CALL TO ORDER: The meeting was called to order by Chairman Robert Erickson at 7:35 p.m. in the City of Apple Valley Community Center, 14603 Hayes Road. Members Present: Chairman Robert Erickson; Members Virginia Sterling, Richard Carlson, Alan Felkner, Marcia Gowling and Frank Kleckner. Staff Present: Lon Aune, Keith Gordon, Rick Kelley, Meg McMonigal, Dennis Miranowski and Dennis Welsch. Others Present: See sign in sheet attached. 2. APPROVAL OF AGENDA: MOTION: It was moved by Member Carlson, seconded by Member Felkner to approve the agenda as written with the addition of an item 8C - Park Hill Rezoning and Plat Request Withdrawal. The motion carried unanimously. 3. APPROVAL OF THE MINUTES OF OCTOBER 5, 1988: The minutes of the October 5, 1988 City of Apple Valley Planning Commission Meeting were approved with one change: Former member Peterson was not present. The minutes were approved unanimously. 4. CONSENT AGENDA: None. 5. PUBLIC HEARINGS: A. Proposed Amendments to the Zoning Ordinance Establishing Flood Zones in the City of Apple Valley, Dakota County, Minnesota. LOCATION: City of Apple Valley, Dakota County, Minnesota. PETITIONER: City of Apple Valley, Dakota County, Minnesota. Planning and Development Director Welsch provided a background verbal report regarding the flood plain provisions of a draft ordinance. He re- quested that the Commission continue the public hearing until November so that further information can be compiled and presented in a formal recom- mendation to the Commission. A general discussion ensued regarding the impact of a flood plain ordinance on the City of Apple Valley. City Engineer Keith Gordon ex- plained the need for correct survey data and noted that it would take about one week to acquire the correct elevations for all of the City's storage ponding areas. He stated that there are between 20 - 50 homes that would be impacted by this project and ordinance. In the 1987 floods, Planning Commission Minutes Page 2 October 19, 1988 only three (3) homes were flooded substantially. None of them were at high risk. Twenty (20) other homes received minor flooding damage; none of which was of a structural nature. He noted that it may be 30 - 50 years before we receive another rainfall and ensuing flood similar to the 1987 situation. No comment was offered by the public the hearing to the November meeting. LAND USE /ACTION ITEMS: A. Garrett Avenue Extension. LOCATION: Upper 139th Street to PETITIONER: City of Apple Valley. Chairman Erickson continued Upper 136th Street. City Planner Rick Kelley provided a background report dated October 19, 1988 in which he reviewed the comments from the October 5th meeting with the neighborhood. He also highlighted the responses received from the City Police and Fire Departments favoring an extension of Garrett Avenue when new subdivisions are created. Member Carlson asked if special assessments would be created for the extension of Garrett Avenue through the park. City Planner Kelley re- sponded that this road extension would be paid for through City funds with no assessments being made. In that case, Member Carlson requested that sidewalks be placed on both sides of the street in order to provide more effective access to the school property to the north. Chairman Erickson asked for clarification regarding the snow shoveling policy on sidewalks created through parks and in front of private properties. Motion DISCUSSION ITEMS: A. Council Action of October 6, 1988 and October 13, 1988 (Verbal Report). Planning and Development Director Welsch provided a summary of City Council actions at the October 6th and October 13th meetings. B. Zoning or Other Code Improvement Suggestions (Commission). Chairman Erickson asked for further information regarding continued work on the gravel ordinances. Planning Commission Minutes Page 3 October 19, 1988 The Commission requested information on ordinance enforcement. General discussion of code enforcement ensued. C. Downtown Tax Increment Financing Redevelopment District. No further information was available on the Redevelopment Tax Increment District in the northwest portion of the downtown except to acknowledge that the City Council would establish a public hearing on such a proposed district for December 1, 1988. D. Economic Development Growth In Apple Valley, Minnesota - September 1988. Dennis Welsch reported that the September growth report will be mailed to the Planning Commission members within the next few days. 8. OTHER BUSINESS: A. Consider Special Meeting. B. Set Hearings For Comprehensive Plan /Zoning Revisions City Planner Rick Kelley asked Planning Commission Members to con- sider establishing three (3) meetings in November for the purpose of continuing normal business and for special zoning revision hearings. The Planning Commission established November 2nd, 9th and 16th as the formal meeting dates for November. The meeting on November 2nd will begin with a 6:15 p.m. study session. The normal business meeting will begin at 7:30 p.m. on that same evening. On November 9th, the Planning Commission will hold public hearings on zoning consistency cases 027, 032, 040 and 048. City Planner Rick Kelley noted that the zoning changes will require property owner and adjacent property notification, but that comprehensive plan amendment requirements only provide for newspaper publication and no individual notice. C. Park Hill Rezoning And Plat. City Planner Rick Kelley explained that the developers of the Park Hill Rezoning and Plat have formally requested that the rezoning and the plat be withdrawn from further consideration and that the property in question retain its existing "M -2" zoning classification. No action was necessary by the Planning Commission. 9. ADJOURNMENT: The meeting adjourned at 8:30 p.m.
