HomeMy WebLinkAbout05/20/1987CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES May 20, 1987 Minutes of the meeting of the Apple Valley Planning Commission held Wednesday, May 20, 1987, at 7:30 p.m. at the Apple Valley City Hall. PRESENT: Chairperson Robert Erickson; Commission Members Richard Carlson, Marcia Cowling, Virginia Sterling, Philllip Peterson and Arleigh Thorberg. Staff members Rick Kelley, Meg McMonigal, Keith Gordon; 35 members of the public. ABSENT: Frank Kleckner. 1. Chairperson Erickson called the meeting to order at 7:32 p.m. 2. Approval of Agenda. MOTION: of Thorberg, seconded by Cowling, to approve the agenda as presented. VOTE: Yes - 6, No - 0. 3. Approval of minutes of May 6, 1987. MOTION: of Cowling, seconded by Sterling, to approve minutes as corrected. VOTE: Yes - 5, No - 0, Abstain - 1 (Erickson). 4 Public Hearing for Replat of Apple Valley Commercial 3rd Addition,. LOCATION On Cedar Avenue, former Jimmy's Building PETITIONER: Reason Investments, Inc. AGENDA MINUTES OF APRIL 1. 1987 PH REPLAT A.V. COMM. 3RD ADDN. Chair Erickson opened the public hearing with the standard opening remarks. Ms. McMonigal presented the petition to subdivide Lot 2, Block 2, Apple Valley Com- mercial Addition into two lots. One lot would be used for an office building, the use for the other lot is undetermined. Keith Gordon stated that there are shallow utilities under that parcel and any building with a basement would re- quire a sump pump. The petitioner said Coldwell Banker will use the present building. No one from the public was present to speak. The Chair declared the public hearing closed with the standard closing remarks. The petitioner requested that the Planning Commission act on the preliminary plat at this meeting in order for them to meet their schedule. 5 LOCATION Between 132nd Street and the Zoo Road, west of Calaxie PH REZONING TO PETITIONER Bill Coady NC -1- ANDY'S MKT Chair Erickson opened the public hearing with the standard opening remarks. Ms. McMonigal presented the preliminary plat and request for rezoning from "M -3" to "R- 1C" for 16 detached single family lots and one outlot for future development. Mr. Gordon said there was no problem with the plat and that city services would be available after 132nd Street is upgraded this summer. Steve Watcher, 7250 132nd MOTION: of Thorberg, seconded by Carlson, recommending approval of the preliminary plat to subdivide into two lots. VOTE: Yes - 5, No - 0, Abstain - 1 (Sterling). Public Hearing for Rezoning and Preliminary Plat - Royal Oaks PLANNING COMMISSION MINUTES May 20, 1987 Page 2 Street, asked what the density of the outlot would be. Mr. Erickson replied that the answer to that question was not available at this time. Jim Mattaiola, 8605 Hunters' Way, asked why public hearing notices are only mailed to property owners within 350' of property being considered for change. Mr. Erickson stated that that is the distance legally required by the State of Minnesota. Mark Mullin, 13146 Heritage Way, asked why the Comprehensive Plan takes precedence over zoning and would like to have a larger area that 350' noticed for public hearings. Mr. Erick- son responded that the Comp Plan does not take precedence over zoning but when a property owner wishes to make a change on a piece of property, and requires a zoning change, that change must be in conformance with the Comprehensive Plan or a public hearing must be held. The Planning Commission does not decide who should be noticed for public hearings but if they believe the procedure should be changed, it could be discussed at another meeting and any recommended change could be forwarded to City Council. There were no more questions and the public hearing was closed. Because the City Council is expected to approve the 132nd Street improvements at its meeting on May 28, the Planning Commission will make its recommendation to Council at the next meeting, June 3. 