Minutes of the special meeting of the Economic Development Authority of Apple Valley, Dakota
County, Minnesota, held December 11th, 1997, at 7:30 o’clock p.m., at Apple Valley City Hall.
PRESENT: President Severson; Commissioners Edgeton, Erickson, Goodwin, Grendahl,
Humphrey, and Sterling.
ABSENT: None.
Staff members present were: Executive Director Gretz, Secretary Mueller, City Attorney
Dougherty, Finance Director Ballenger, Assistant to the City Administrator Grawe, Community
Development Director Kelley, and Public Works Director Miranowski.
President Severson called the meeting to order at 7:30 p.m.
APPROVAL OF AGENDA
MOTION: of Erickson, seconded by Sterling, approving the agenda for tonight’s meeting as
presented. Ayes - 7 - Nays - 0.
MINUTES
MOTION: of Erickson, seconded by Grendahl, approving the minutes of the special meeting
of August 21st, 1997, as written. Ayes - 6 - Nays - 0 (Edgeton Abstained).
CARROLL CENTER 4TH ADDITION AGREEMENT
Mr. Kelley reviewed the Subdivision Agreement with the City of Apple Valley for the plat of
Carroll Center Fourth Addition as attached to his memo dated December 11, 1997. Because the
EDA and Anthony Properties are jointly acting as the developers of the project, both are required
to sign the Agreement.
MOTION: of Humphrey, seconded by Erickson, approving the Subdivision Agreement for
Carroll Center Fourth Addition with the City of Apple Valley and authorizing the
President and Secretary to sign the same. Ayes - 7 - Nays - 0.
SALE OF LOT 2, BLOCK 2, CARROLL CENTER 4TH ADDITION
Mr. Kelley reviewed the location of Lot 2, Block 2, Carroll Center Fourth Addition; southwest of
155th Street and Gateway Path. The lot is intended to be sold for a townhouse complex and a
public hearing is required prior to such sale. The Dakota County HRA has submitted a Purchase
Agreement for the site. NP Dodge Management Company has submitted a letter of intent to
purchase the site. Both offers are for the established value of $1.50 per square foot.

President Severson called the public hearing to order, at 7:35 p.m., to consider sale of Lot 2,
Block 2, Carroll Center Fourth Addition, and noted receipt of the affidavit of publication of the
hearing notice. He asked for comments or questions on the proposed property sale.
Mark Ulfers, of the Dakota County HRA, was present and said the HRA has had a long-standing
interest in purchasing the site; originally with the MVTA. It has existing property to the south
and provided an easement for the transit hub development. It would build 27 rental townhome
units, for low and moderate income families, on the site which will help the City meet its livable
communities goals. Funds for the purchase are available and they would be able to close as soon
as possible.
Robert Banta, of NP Dodge Management Company, was present and said they would also build
rental townhomes with garages on the site. They would be market rate units; not falling into the
affordable category. They could not close on the purchase until June or July. They understand
the relationship with the HRA and would also be interested in finding another site in the City.
There were no further comments and the hearing was declared closed at 7:42 p.m.
Resolution No. EDA-97-3
MOTION: of Humphrey, seconded by Goodwin, adopting
approving the Purchase Agreement with the Dakota County HRA for sale of Lot
2, Block 2, Carroll Center 4th Addition (Replat of Outlot B, Carroll Center
Addition), for $161,700.00, and authorizing the President and Secretary to execute
the necessary documents. Ayes - 7 - Nays - 0.
L.G.S. CONCORD PROPERTY
Mr. Kelley reviewed his memo, dated December 11, 1997, describing the offer of L.G.S. Concord
and Citizens Utility to sell property located southwest of 147th Street and Pilot Knob Road to the
EDA. The 28-acre site is offered at $500,000.00 or $.41 per square foot. Dakota County shows
a market value of $901,200.00. They are offering the bargain sale arrangement in order to
liquidate holdings which do not relate to their core business. The acquisition would allow the
EDA to offer the property at a competitive price. John Waters, of Citizens Utility, and Norm
Johnson, representing L.G.S. Concord, were present.
Mr. Dougherty commented on discussions he had with the owners on details of a purchase
agreement. It would recognize $60,000.00 of the value as a gift and they are prepared to close
very quickly.
Mr. Gretz said the EDA has options on financing the purchase. It could borrow from the City
and repay it when the property is sold. It could also exercise its authority for a special tax levy.

Commissioner Sterling expressed concern about the EDA’s involvement in rezoning the site. It
was noted that the area is intended for business park or light industrial uses and the Economic
Growth Partnership Committee supports the proposal.
Commissioner Erickson said if the property can be sold in a year, as he was assured it could be,
and recover the EDA’s costs he would support the purchase.
MOTION: of Erickson, seconded by Edgeton, approving purchase of the 28-acre site,
southwest of 147th Street and Pilot Knob Road, from L.G.S. Concord/Citizens
Utility, for $500,000.00, and authorizing the President and Secretary to execute
the necessary documents. Ayes - 5 - Nays - 2 (Grendahl and Sterling).
MOTION: of Sterling, seconded by Grendahl, to adjourn. Ayes - 7 - Nays - 0.
The meeting was adjourned at 7:50 o’clock p.m.
