APPROVAL OF AGENDA Chair Burke asked if there were any changes to the agenda. CD Director Nordquist advised that there are two changes – the addition of a site plan submitted for item 4. A. Lakeside of Diamond Path (Buller) Single Family Chair Burke opened the public hearing. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 5, 2022 Page 2 of 7 Planner Bodmer presented the staff report. Petitioner Mark Sonstegard gave a brief presentation. Resident Rick Bruneau (13271 Diamond Path) asked if these homeowners will be able to add a dock and beach area. He also mentioned that he spoke with Dakota County who mentioned that Diamond Path would be upgraded in the future and will want to take 40’ from his property. He suggested that the City may want to check to be sure that this will not be an issue for the future homeowners. Chair Burke advised that Planner Bodmer would look into these concerns and have an answer for the next meeting. Resident Bill Sherry (4855 Dominica Way) stated his gratitude for the new proposal as opposed to the 17 detached villa homes previously proposed. He also stated how pleased he was that the developer will be doing some initial site prep including the rain garden and then the builder will be doing the individual grading for each property so that it will catch any run-off, sediment, etc. Mr. Sherry also commented that during the building process, it should be expected that there may be a massive rainfall or something that could create a disaster and should be prepared for accordingly. He also stated that he would like to see projects not just meeting the minimum requirements but taking into consideration what works best for each property. Resident Joe Elliott (12949 Diamond Path) asked if the developer is required to build out each property one at a time or if that is just their plan. He stated his concern for wanting the City to require this as a condition. Chair Burke stated that it is just the builder and developer’s plan and not required by the City at this time. Planner Bodmer stated that this could be further researched and brought back at the next meeting. Mr. Elliott asked if the buffer zone is required by the approval process. Planner Bodmer stated that this is required as the developer must provide stormwater treatment and management before it goes into the lake. B. U-Haul Apple Valley Chair Burke opened the public hearing. Planner Sharpe presented the staff report. Planner Sharpe stated that this can be added as a condition. Commissioner Kurtz stated that the orange banding is a highlight of U-Haul and agreed with adding it as a condition. Commissioner Diekmann pointed out that the drawing is showing a setback of 19.68’ as opposed to the 20’ Planner Sharpe stated that within the City Ordinance there is a 6” leeway zone and instead of reducing to 19’, staff thought it would be more applicable to go to 20’. Commissioner Diekmann asked how this amendment would affect AmericInn as they have a current setback of 15’. Planner Sharpe advised that since the City granted their variance, it is still applicable and the amendment does not affect them. Commissioner Scanlan asked if there would be any special venting requirements. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 5, 2022 Page 4 of 7 Planner Sharpe advised that since there will be cooking in the addition, they will require a Class II vent hood system and they are using the existing HVAC system. Commissioner Kurtz asked where the new parking spaces will be added and commented that there may be parking issues due to how busy the area is. Planner Sharpe advised that no additional parking will be added. The current parking spots in the front of the building will be designated for pickup orders. Staff has worked with the owner to reduce how busy the area is by having Glazier deliveries pull into the parking lot. AmericInn has stated that they prefer the pickup parking to be located in these front spaces as well so they do not impact the rest of the parking lot. Commissioner Kurtz asked if it were possible to do a northern driveway entry. Planner Sharpe advised that it is not possible as there is not enough room on a corner to add another entrance which is why the current entrance is combined when initially constructed. Chair Burke if there were any comments from the public – None. Petitioner Ken Sherman was present virtually and had no comments. With no further comments, Chair Burke closed the public hearing. It is the policy of the Planning Commission to not act on items the same night of its public hearing, but seeing as there are no public comments, a motion can be made. MOTION: Commissioner Diekmann moved, seconded by Commissioner Sandahl, to recommend approval of a text amendment to Planned Development 290 to reduce the building setback from 30’ to 20’. Roll call vote: Ayes – 5 – Nays – 0. 5. LAND USE A. Apple Valley Industrial – Opus Development Planner Sharpe presented the staff report. Commissioner Diekmann asked if there would be plans for a monument sign on 147th Street to notify who occupies the building as it does not face the street. Planner Sharpe advised that sign plans are not reviewed as part of a site plan and building permit authorization and staff will need to discuss with the applicant. