PLANNING COMMISSION MINUTES
June 17, 1987
Minutes of the meeting of the Apple Valley Planning Commission held Wednesday,
June 17, 1987, at 7:30 p.m. at the Apple Valley City Hall.
PRESENT: Chairperson Robert Erickson; Commission Members Richard Carlson, Marcia
Cowling, and Frank Kleckner. Staff members Rick Kelley, Meg McMonigal,
Keith Gordon; 11 members of the public.
ABSENT: Virginia Sterling, Philllip Peterson and Arleigh Thorberg.
1. Chairperson Erickson called the meeting to order at 7:33 p.m.
2. Approval of Agenda.
MOTION: of Carlson, seconded by Kleckner, to approve the agenda AGENDA
as presented. VOTE: Yes - 4, No - 0.
3. Approval of minutes of June 3, 1987.
MOTION: of Cowling, seconded by Carlson, to approve minutes as
corrected. VOTE: Yes - 2, No - 0, Abstain - 2
(Erickson and Kleckner).
4. Public Hearing for Rezoning to GB, Preliminary Plat and Condi-
tional Use Permit - Auto Service Center.

Chair Erickson opened the public hearing with the standard opening remarks. Mr.
Kelley presented the petition for a rezoning to General Business, conditional use
permit for outdoor vehicle storage and preliminary plat to subdivide property by
creating a new commercial lot. Keith Gordon reported that all services are avail-
able to the area. Dick Winkler asked what is the highest point of the building. It
is 16 feet. Sheldon Lubar, Milwaukee, WI, a partner of the Learning Tree Daycare
Center telephoned to oppose the use and change in zoning because he feels it is
inconsistent with the proximity of a daycare center. There were no further comments
and the hearing was closed with the standard closing remarks.
The petitioner requested that the Planning Commission act on the requests at this
meeting in order for them to proceed as soon as possible.
MOTION: of Cowling, seconded by Carlson, recommending approval of the rezoning
from PD #244, Zone 2, (retail with some offices) to GB (general business).
VOTE: Yes - 4, No - 0.
MOTION: of Carlson, seconded by Cowling, recommending approval of the preliminary
plat. VOTE: Yes - 4, No - 0.
MOTION: of Kleckner, seconded by Cowling, recommending approval of the Conditional
Use Permit with the restriction that not more than 20% of the parking
spaces be used for outside parking of inoperable or physically damaged
vehicles. VOTE: Yes - 4, No - 0.

MOTION: of Cowling, seconded by Carlson, to recommend approval of the building
permit in accordance with the site plan and specifications. VOTE: Yes -
4, NO - 0.
5. Consideration of Revised Preliminary Plat for Apple Ponds Development.
LOCATION Northwest Quadrant of the Intersection of Cedar REVISED PRELIM.
Avenue & County Road #46 PLAT -APPLE PONDS
PETITIONER Winkler Development
John Voss presented the revised preliminary plat for Apple Ponds, explaining changes
which had been made from the original plat. Mr. Erickson stated his concern with
considering this development again after the Planning Commission imposed a mora-
torium on the use of substandard lots at the June 3 meeting and they have received
no direction from the City Council at this time. It was noted by the Chair that the
park issue has been resolved and positive changes have been made in the street
alignment, however, many of the lots are still under 80' wide.
MOTION: of Cowling, seconded by Carlson, to recommend denial of the plat on the
grounds of the moratorium imposed by the Planning Commission at its
meeting on June 3 regarding substandard lots, noting, however, that the
Planning Commission feels that the park issue has been satisfactorily
resolved. VOTE: Yes - 3, No - 0, Abstain - 1 (Kleckner).
6. Site Plan Review and Building Permit Authorization for An Office Building.

Ms. McMonigal made the staff presentation for this item. The architect and
petitioners were present to answer questions. Commission members asked if
moving one parking space to conform to setbacks from Garrett Avenue would be
difficult to accomplish. The architect replied that it would not.
MOTION: of Carlson, seconded by Kleckner, recommending approval of the site plan
and issuance of the building permit pending resolution of the parking
setback. VOTE: Yes - 4. No - 0.
7. Sketch Plan Review for Residential Lot Split or Day Care Center
LOCATION On Cedar Avenue Frontage Road, North of 138th St. W. SKETCH PLAN
PETITIONER: Mary Wilker REVIEW - WILKER
PROPERTY
Ms. McMonigal presented the staff report for this item. Mr. Wilker was pre-
sent and stated that he was seeking ideas from the Planning Commission regard-
ing his options for this property. The Planning Commission stated that it
would not be favorable to daycare (business) use in a residential area like
this. It appeared that his best options were to look at layouts for a duplex
lot on the lot or to attempt to sell the property to the owners of the lots
surrounding his property when the lots have been sold. No action was taken on
this item.

Comprehensive Land Use Plan versus Zoning was discussed as an extra item. Consul-
tant John Voss said the conflict is a point of discussion in many communities. In
commercial and industrial areas, it is okay to go ahead and rezone if the City is
fairly certain that will be the permanent use. In residential areas, it is un-
known what the future will bring. The market changes so quickly that the, city
probably wants to retain flexibility in those areas.
8. Ms. McMonigal briefly reviewed the demographic information from the June 10th
Comprehensive Plan meeting. The next meeting for the Comprehensive Plan will
be July 8th. That meeting will be an "issue identification" session.
