HomeMy WebLinkAbout12/28/1995CITY OFAPPLE VALLEY Dakota County, Minnesota December 28, 1995 Minutes of the special meeting of the City Council of Apple Valley, Dakota Gounty, Minnesota, held December 28th, 1995, at 12:00 o'clock noon, at Apple Valley City Hall. PRESENT: Mayor Branning, Councilmembers Erickson, Goodwin, Humphrey, and Sterling. ABSENT: None. City staff members present were: .City Administrator Gretz, City Clerk Mueller, City Attorney Margarit, City Engineer Cordon, Administrative Intern Grawe, Gommunity Development Director Kelley, Public Works Director Miranowskt, and Police Ghtef Willow. Mayor Branning called the meeting to order at 12:00 noon. MOTION: of Erickson, seconded by Sterling, approving the agenda for today's meeting as amended. Ayes - 5 - Nays - 0. APPROVE AGENDA Mr. Miranowski reviewed the terms of a proposed purchase agreement for PONDING AREA a ponding area and easements in the northwest corner of County Road 46 PURCHASE and Pilot Knob Road from McNamara, as contained in the City Attorney's memo dated December 27, 1995. The document is still being drafted. The purchase price will be $445,000 plus 1996 taxes. The property is needed in connection with Project 93-425, the Central Trunk Storm Sewer. MOTION: of Goodwin, seconded by Sterling, approving the Purchase Agreement with MeNamara for a ponding area northwest of County Road 46 and Pilot Knob Road as detailed in the City Attorney's memo dated December 27, 1995, and authorizing the Mayor and Clerk to sign the necessary documents. Ayes - 5 Nays - O. McNAMARA POND PURCHASE AGREEMENT Mr. Gretz reviewed the proposed ordinance implementing the Federal TRANSPORTATION Omnibus Transportation Employee Testing Act and related regulations EMPLOYEE DRUG as attached to the City Attorney's memo dated December 20, 1995. The TESTING ACT City, as an employer of 50 or fewer regulated drivers, is required to have a drug and alcohol testing policy in place by January 1, 1996. For that reason, the Council is also requested to waive two readings of the ordinance and pass it. Mr. Gretz also reviewed a recommendation to contract with the Association of Minnesota Counties for the testing services as described in the City Attorney's memo dated December 27, 1995. The services include providing the necessary recordkeeping and training materials. MOTION: of Erickson, seconded by Humphrey, waiving the requirement for two readings and passing Ordinance No. 610 adding Section 16-39 to the City Code implementing the Federal Omnibus Transportation Employee Testing Act and related regulations. Ayes - 5 - Nays - 0. ORDINANCE 610 DRUG TESTING IMPLEMENTATION CITY OF APPLE VALLEY Dakota County, Minnesota December 28, 1995 Page 2 MOTION: of Goodwin, seconded by Erickson, approving enrolling in and contracting with the Association of Minnesota Counties for its drug and alcohol testing program to implement the Federal Department of Transportation regulations contained in Ordinance No. 610. Ayes - 5 - Nays - 0. AMC TESTING CONTRACT HIRE GRAWE & SEASONAL EMPLOYEES . MOTION: of Humphrey, seconded by Sterling, approving hiring Charles Grawe for the full-time position of Assistant to the City Administrator and hiring the seasonal employees as listed in the Personnel Report dated December 28, 1995. Ayes - 5 - Nays - O. Mr. Gretz said the City has received some interest in the armory site. ARMORY SITE He distributed copies of a letter from Life Time Fitness, dated December 21, 1995, offering to purchase the site for $1.00 with the City contributing all grading, parking and site work. He has also been contacted by Lyndale Garden Center who is interested in the site and will be looking at it today. MOTION: of Sterling, seconded by Erickson, rejecting the offer of REJECT LIFE Life Time Fitness to purchase the armory site as described TIME FITNESS in its letter dated December 21, 1995. Ayes - 5 - Nays - O. Councilmember Sterling commented on the notice from Marcus Cable about CABLE TV RATES its changes in rates for 1996. She called them and asked for clarifi- cation of the need for a terminal box. It appears this is needed to receive HBO and Showtime, but will also be required equipment in the future. She said she would like an explanation of the new rates and procedures. Councilmember Humphrey said the Cable TV Committee reviewed the new rates at its last meeting. It should be noted that the City cannot control all the rates; it only has authority over the base rate. MOTION: of Humphrey, seconded by Goodwin, requesting that a representative of Marcus Cable attend the January 11, 1996, Council meeting and discuss rates and procedures. Ayes - 5 - Nays - O. CABLE MEETING INVITATION 'CLAIMS & BILLS MOTION: of Goodwin, seconded by Sterling, to pay the claims and bills, check registers dated December 27, 1995, in the amount of $433,424.54; and December 27, 1995, in the amount of $28,728.49.
