Minutes of the special meeting of the Economic Development Authority of Apple Valley, Dakota
County, Minnesota; held November 12th, 1998, at 7:30 o’clock a.m., at Apple Valley City Hall.
PRESENT: Commissioners Erickson, Goodwin, Humphrey, and Sterling.
ABSENT: President Severson; Commissioners Edgeton and Grendahl.
Staff members present were: Executive Director Gretz, Secretary Mueller, City Attorney
Sheldon, Assistant to the City Administrator Grawe, Community Development Director Kelley,
and Public Works Director Miranowski.
Vice President Sterling called the meeting to order at 7:40 a.m.
APPROVAL OF AGENDA
MOTION: of Erickson, seconded by Humphrey, appr oving the agenda for today’s meeting as
presented. Ayes - 4 - Nays - 0.
MINUTES
MOTION: of Erickson, seconded by Goodwin, approving the minutes of the special meeting
of October 22nd, 1998, as written. Ayes - 3 - Nays - 0 (Humphrey Abstained).
TRANSIT HUB CONSTRUCTION CHANGE ORDER
MOTION: of Humphrey, seconded by Goodwin, approving Change Order No. 1 to the
contract with Graus Contracting, Inc., for Apple Valley Transit Hub construction,
in the amount of an additional $6,643.00, as recommended in the Community
Development Director’s memo dated November 6, 1998. Ayes - 4 - Nays - 0.
METROPOLITAN COUNCIL TRANSIT HUB COVENANTS
MOTION: of Goodwin, seconded by Erickson, approving Restrictive Covenants on Lot 1,
Block 2, Carroll Center 4th Addition, providing that the property be used for
regional public transit purposes as required under the terms of Metropolitan
Council grant funding, as described in the Community Development Director’s
memo dated November 6, 1998; and authorizing the President and Secretary to
execute the necessary documents. Ayes - 4 - Nays - 0.
TRANSIT HUB LEASE AGREEMENT
Mr. Sheldon reviewed the proposed lease agreement between the EDA and member cities of the
Minnesota Valley Transit Authority (MVTA) for the Transit Hub property. The EDA owns the

property and the cities, through the MVTA, will be operating transit services from the site, as
described in the Community Development Director’s memo, dated November 6, 1998. The
MVTA Executive Director has indicated disagreement with a lease through the cities rather than
directly with the MVTA. The attorney’s opinion is the MVTA is a joint powers entity and cannot
enter into an agreement on its own.
Mr. Gretz advised that the MVTA has said it will not operate from the Transit Hub unless there is
a lease. If no lease is approved, the facility will remain vacant until a transit entity takes over.
MOTION: of Erickson, seconded by Goodwin, approving a Lease Agreement with the Cities
of Apple Valley, Burnsville, Eagan, Prior Lake, Rosemount and Savage for the
Transit Hub site on Lot 1, Block 2, Carroll Center 4th Addition, for a term of 90
years; as attached to the Community Development Director’s memo dated
November 6, 1998; and authorizing the President and Secretary to execute the
necessary documents. Ayes - 4 - Nays - 0.
MVTA BOARD MEETING
The Board received a copy of a letter to Mr. Gretz from the MVTA requesting the Mayor, City
Attorney and him to attend a Board meeting on November 18, 1998, to discuss the agreement for
the Transit Hub. Mr. Gretz said the options appear to be: do nothing and let the Lease proceed,
request an Attorney General option on the status of the MVTA, or look into Apple Valley
operating transit services independently of the MVTA. Commissioner Humphrey noted that since
the EDA owns the property, the President of the EDA should attend the meeting with Mr. Gretz
if he attends.
The Board discussed the option of the City operating transit services independently. With the
transit property tax levy, the City could contract with Metropolitan Council Transit Operations
for bus service. The Board indicated this is an option on which the City should get more
information and cost projections.
WALMART ECONOMIC DEVELOPMENT PROGRAM
Commissioner Sterling said she received information on an economic development program from
Walmart. It has a $10,000 grant available for small business assistance. An entity such as the
Chamber of Commerce or the City would have to apply. She suggested the funds could be used
for an incubator business program or revolving loan fund. Mr. Kelley will get further information
on the program.
MOTION: of Erickson, seconded by Goodwin, to adjourn. Ayes - 4 - Nays - 0.