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 5, 2022 Page 5 of 7 Commissioner Scanlan commented that in the past there has been a limit to how many businesses can be displayed on the sign. Planner Sharpe stated that this is correct and would need to meet the overall signage requirement though they could get an increase. This would need to be worked through as part of the sign permit review. Commissioner Scanlan commented that the landscape requirements for the west and east and that a balance takes place with the structure. Planner Sharpe commented that there is a 25’ trail easement on the western side for the Dakota County Greenway Trail as that area will be torn up when the trail is constructed. Chair Burke commented that it could be possible that screening on the north side may not be possible due to the trail and may not be able to have exterior storage as screening is a requirement. Planner Sharpe advised that this could be an issue if a tenant wishes to have exterior storage as they may need to be place on the south side of the building where screening will be allowed. Commissioner Kurtz asked if the applicant or the City decides which trees go into the landscape plan. Planner Sharpe advised that the applicant submits a proposal and the City typically does not revise this though staff will make recommendations to ensure there is a mix of different types as there is a standard practice in forestry and urban plantings. This is to reduce the risk of certain diseases coming through like Emerald Ash Borer to diversify the species in the City. MOTION: Commissioner Diekmann moved, seconded by Commissioner Kurtz, to recommend approval of site plan and building permit authorization for a 112,170 sq. ft. speculative building. Roll call vote: Ayes – 5 – Nays – 0. B. Tempo Homes Detached Garage Variance Planner Bodmer presented the staff report. Commissioner Diekmann asked if there would be no condition #1 if the addition is not put on. Planner Bodmer advised that plans have been submitted for the addition so it can be done based on the design. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 5, 2022 Page 6 of 7 Commissioner Diekmann asked in reference to the materials matching on both the home and the detached garage, since there are several different materials being used on the home, which material will the garage need to match? Planner Bodmer advised that the current horizontal lap siding is not consistent with what the plan is and staff will need to work with the builder. Commissioner Kurtz asked if it would be possible to move the garage further east so that the variance would not be needed. Planner Bodmer stated that as the building gets closer to the home, additional fire protection is required and there are several trees that would need to be removed. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, to recommend a variance reducing the setback from Galaxie Avenue from 40’ to 32’ for 624 sq. ft. detached garage. S UM M ARY: Apple Ford Lincoln Apple Valley and Gulbrandson Real Estate LLLP/Apple Auto Properties request consideration of a conditional use permit and site plan review/building permit authorization to redevelop the site at 7125 - 151st Street into a Lincoln dealership site. T he five existing buildings are proposed to be demolished and replaced with a 20,800 sq. ft. building that will contain the Lincoln dealership and auto repair facilities. Vacation Request: While review of the C UP and site plan/building permit authorization are underway, the petitioners have also submitted an application requesting the vacation of Gardenia Avenue and a portion of 151st Street that abuts the subject property. Apple Ford Lincoln would like the public streets vacated so that they can create a connected campus between the Ford and Lincoln dealership buildings. T he vacation request will be reviewed directly by the City Council; the public hearing to consider the vacation is scheduled for the City C ouncil's February 10, 2022, meeting. Conditional Use Permit: T he outdoor sales and storage of motorized vehicles is listed as a conditional use in the "G B" (General Business) zoning district. In addition to the parking lot, special "display areas" are identified on the site plan where vehicles will be arranged and staged. All display areas will be required to be paved. Vehicles may not be stored or displayed in boulevards or landscape areas. T he plans submitted in December show that some of the the outdoor display area on the existing Ford property would also be reconfigured as part of the Lincoln dealership redevelopment. T he public hearing notice only identified the Apple Auto C ollision property, not the main Ford property, as part of the C UP consideration. It may be necessary to re- advertise the public hearing notice to include the Ford property depending upon the extent of the changes from the previously approved C UP. A revised plan set was received J anuary 26, 2022, which appears to confine the limits of the project area to the subject Lincoln parcel. Further review is needed to determine whether the existing Ford C UP will need to be amended. Site Plan Review/Building Permit Authorization: T he site plan shows the new Lincoln dealership building on the site. Access