Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held March 10, 2022, at 7:00 o'clock p.m., at Apple Valley Municipal Center.
PRESENT: Mayor Hooppaw; Councilmembers Bergman, Goodwin, Grendahl, and Melander.
ABSENT: None.
City staff members present were: City Administrator Lawell, City Clerk Gackstetter, City
Attorney Dougherty, City Engineer Anderson, Planner Bodmer, Parks and Recreation Director
Carlson, Police Captain Dahlstrom, Police Captain Francis, Human Resources Manager Haas,
Finance Director Hedberg, Liquor Operations Director Heyne, Community Development Director
Nordquist, Police Chief Rechtzigel, Fire Chief Russell, and Public Works Director Saam.
Mayor Hooppaw called the meeting to order at 7:00 p.m. Everyone took part in the Pledge of
Allegiance to the flag.
APPROVAL OF AGENDA
MOTION: of Grendahl, seconded by Goodwin, approving the agenda for tonight's meeting, as
presented. Ayes - 5 -Nays - 0.
AUDIENCE
Mayor Hooppaw asked if anyone was present to address the Council, at this time, on any item not
on this meeting's agenda. No one requested to speak.
CONSENT AGENDA
Mayor Hooppaw asked if the Council or anyone in the audience wished to pull any item from the
consent agenda. There were no requests.
MOTION: of Bergman, seconded by Grendahl, approving all items on the consent agenda with
no exceptions. Ayes - 5 -Nays - 0.
CONSENT AGENDA ITEMS
MOTION: of Bergman, seconded by Grendahl, approving the minutes of the regular meeting
of February 24, 2022, as written. Ayes -4 -Nays - 0 - Abstain - 1 (Grendahl).
MOTION: of Bergman, seconded by Grendahl, approving issuance of a lawful gambling
exempt permit, by the State Gambling Control Board, to Apple Valley Ducks
Unlimited, Chapter 185, for use on April 16, 2022, at Bogart's Entertainment
Center, 14917 Garrett Avenue, and waiving any waiting period for State approval.
Ayes - 5 -Nays - 0.

MOTION: of Bergman, seconded by Grendahl, adopting Resolution No. 2022-38 certifying
local official positions to the Minnesota Campaign Finance and Public Disclosure
Board. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, adopting Resolution No. 2022-39 amending
the 2022 Operating Budget for specific items. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, approving extension of the Agreement with the
Apple Valley Chamber of Commerce,to administer the Convention and Visitors
Bureau services, through December 31, 2022, as attached to the Assistant City
Administrator's memo, and authorizing the Mayor and City Clerk to sign the same.
Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, approving the Apple Valley Convention and
Visitors Bureau(CVB) 2022 budget and marketing plan, as attached to the
Assistant City Administrator's memo. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, adopting Resolution No. 2022-40 proclaiming
June 27, 2022, through July 4, 2022, as "The 56th Annual Apple Valley Freedom
Days Celebration" and declaring it a community festival and encouraging citizens
to support and participate in the community-wide celebration. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, approving the Agreement with RES Specialty
Pyrotechnics, Inc., d/b/a RESPYRO for fireworks display services on July 4, 2022,
in the amount of$25,000.00, subject to conditions listed in the Parks and
Recreation Director's memo, and authorizing the Mayor and City Clerk to sign the
same. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, approving the Joint Powers Agreement with
Dakota County for Dakota County Project No. 99-012 (Project 2020-130, Cedar
Overpass at 140th Street), and authorizing the Mayor and City Clerk to sign the
same. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, approving the personnel actions as listed in the
Personnel Report dated March 10, 2022. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Grendahl, to pay the claims and bills, check registers
dated February 16, 2022, in the amount of$771,557.47, and February 23, 2022, in
the amount of$840,450.85. Ayes - 5 -Nays - 0.

INTRODUCTION OF NEW POLICE OFFICER CHIRPICH
Police Chief Rechtzigel introduced newly hired Police Officer Evan Chirpich to the Council. The
City Clerk administered the oath of office and then Police Chief Rechtzigel presented Officer
Chirpich with his badge. The Council congratulated Officer Chirpich and welcomed him to his
new position.
TIM BURKE RECOGNITION
Mr. Nordquist introduced this item. Councilmembers Bergman and Melander said it was a
privilege to work with Commissioner Burke on the Planning Commission, and they thanked him
for his years of volunteer service.
Planning Commissioner Burke said it has been a pleasure to be part of the Planning Commission
and he appreciated the opportunity to serve.
Councilmember Melander then read the proclamation recognizing Planning Commissioner Tim
Burke for 24 years of service on the Planning Commission.
MOTION: of Grendahl, seconded by Melander, approving the proclamation recognizing
Planning Commission Tim Burke for his leadership and service over the last 24
years. Ayes - 5 -Nays - 0.
GARDENIA AVENUE & 151 ST STREET VACATION
Ms. Bodmer reviewed the request by Apple Ford Lincoln Apple Valley and Apple Auto
Properties/Gulbrandson Real Estate for the vacation of Gardenia Avenue and 151 st Street W.
rights-of-way abutting 7125 151 st Street W. This item was postponed on February 10, 2022.
Frontier, Center Point Energy, Charter, and Dakota Electric notified the City that they have
utilities in this right-of-way and raised concern over the vacation. The City of Apple Valley also
has utilities in this area. At this time, it appears that there is a need for this right-of-way.
Discussion followed.
Mayor Hooppaw called the public hearing to order, at 7:25 p.m., to consider vacating Gardenia
Avenue and 151 st Street W. rights-of-way abutting 7125 151 st Street W. The Mayor asked for
questions or comments from the Council and the public. There were none and the hearing was
declared closed at 7:26 p.m.
COMMUNICATIONS
Mr. Lawell announced the newly redesigned Spring/Summer Newsletter is in the mail. He also
announced that the Apple Valley and Rosemount Police Departments will be holding a Police
Teen Academy starting in April. Anyone interested should visit the City's website for additional
information.

Mr. Carlson announced the Parks and Recreation Department is now recruiting for seasonal and
part time jobs.
Mayor Hooppaw wished Apple Valley resident Floyd Skinner, who recently turned 105, a happy
birthday.
CALENDAR OF UPCOMING EVENTS
MOTION: of Bergman, seconded by Grendahl, approving the calendar of upcoming events as
included in the Deputy City Clerk's memo, and noting that each event listed is
hereby deemed a Special Meeting of the City Council. Ayes - 5 -Nays - 0.
MOTION: of Grendahl, seconded by Goodwin, to adjourn. Ayes - 5 -Nays - 0.
The meeting was adjourned at 7:31 o'clock p.m.
