HomeMy WebLinkAbout08/19/1987CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES August 19, 1987 Minutes of the meeting of the Apple Valley Planning Commission held Wednesday, August 19, 1987, at 7:30 p.m. at the Apple Valley City Hall. PRESENT: Chairperson Robert Erickson; Commission Members Richard Carlson, Frank Kleckner, Virginia Sterling; Staff Members Rick Kelley, Meg McMonigal; two members of the public. ABSENT: Marcia Cowling, Phillip Peterson, Arleigh Thorberg. 1. Chairperson Erickson called the meeting to order at 7 :30 p.m. 2. Approval of Agenda. AGENDA MOTION: of Carlson, seconded by Kleckner, to approve the agenda as presented. VOTE: Yes, 4; No, 0. 3. Approval of Minutes of August 5, 1987. MOTION: of Sterling, seconded by Carlson, to approve the MINUTES minutes of August 5, 1987, as presented. AUGUST 5,19E VOTE: Yes, 4; No, 0. 4. Variance for Garage Addition. LOCATION 930 Redwood Circle VARIANCE PETITIONER Gregory A. Hanson,.: GARAGE ADD. Ms. McMonigal presented the petition for variance to setback requirements for an addition to a garage which would bring the garage to 1'9" of the property line in the back and 4'2" in the front,rather - than the 5' required by ordinance. The topography in the back prohibits the petitioner from expanding in that direction; an expansion to the side, however, would require some work on the neighbors property so that storm water would drain away from the garage. Discussion ensued as to the need for work to be done on the neighbor's property so that storm water would drain properly. Chair Erickson emphasized that it would be important for the petitioner to talk to the neighbor regarding needed work on his property. Mr. Kleckner suggested to the petitioner that he secure the opinion of an engineer to consider a 3+ block wall, which would require less grading. The Planning Commission requested that the petitioner secure a letter from his neighbor indicating his approval before they act on this matter. MOTION: of Sterling, seconded by Carlson to TABLE action on the request for a garage addition variance until the petitioner can talk with his neighbor and also get recommendations from an engineer. VOTE: Yes, 4; No, 0. PLANNING COMMISSION MINUTES August 19, 1987 Page 2 5. Variance for Mud Room Addition to Garage. LOCATION 5830 130th Street Court MUD ROOM ADI PETITIONER: Mark Furtney. TO GARAGE Ms. McMonigal presented the petition for variance to setback requirements for an addition to a garage - -a mud room. This variance would bring the garage within 3' of the property line, rather than the 5' required . by ordinance. There is a pathway leading to Hagemeister Park between this property and the next house. The Petitionel presented a sketch of what he wished to do and also the distances between his house and the pathway and the pathway and the next house. Chair Erickson indicated that he does not like to grant variances, but in this situation the distances to the common pathway and to the adjoining house being what they are could make this variant justifiable. Mr. Kelley indicated the City would not have a problem with this as it would not have an adverse affect on the neighbor. Mr. Carlson also indicated he does not have a problem with granting this variance eventhough he is not a "champion" of sideline variances, but with such distances as are present in this situation, grant- ing of this variance would not bother him.. (This pathway is wider than usually required.) MOTION: of Kleckner, seconded by Sterling, to recommend approval of a variance for a garage additon to within 3' of the property line, rather than the 5' required - by ordinance because of the unique sitution present- -the large distances between this property and Any other property owner. VOTE: Yes, 4; No, 0. 6.. Resolution Amending Planning Commission By -Laws. Ms.McMonigal presented the suggested revisions to the by -laws of the RESOLUTION AMENDING. Planning Commission. Chair Erickson indicated he had read them and PLANNING had a problem with ABSENCES and MEETING PROCEDURES, Page 2. He COMMISSION felt that under Absences a number should be inserted and that BY -LAWS under Meeting Procedures the words notifying the Secretary and Chairman if more than number /percentage of absences had occurred. Discussion ensued as to the number of meetings that would be allowable to be absent from, etc. presented be amended to MOTION: of ..Carlson, seconded by Sterling, that the Planning Commission By -Laws/ include the following: ABSENCES: A member missing 6 or more regularly scheduled meetings in a calendar year shall be reported by the Secretary or the Chairperson to the City Council and MEETING PROCEDURES: (add) and City Staff shall notify the Secretary or Chairman when a member has missed 6 regularly scheduled meetings in a calendar year, and that Ms. McMonigal will include a revised copy of the by -laws in the next packet., 7. Other Items. Gravel Operations- -Chair Erickson commented on the tour of the gravel operations, of the future development across from Andy's, of the long term and short term implications to the City for the area south of CR #42 where Fischer holds a permit to mine 30% of the land; etc. 8.
