Call to Order The meeting was called to order at 7:00 p.m. by Linda Dolan. Members Present: Linda Dolan, Nick Francis, Charles Grawe, Dave McKenzie, Matt Saam Members Absent: Arthur Zimmerman, Joe Shaw Consultants/Alternates Present: Brandon Anderson Others Present: Brain Hurley, Mark Ketterer, Greg Nelson, John Peschman, Jeff Pricco, Mike Saice, Tom Walden, Nicholas Zeitler 2. Approval of Agenda _ MOTION: Mr. Saam moved, second by Mr. McKenzie, to approve the agenda as presented, but to reorder items to deal with those items with public attendees first. Motion passed 5-0. 3. Audience Items Mr. Zeitler and Mr. Peschman expressed concern about a sharp right angle turn at Whitney Drive and Hyacinth Path. There is a playground on the north side of Whitney in advance of the turn. Residents are concerned about vehicle speeds. Mr. Anderson said the roads were recently reconstructed and some changes were made to the adjacent pathways to eliminate the temptation to cross at the turn. The Engineering Division is reviewing additional signage and curve delineation markings. 4. Approval of July 14, 2021 Minutes MOTION: Mr. Grawe moved, second by Mr. McKenzie, to approve the Minutes of July 14, 2021. Mr. Francis and Mr. Saam abstained. Motion passed 3-0. 5A. Request for Dead End or No Outlet Sign at 1381h Street Court Mr. Anderson received a request from residents to install signage at the beginning of a longer cul-de-sac. The "Dead End"verbiage is the approved signage in the Minnesota Manual on Uniform Traffic Control Devices. Mr. Anderson recommended installing a"Dead End" sign to be consistent with other cul-de-sac signage. Mr. Anderson noted that the increase of home deliveries during the pandemic has led to a 10 to 15 percent increase of traffic volumes on most residential streets. MOTION: Ms. Dolan moved, second by Mr. Francis, to recommend installation of the Dead End sign as recommended by the City Engineer. Motion passed 5-0. 5B. Crosswalk Request at 152nd and Gallivant Mr. Anderson received a request from employees at Apple Valley Ford for a marked crosswalk across 152nd Street. Ford leases parking spaces in the municipal lot across 152nd and employees have experienced difficulty crossing due to traffic volumes and speeds. Mr. Anderson recommended extending the parking restriction the full length between the Ford driveway and L.A. Fitness driveway to improve sight lines. He also suggested adding lane striping to 152nd Street as a traffic calming measure. He asked for a more detailed study to determine if a marked crosswalk would be feasible. MOTION: Mr. Grawe moved, second by Ms. Dolan, to recommend the recommended parking restriction and lane striping and to initiate a study of the surrounding area to evaluate if additional measures might be appropriate. Motion passed 5-0. 5C. Crosswalk Request at 1471h Street and Haven Drive Mr. Anderson said that due to the curve of 1471h Street, the controlled intersections at County Road 42 and Pennock Avenue are a long distance apart. Residents requested a mid-block crossing at Haven Drive. Mr. Anderson said a further engineering study would be necessary. MOTION: Mr. Grawe moved, second by Mr. Francis, to initiate a study of the surrounding area to evaluate if a crossing might be appropriate. Motion passed 5-0. 5D. Review of Diamond Way No Parking Si nnaage Mr. Anderson explained that this is a loop street and parking is prohibited on one side of the three through the entire loop. There are several existing signs, but they are near trees or other things that could obstruct or distract from them. Mr. Anderson recommended the addition of signs to clarify that parking is prohibited through the loop. MOTION: Mr. Saam moved, second by Mr. McKenzie, to recommend installation of signage as recommended by the City Engineer. Motion passed 5-0. 5E. Review of Driver Feedback Sign Data Mr. Anderson provided a brief review of the collected data. 1341h Street between 1401h Street and Garden View Drive: The data showed very low traffic volumes and an 85th percentile speed of under 25 miles per hour. Johnny Cake Ridge Road at 138th Court: The data showed a high 85th percentile speed of 45 miles per hour. The speed limit is 40 miles per hour. Whiney Drive between Pennock Avenue and Garden View Drive: The data showed a relatively high 85th percentile speed of 33 miles per hour. The speed limit is 30 miles per hour. Pennock Avenue near Wallace Park: The data showed a high 85th percentile speed of 35 miles per hour. The speed limit is 30 miles per hour. The data also showed some very high maximum incident speeds, with some recorded near 70 miles per hour. 6A.Other Traffic Concerns Communicated to the City of Apple Valley Police Concerns The City received complaints of speeding on Findlay Ave near Fawn Ridge Court. Staff is looking at installing temporary driver feedback signs at that location. Public Works Concerns Mr. Anderson said staff is working on education efforts for the new pedestrian crossings at Greenleaf Elementary and Valley Middle School. 