to the site is available in three locations: the northwest side via shared parking lot with Ford, the southwest side via an internal private street connection, and the southeast corner of the site via direct connection to 151st St W. T he circulation between the two lots is circuitous, perhaps to deter cut-through traffic. T he number of parking spaces required for customers, staff and employees is based on the size of the building and the number of employees on the largest shift. A total of 45 parking spaces are required on the site; 126 parking spaces are shown on the site. As stated, a revised plan set was received mid-week last week, not allowing sufficient time for a detailed review. T he plans are included in the staff report, but were not reviewed in detail. Further review will be needed before a recommendation can be made on the project. T he site plan layout is dependent upon C ity approval of the requested vacation of rights-of- way. T he City will need to make a determination whether or not the rights-of-way continue to serve a public purpose. If some of the right-of-way is retained by the C ity, the petitioners will need to revise their plans to address that change of circumstances. B AC K G RO UND: T he Apple Valley Ford dealership was developed on its site at 7200 - 150th Street West in 1992. In connection with that development, the C ity vacated a portion of the 151st Street right-of-way so that it could be platted as an outlot. Outlot A, Apple Valley Ford Addition, was then dedicated to the C ity, and was subsequently transferred to the C ity's Economic Development Authority (ED A). Establishing the outlot allowed the ED A to retain future control of an east-west alignment through the property, while allowing the ED A to respond to the needs of the marketplace at that time. SAC determination is required from Met Council prior to permit issuance from the city. Architectural, Structural and Civil plans are required to be signed with the permit submittal. Separate demolition building permits are required. Geotechnical report boring log and Special Inspector Agreement is required prior to permit and soil corrections on site. Submit plans to Minnesota Department of Labor, Plumbing Division for review of proposed plumbing, water and sewer, and storm design. Trash area is required per MSBC 2020 1303.1500 Subpart 1 requires recycling space in accordance with Table 1-A to be shown. Designate this on the site plan with calculations. Separate sign permits are required. Structural drawings will be required for review. Include roof top screening drawings with the plan submittal. Allowable area and building heights will be determined once the code analysis has been completed. Fire separation and opening protection if required between buildings will be required to be shown in the code analysis based on property line distance. The City of Apple Valley has adopted the 2020 MSBC 1306, subpart 3 Special Fire Protection systems. This section would require the buildings to have an automatic sprinkler system installed based on occupancy type and square footage. Occupant loads for calculating occupancy and plumbing fixture counts shall be in accordance with the 2020 MSBC Section 2901 for plumbing fixtures and 1004 for occupant load. Accessible parking required will be required per the Minnesota State Accessibility Code Table 1106.1. Provide energy and lighting compliance calculations at the time of permit submittal. CITY OF MEMO Public Works TO: Kathy Bodmer, Planner FROM: Jodie Scheidt, PE, Civil Engineer DATE: January 28, 2022 SUBJECT: Apple Valley Lincoln Plan Review per plan submitted 12/15/2021 General 1. All work and infrastructure within public easements or right of way shall be to City standards. 2. Provide a narrative of how the buildings will be constructed and any impacts. The narrative shall include the following: • Shoring (if applicable) • Protection of public utilities within existing drainage and utility easements shall be protected at all times. • Material Storage. • Haul routes to and from the site. • Phasing 3. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 4. Public Work Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. 5. City of Apple Valley Water Department shall operate all valves on public owned mains and valves connecting private lines to public owned mains. 6. Easements will be required over all City owned utilities. Permits 7. A public infrastructure project is anticipated for the required cul-de-sac in public right of way. Plans and specifications shall be completed by the City of Apple Valley. A private installation agreement may be necessary for construction of public infrastructure by developer or the developer can have the City of Apple Valley publicly bid the improvements and provide assessments back to the property. 8. Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to construction. 9. A right of way permit will be required for all work within public easements or right of way. 10. A Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity commences. 