6. Consideration of Rezoning from R -1C to M -2 and Preliminary Plat - Crestview Forest Townhomes LOCATION Southwest Quadrant of the Intersection of Palomino REZONE CRESTVIEW Drive and Garden View FOREST TOWNHOMES PETITIONER Vista Development Ms. McMonigal presented the request for rezoning to M -2 and preliminary plat for the 142 unit townhouse development. The public hearing on this project was held at the last Planning Commission meeting. Members of the public were present for this meeting because they thought it was a continuation of the public hearing. Residents of the area presented a petition with 136 signa- tures objecting to the construction of townhouses on this property. Mr. Thor - berg asked the developer where the buildings would be located on the ridge along Palomino? Mr. Dietrich said it would be on the south side and below the crest of the ridge. Ms. Sterling asked is the structures were twinhomes or fourplex units? There are both in the project. Mr. Carlson asked why single family units were not being proposed for this development and what kind of traffic will the multiple units generate? Mr. Dietrich said they are propos- ing multiple units because the parcel is surrounded by major roads and they believe townhouses will be more attractive at this location. He also said that Palomino Drive is designated as a community collector designed to handle 30,000 trips a day and would be able to handle the traffic generated by the project. Ms. Sterling asked how flexible is the Comprehensive Guide Plan with respect to multiple or single units in specific areas. Mr. Gretz replied that it is quite flexible and that is the intent of the document. Mr. Thorberg suggested that the Commission members walk the property prior to making a decision on this request. MOTION: of Carlson, seconded by Cowling, to table this item until the next meeting and to meet at 6 p.m. on Wednesday, May 27, on the corner of Garden View and Palomino to walk the property. Consideration of Preliminary Plat for Wildwood Pond Townhomes. LOCATION S/W Quadrant of the Intersection of Pennock & 140th Street W. PETITIONER: Miles Development, Ltd. PRELIM PLAT WILDWOOD POND TOWNHOUSES Ms. McMonigal presented the preliminary plat for this development of 19 town- house units. Replatting is required due to the change from condominiums to townhouses which require separate lots. The technical requirements are met by the plat and no comments were received at the public hearing on May 6, 1987. The developer stated that this is a particularly difficult piece of property to work with and they have done everything possible to meet the City's re- quirements. It is possible that they will still have to come back and ask for a setback variance for one of the buildings. Ms. Sterling voiced concern regarding this possible variance and the lack of space between two of the buildings. MOTION: of Peterson, seconded by Thorberg, to forward this project to the City Council with a recommendation to approve. VOTE: Yes - 4 - No - 2 (Sterling and Cowling). 8. Consideration of Rezoning from LB to M -2 and Preliminary Plat - Pennock Shores Third Addition LOCATION On Glenda Drive, North of 145th Street W. REZONE PENNOCK PETITIONER Vista Development SHORES 3RD Ms. McMonigal presented the request for rezoning to M -2 and preliminary plat for two four -unit townhouses. The area is designated for limited business but the developer believes that multiple residential is a better use for the lot. The change is compatible with the land use guide plan. Commission members questioned placing residential use directly across from a limited business zone. MOTION: of Thorberg, seconded by Sterling, to forward this item to City Council with a recommendation to approve. VOTE: Yes - 5, No - 1 (Carlson). 9. Sketch Plan for Valley Meadows. LOCATION East Side of Garden View Drive, South of Heywood Path SKETCH PLAN PETITIONER American Heartland Homes, Inc. VALLEY MEADOWS Ms. McMonigal presented the sketch plan for 15 duplex units with a private road and driveway system. Mr. Gretz suggested that the developer consider a public loop street through the property from Heywood Path to Garden View Drive to facilitate snow removal. The developer said they had no problem with that but they might need smaller setbacks on some of the lots to permit the wider right -of -way required for City streets. The petitioner stated that they are working around two pipelines that run through the property and may have to request setback variances on the south side of the plat. Commission members were concerned about granting setback variances for a multiple housing project which abuts single family housing. The developer said he did not believe this would be a problem.