6B.Educational Issues Ms. Dolan provided a brief educational issues update. 7. Adjourn MOTION: Mr. Saam moved, second by Mr. McKenzie, to adjourn. Motion passed 5-0. Meeting was adjourned at 8:30 p.m. CITY OF APPLE VALLEY ORDINANCE NO. AN ORDINANCE OF THE CITY OF APPLE VALLEY, MINNESOTA, AMENDING CHAPTER 72 OF THE CITY CODE REGULATING USE OF RECREATIONAL VEHICLES ON PUBLIC OR PRIVATE PROPERTY BY ADDING REGULATIONS REGARDING THE OPERATION OF LOW POWER MOTORIZED VEHICLES ON SIDEWALKS AND PATHWAYS WITHIN THE CITY The City Council of Apple Valley ordains: Section 1. Chapter 72 of the Apple Valley City Code is amended by revising Section 72.01 to read as follows: § 72.01 PURPOSE. The purpose of this chapter is to provide reasonable regulations,for the use of snowmobiles, aad all-terrain motor vehicles, and low power vehicles on public and private property in the city. It is intended to protect life, property,and to prevent public nuisances. If any provision in this chapter contradicts the regulations set forth in M.S. Chapters 168 (motor vehicle registration), 169 (motor vehicle operation)," -171 (driver license regulations) or 84 (snowmobile and all-terrain vehicle regulations), the state regulations shall control. Section 2. Chapter 72 of the Apple Valley City Code is amended by adding the following definitions to Section 72.02 to read as follows: § 72.02 DEFINITIONS. ELECTRIC PERSONAL, ASSISTIVE MOBILITY DEVICE. A self-balancing device with two non-tandem wheels, designed to transport not more than one person, and operated by an electric propulsion system that limits the maximum speed of the device to 15 miles per hour. ELECTRIC ASSISTED BICYCLE. A bicycle with two or three wheels that: (1) has a saddle and fully operable pedals for human propulsion, (2) meets the requirements: (i) of federal motor vehicle safety standards for a motor-driven cycle in Code of Federal Regulations, title 49, sections 571.1 et seq.; or (ii) for bicycles under Code of Federal Regulations, title 16, part 1512, or successor requirements, and 1 (3) has an electric motor that(i) has a power output of not more than 1,000 watts, (ii) is incapable of propelling the vehicle at a speed of more than 20 miles per hour, (iii) is incapable of further increasing the he speed of the device when human power alone is used to propel the vehicle at a speed of more than 20 miles per hour, and (iv) disengages or ceases to function when the vehicle's brakes are applied. LOW POWER VEHICLE. A devise that is self-propelled or power assisted by a combustion engine or electric motor serving as a mode for personal transportation. A low power vehicle may include, but not be limited to the following devises: electric-assisted bicycles, motorized skateboards, motorized foot scooters, hoverboards, motorized children's toys designed with the primary purpose of operation by a child,or other vehicles not licensed for roadway use under the provisions of Minnesota Statutes, .Chapter 168. A low power vehicle is not an electric personal assistive mobility device, motorized bicycle, and a pocket bike. MOTORIZED BICYCLE. A bicycle that:is propelled by an electric or a liquid fuel motor of a piston displacement capacity of 50 cubic centimeters or less, and a maximum of two brake horsepower, which is capable of a maximum speed,of not more than 30 miles per hour on a flat surface with not more than one percent grade in any direction when the motor is engaged. Motorized bicycle does not include an electric-assisted bicycle or pocket bike as defined herein. MOTORIZED FOOTSCOOTER. A device with handlebars designed to be stood or sat upon by the operator,and p6wered by an internal com'bntion,engine or electric motor that is capable of propelling,the device with or without human propulsion, and that has no more than two 12-inch or smaller diameter wheels and has an engine or motor that is capable of a maximum speed of 15 miles per hour on a flat surface with not more than one percent grade in any direction when the motor is engaged. An electric personal assistive mobility device, a motorized bicycle, an electric-assisted bicycle, or a motorcycle is not a motorized foot scooter. POCKET BIKE. A 'self-propelled,miniature motorcycle that is equipped with an electric motor or two or four-stroke combustion engine having a piston displacement of not less than XX cubic centimeters, is designed_ to propel itself with not more than two wheels in contact with the ground,has a Seat or saddle for the use of the operator, is not designed for use on a highway, and is ineligible for title and registration under Minnesota law. A pocket bike includes those vehicles also referred to as pocket rocket or mini-pocket