HomeMy WebLinkAbout08/30/1993GITY OFAPPLE VALLEY Dakota County, Minnesota August 30, 1993 Minutes of the special meeting of the City Council of Apple Valley, Dakota County, Minnesota, held August 30th, 1993, at 11:30 o'clock a.m. at Apple Valley City Hall. PRESENT: Mayor Branning; Councilmembers Sterling and Humphrey. ABSENT: Councilmembers Erickson and Goodwin. City staff members present were: City Administrator Melena, City Clerk Mueller, City Attorney Severson, Finance Director Ballenger, Personnel Director Boland, Community Development Director Gretz, Parks & Recreation Director Johnson, City Planner Kelley and Public Works Director Miranowski. Mayor Branning called the meeting to order at 11:40 a.m. Steve Mattson, of Juran & Moody, the City's financial consultant, de- BOND SALE livered, opened and read the bids received for the City's $3,340,000 BID OPENING General Obligation Improvement Bonds. The apparent low bid, of ten received is Harris Trust and Savings Bank at a net interest rate of 3.8682 percent. Mr. Mattson then checked and verified the bids. The Council received a letter dated August 19, 1993, from Star Cable- STAR GABLE vision describing the change in cable service rates effective September RATE CHANGES 1, 1993. Lisa Washa, of Star, was present to describe the changes in response to rate regulation provisions contained in the Gable Act and developed by the FCC. They are asking that the City not certify with the FCC to regulate rates at this time. Councilmember Sterling asked what will happen if Star does not get retransmission consent from the local channels? Ms. Washa said negotiations are proceeding. If consent is not obtained by October 6th, the local channels will be replaced with other channels. If they cannot be rebroadcast, cable customers will have to use an antenna or rabbit ears to pick up the channels. The Council asked for an update on the local channel retransmission status at its September 23, 1993, meeting. MOTION: of Humphrey, seconded by Sterling, accepting Star Cable- vision's letter of August 19, 1993, and not certifying with the FCC to regulate cable service rates at this time with the understanding Star Cablevision will act as if it is regulated and seek consent for rate increases. Ayes - 3 - Nays - 0. ACCEPT STAR GABLE RATES STAR SOLICITOR PERMITS MOTION: of Humphrey, seconded by Sterling, authorizing issuance of 13 solicitor licenses to Star Cablevision marketers for door-to-door solicitation from September 7 to 17, 1993. Ayes - 3 - Nays - 0. CITY OF APPLE VALLEY Dakota County, Minnesota August 30, 1993 Page 2 Mr. Mattson reported that ha has verified the bids and recommended award to Harris Trust, the low bidder. MOTION: of Sterling, seconded by Humphrey, adopting Resolution No. 1993-189 accepting the low bid of Harris Trust and Savings Bank, at a net interest rate of 3.8682 percent, to purchase $3,340,000 General Obligation Improvement Bonds of 1993 and providing for the terms and conditions of issuance. Ayes - 3 - Nays - 0. RES. 1993-1~ AWARD SALE $3,340,000 MOTION: of Sterling, seconded by Humphrey, setting an informal meeting at 6:00 p.m. on September 15, 1993, at Gtty Hall and inviting the Planning Commission to attend. Ayes - 3 - Nays - 0. SET INFORMAL MEETING MOTION: of Humphrey, seconded by Sterling, to pay the claims and bills, check register dated August 26, 1993, in the amount of $595,388.29. Ayes ~ 3 - Nays - 0. MOTION: of Sterling, seconded by Humphrey, to adjourn. Ayes - 3 - Nays - 0. The meeting was adjourned at 12:17 o'clock p.m.
