HomeMy WebLinkAbout04/22/1999ECONOMIC DEVELOPMENT AUTHORITY City of Apple Valley Dakota County, Minnesota April 22, 1999 Minutes of the special meeting of the Economic Development Authority of Apple Valley, Dakota County, Minnesota, held April 22nd, 1999, at 7:15 o’clock a.m., at Apple Valley City Hall. PRESENT: President Severson; Commissioners Edgeton, Erickson, Goodwin, Grendahl, Hamann-Roland, and Sterling. ABSENT: None. Staff members present were: Executive Director Gretz, Secretary Mueller, EDA Attorney O’Meara, Finance Director Ballenger, Assistant to the City Administrator Grawe, Community Development Director Kelley, and Public Works Director Miranowski. President Severson called the meeting to order at 7:15 a.m. APPROVAL OF AGENDA MOTION: of Goodwin, seconded by Haman n-Roland, approving the agenda for today’s meeting as presented. Ayes - 7 - Nays - 0. MINUTES MOTION: of Goodwin, seconded by Hamann-Roland, approving the minutes of the special meeting of March 4th, 1999, as written. Ayes - 5 - Nays - 0 (Grendahl and Sterling Abstained). FISCHER MARKET PLACE REDEVELOPMENT ASSISTANCE AGREEMENT Mr. Miranowski reviewed his memo dated April 22, 1999, concerning a request to amend the Redevelopment Assistance Agreement for Fischer Market Place to allow either a single-user grocery or other retail as qualifying development. Mr. O’Meara said the existing agreement provided for a single-user retail facility on the site. Eligible site development costs must be paid by July 28, 1999, to qualify for tax increment financing assistance. The retail store will not be built this year, but a grocery is interested in the site. The proposed amendment does not change the amount of assistance or deadline for site development, but allows for a substituted use. By law, the July 28, 1999, date cannot be extended so any future development would not be eligible. Tony Gleekel, representing Fischer Market Place, was present and said they have been negotiating with and had a commitment from Kohl’s as the retail user. Because it purchased stores in the east, it is delaying new construction in this area and would not take possession of the site until December 31, 2000. Due to the delay, a grocery use is being pursued and the amendment would substitute this use. The name of the grocery cannot be released yet, but he could say that it is not a Sam’s Club. They will continue to work with Kohl’s to bring them into the development at a later date. Commissioner Erickson said the purpose of providing assistance is to stimulate development and he questioned whether a grocery would have the same draw as a Kohl’s in attracting other uses. Commissioner Edgeton said she is concerned about generally approving a grocery use and not knowing what it is. It would make a difference in projecting what other types of retail might be drawn to the site and set the tone for how the rest of the development would proceed. Mr. Gleekel said he understood the concern and if negotiations proceed to a point where he could release the name, the amendment would be brought back for consideration. He asked that the Board consider a time extension to the Agreement for the retail use. Mr. O’Meara said he had also prepared an amendment to extend the completion date of the store from December 31, 1999, to August 31, 2001, that the Board could consider. The provision that site development costs must be made by July 28, 1999, would not change. Resolution No. EDA-99-3 MOTION: of Goodwin, seconded by Edgeton, adopting approving an Amended and Restated Supplement to the Redevelopment Assistance Agreement dated August 22, 1998, for Fischer Market Place, extending completion of a retail use on the easternmost part of Outlot H, Block 3, until August 31, 2001, and authorizing the President and Secretary to execute the necessary documents. Ayes - 7 - Nays - 0. MOTION: of Hamann-Roland, seconded by Grendahl, to adjourn. Ayes - 7 - Nays - 0. The meeting was adjourned at 7:47 o’clock a.m.
