8th ADDITION
Chair Erickson opened the public hearing with the standard opening remarks.
Mr. Kelley presented the petition for a preliminary plat to subdivide property
creating 11 detached single family lots (Heritage Hills 8th Addition) . The proposed
plat is centered on future C. R. X138 but does not indicate any right -of -way dedica-
tion for this road. The plat is inconsistent with Apple Valley's and Dakota County's
Thoroughfare Plans. Mr. Kelley reviewed the Planned Development agreement for
the overall development of the Heritage Hills area. Paragraphs 5 and 7 of this
agreement recognized the existence of the future county road and a commitment
to dedicate the right -of -way. Attached with the minutes is a letter received
from the Dakota County Highway Department indicating their objection to this plat.
Mr. Kelley indicated that he believed the intent of the planner is to have the County
purchase the property (150') rather than having to dedicate it. Given the alignment
of C. R. #38 (10 years planning) this plat would create many problems.
No one from the public wished to speak to this public hearing.
MOTION: of Sterling, seconded by Cowling, to continue the Public Hearing until
December 2, 1987.
VOTE: Yes, 4; No, 0.
