HomeMy WebLinkAbout10/26/1995CITY OF APPLE VALLEY Dakota County, Minnesota October 26, 1995 Minutes of the meeting of the City Council of Apple Valley, Dakota County, Minnesota, held October 26th, 1995, at 8:00 o'clock p.m., at Apple Valley City Hall. PRESENT: Mayor Branning; Councilmembers Erickeon, Goodwin, and Sterling. ABSENT: Gouncilmember Humphrey. City staff members present were: City Administrator Oretz, City Clerk Mueller, City Attorney Sheldon, City Engineer Gordon, Finance Director Ballenger, Assistant Planner Bodmer, Administrative Intern Grawe, Parks & Recreation Director Johnson, Community Development Director Kelley, and Public Works Director Miranowski. Mayor Branning called the meeting to order at 8:04 p.m. The Councilmembers and everyone in attendance took part in the pledge of allegiance to the flag. The Council accepted the agenda for tonight's meeting as presented with no changes. END OF CONSENT AGENDA Mayor Branning called the public hearing to order at 8:06 p.m. to con- PUBLIC HEARING sider 1995 Special Assessment Rolls 368 through 383 and 384 and noted 1995 ASSESS- receipt of the affidavit of publication of the hearing notice. The MENT ROLLS City Clerk reviewed the proposed assessments. Rolls No. 368 through 383 are for utility and street improvement projects totaling $5,560,395. Roll No. 384 is for delinquent utility charges totaling $15,849.50. No written objections to any of the assessments have been received. The Mayor asked for questions or comments from the Council and the public. There were none and the hearing was declared closed at 8:07 p.m. MOTION: of Erickson, seconded by Goodwin, adopting Resolution No. 1995-283 approving 1995 Special Assessment Rolls No. 368 to 383, in the total amount of $5,560,395.00, for certification to Dakota County. Mr. Kelley reviewed the Planning Commission report on the proposed ACADEMY Academy Townhomes located northeast of 143rd Street and Heywood Avenue. ~OWNHOMES The development is proposed for 25 units with 17 units on the north side and 8 units on the south side of the site. CITY OF APPLE VALLEY Dakota County, Minnesota October 26, 1995 Page 4 Glen Van Wormer, the City's traffic consultant, reviewed his report estimating 150 vehicles per day would access the site from 142nd Street with only one access from the west. The west access would provide the best traffic flow for the development and prevent vehicles from using the parking lot to travel between Hayes Road and Garden View Drive. MOTION: of Erickson, seconded by Goodwin, adopting Resolution No. 1995-285 approving the preliminary plat of Academy Townhomes and directing preparation of a subdivision agreement; Resolution No. 1995-286 approving a Conditional Use Permit for synthetic siding on Lots 2, 3, 4, and 6, Block 1, Academy Village; and Resolution No. 1995-287 approving the site plan and authorizing issuance of a building permit for Academy Townhomes; all with conditions as recommended by the Planning Commission. PERMIT MOTION: of Sterling, seconded by Goodwin, amending the foregoing AMEND MOTION motion by conditioning approval on vacation of the south half of the unconstructed 142nd Street right-of-way. Mr. Kelley said the Planning Commission reviewed the neighboring residents' request for a pathway on the 142nd Street right-of-way and determined it would not be a necessary link in the pathway system. The residents had suggested a woodchip pathway which the City has not installed due to maintenance problems. Mayor Branning asked if access to the site from Hemlock Court was considered? Mr~ Kelley said the Engineer reviewed that possibility and determined it was not practical due to topography. Councilmember Goodwin asked whether the new intersection at 142nd Street Court could be moved farther east to lessen the impact of vehicles' lights on the residence at 8489 - 142nd Street Court? Mr. Kelley said moving it farther east would require removing more vegetation intended to be maintained as a buffer. Councilmember Sterling asked if screened porches could be added to the units? Mark Hebert, the developer, was present and showed renderings of the units. At least two screened porches will be added on each building. Dick Unger, 8489 - 142nd Street Court, said he would prefer having the entrance for the development located at the northeast corner of the site and the northwest corner closed to access. Mayor Branning asked about constructing an east access but closing it to traffic. Mr. Van Wormer said any access there would open the possibility of traffic from the high school using the parking lot to cut through to Garden View Drive instead of 143rd Street. The plan shows about 20 feet from a turn-around to the cul de sac on the east. It could be increased to 30 feet and still allow enough space for emergency vehicles to turn around. MOTION: of Erickson, seconded by Sterling, adopting Resolution No. 1995-288 approving a subdivision grading permit for Academy To~r~homes, as recommended in Ms. Bodmer's memo dated October 23, 1995, excluding the 142nd Street right-of-way until vacation has been considered. MOTION: of Goodwin, seconded by Sterling, adopting Resolution No. 1995-289 setting a public hearing, at 8:00 p.m., on November 21, 1995, to consider vacating easements on Lots 2, 3, 4, and 6, Block 1, Academy Village; and the unconstructed portion of 142nd Street right-of-way in conjunction with Academy To~Thhomes development. Ayes - 4 - Nays - 0. Mayor Branning reported that the MVTA has contracted for express bus MVTA TRANSIT service during to the transit strike. It appears the strike will be UPDATE settled and full service will resume Sunday. The MVTA did commit to continue the extra buses for a certain period of time even though the strike may be settled. He also reported on the 7-County Steering Committee meeting to prepare a recommendation on regional transit issues. Mr. Kelley reported on a Metro-Wide GIS workshop hosted by the Metro- politan Council. Discussions are centering on the potential for cross-county utilization of GIS information. METRO-WI~E GIS HOLIDAY LIGHTING Councilmember Sterling said the Optimists' Glub will be sponsoring a holiday lighting competition this year.