11. Since the site will be disturbing more than 1 acre and creating more than 1 acre of new impervious. The applicant will be subject to the requirements of the State NPDES Construction Storm water Permit. The applicant must provide proof of permit. Demo Plan 12. Add notes to protect existing storm structures in the west parking area. 13. There is an existing storm sewer structure on the north side of the existing sidewalk along 151st St. Will this structure be removed? Site Plan 14. Show locations of hydrants, manholes, valves and catch basins on the site plan. 15. The proposed sidewalk on 150th Street shall match the existing concrete section. 16. Provide a scale on the site plan sheet. 17. Provide dimensions for the cul-de-sac including the width of the road as it goes to the east. All work in Right of Way shall be to City Standards. 18. The sidewalk in the cul-de-sac should be 5 feet behind the proposed curb and have ADA Ramps. 19. Provide Auto turn drawing utilizing Apple Valley emergency vehicle to ensure adequate emergency and service vehicle circulation to and from the building. 20. Additional drawings showing vacated and dedicated ROW and easements would help with clarity. Public streets and utilities should be included in easements or ROW. Storm Sewer, Grading. Drainage, and Erosion Control 21. Include a storm water pollution prevention plan in the plan set. 22. Final Grading Plans shall be reviewed and approved by City Engineer. 23. Final Storm water Management Plan shall be reviewed and approved by City Engineer. 24. Final locations and sizes of Storm Sewer shall be reviewed with the final construction plans and approved by City Engineer. 25. Provide storm sewer calculations for storm water requirements. (Rational method including Hydraulic grade lines). 26. The downstream system from the site is limited in storm water capacity and any new or redevelopment will require more stringent rate control requirements or may need to be discharged in a different location than CR 42 storm sewer. 27. The site is located within the Vermillion River Watershed. The Vermillion River main stem, tributaries, and several lakes are currently listed as impaired for Excess Nutrients. In accordance with 2018 Surface Water Management Plan (SWMP), several storm water policies would need to be addressed for new or redevelopment of the site: • Policy 6.1 The City requires compliance with all applicable post-construction water quality criteria for new and redevelopment activity adopted by the Black Dog Watershed Management Organization and the Vermillion River Watershed Joint Powers Organization, as described in the BDWMO Watershed Management Plan (2012, as amended) and VRWJPO Standards (2016, as amended). • Policy 6.2 The City requires that all new, redeveloped, or expanded commercial, industrial, multiple residential, or institutional development provide infiltration for a volume equivalent to 0.5 inches of runoff over the area of the development. • Policy 6.3 The City requires that new and redevelopment activity of 0.2 acres or more shall be required to achieve no-net-increase in average annual total suspended solids (TSS) and total phosphorus (TP) loading compared to the pre- development condition of the site. • Policy 6.4 The City may require additional treatment measures as needed for any development or re-development activity to protect downstream receiving waters, including, but not limited to, additional measures in TMDLs or WRAPS watersheds plans. • Policy 6.5 of SWMP: Ensure there is 3 feet of separation from the bottom of the infiltration basins and the seasonally saturated soils. 28. In accordance with SWMP policy 1.5, the city requires that new development and redevelopment activities do not increase peak runoff rates relative to pre-project runoff rates for the 1-year, 2-year, 10-year and 100-year critical storm event. The City may impose more stringent rate control requirements if the capacity of the downstream system is limited. 29. City Ordinance 152.55(B): Maintenance agreement for the proposed storm water management areas will be required and must be recorded. 30. City Ordinance 155.350(C): Maximum impervious surface will be limited, see ordinance for more information. 31. Provide updated overall site composite Curve Number (CN) on the plans. 32. All slopes shall be equal to or greater than 2.0%. 33. Storm within the vacated area should be considered privately maintained and owned. 34. How will the pipe be installed that runs from ST-101 to EXMH 100? Will sidewalk need to be removed and reinstalled? 35. Solid castings on existing structures? 36. Drainage from Public roadway should not be routed to private storm water treatment system and will need to be re-routed from ST-309 CB to ST-308 CBMH to connect to public storm water pipe. Sanitary Sewer and Water main 37. Domestic water and fire service shall be split outside the existing building and the valves shall be located 1.5 times the height of the building away from the building or placed in location readily accessible per City of Apple Valley standard detail plate SER-6. Include this detail in the plan set. 38. Provide a hydrant coverage map. 39. All existing sewer and water services not being used shall be removed and sealed at the main. 40. The new services (water and sewer) should be connected to the city mains to the south. 41. Sanitary service connection shall be with wye and not be connected directly into manhole. 42.