rocket. A pocket bike does not include a motorized foot scooter or motorized bicycle as defined herein or a mini-bike. PATHWAY. A paved surface constructed separately from the roadway, designed for public pedestrian travel, comprised of bituminous material, and having a width of no less than 7 feet and no more than 10 feet. SIDEWALK A paved surface constructed separately from the roadway, designed for public pedestrian travel, comprised of concrete material, and having a width 5 feet or less 2 except in the area of the Ring Route and similar business focused areas where the sidewalk widths are larger than normal. Section 3. Chapter 72 of the Apple Valley City Code is amended by revising Section 72.03 to read as follows: § 72.03 AREAS OF OPERATION. (A) The operation of snowmobiles is prohibited in the city, except on trails specifically marked as "snowmobile trails"within the boundaries of Lebanon Hills Regional Park. (B) The operation of an ATV or recreational vehicle other than a snowmobile is prohibited in the city, except in the following areas: (1) On trails specifically marked as"ATV trails" or"recreational vehicle trails"; (2) On private property when in possession of written penni'ssion of the landowner or tenant having control of the property. Written permission shall contain the name and address of the owner and a telephone number where the owner may be'Contacted to verify permission. The permission need not be carried when on,a marked, approved trail; or (3) On state and county highways except as otherwise permitted in this chapter. (C) Operations of snowmobiles and,ATV'"s on public sidewalks and boulevard areas is specifically prohibited, except as provided in § 72.04. (D) The operation of a pocket bike or a low power vehicle that is capable of a speed of more than 20 mph by motorized propulsion is prohibited on public sidewalks, public pathways, and in parks other than n.desi_ ate parkin_ g lots,except when directly crossing a public sidewalk or pathway when the operation is necessary to enter or leave adjacent property. (E) The operation of a jow power vehicle that is not capable of a speed of more than 20 mph by motorized propulsion is permitted as follows: (1) On a public sidewalk in the Ring Route and other business districts if the public sidewalk is wider than five( )feet, (2) On public pathways, and (3) When directly crossing a public sidewalk or pathway to enter or leave adjacent property. (F) The operation of a motorized foot scooter is prohibited on public sidewalks, except when directly crossing a public sidewalk to enter or leave adjacent property. 3 (RG) This section shall not apply to city agents, employees or police officers acting in their official capacity. Section 4. Summary approved. The City Council hereby determines that the text of the summary marked "Official Summary of Ordinance No. " a copy of which is attached hereto clearly informs the public of the intent and effect of the ordinance. The City Council further determines that publication of the title and such summary will clearly inform the public of the intent and effect of the ordinance. Section 5. Filing. A copy of the ordinance shall be filed in the office of the City Clerk. This copy shall be available for inspection by any persons during,regular office hours. Section 6. Publication. The City Clerk shall publish the title of this ordinance and the official summary in the official newspaper of the City with notice that a printed copy of the ordinance is available for inspection by any person during regular office hours at the Office of the City Clerk. Section 7. Effective date. This ordinance shall take effect upon its passage and the publication of its title and the official summary. PASSED by the City Council this day"of, ,2021. AN ORDINANCE OF THE CITY OF APPLE VALLEY,MINNESOTA,REVISING CHAPTER 72 OF THE CITY CODE REGULATING USE OF RECREATIONAL VEHICLES ON PUBLIC OR PRIVATE PROPERTY BY ADDING DEFINITIONS AND REGULATIONS FOR THE USE OF LOW POWER MOTORIZED VEHICLES ON SOME PATHWAYS IN THE CITY The following is the official summary of Ordinance No. passed by the City Council of Apple Valley on 2021: Chapter 72 of the City Code is revised to adddefinitions for various gas and electric motorized personal transportation devices, "sidewalk," and "pathway." The chapter is further revised to restrict from operation on public sidewalks,public pathways, and in parks the use of motorized bicycles,pocket bikes, and low power-vehicles capable of exceeding 20 mph. Low power vehicles not capable of exceeding 20 mph by motorized propulsion are prohibited on public sidewalks and in parks except that their use is permitted on public sidewalks within the Ring Route and business districts where the public sidewalk is wider than 5 feet and onpltblic pathways. The use of a motorized foot scooter on a public sidewalk,is prohibited.
