CALL TO ORDER The City of Apple Valley Planning Commission Annual Meeting was called to order by Vice Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, David Schindler, Keith Diekmann, Paul Scanlan, Phil Mahowald, Becky Sandahl Member(s) Absent: None City staff members attending: Community Develo pment Director Bruce Nordquist, Planner Alex Sharpe, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. A ballot process was administered by City Attorney Hills and Department Assistant Vincent. The first round resulted in a tie therefore a second round of voting was done and Paul Scanlan was nominated as Vice Chair. Proclamation and Recognition of Service of Planning Commissioner Tim Burke Community Development Director Nordquist presented a brief presentation and read a Proclamation recognizing Tim Burke’s years of service, leadership, and experience with the Planning Commission. 5. PUBLIC HEARING None 6. LAND USE A. Projecting Sign Ordinance Amendment Planner Sharpe presented the staff report. Commissioner Diekmann asked what the minimum height would be from the sidewalk to the bottom of the sign. Planner Sharpe advised that it shall not be less than 8’. Chair Kurtz stated that this was a great idea and asked why it had not been approved before. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes March 16, 2022 Page 3 of 3 Planner Sharpe advised that it has been approved in Planned Developments that are pedestrian oriented. The sign code is relatively dated and a complete overhaul has not been done and these types of signs were not popular at the time it was written. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, recommending approval of the amendment to Chapter 154 of the City Ordinance to define “Projecting Signs” and permitting projecting signs within the commercial, industrial, and institutional zoning districts. S UM M ARY: LB Apple Valley, LLC (aka Lund Food Holding, Inc.) is requesting approval of the subdivision of an 8.09-acre outlot (Outlot B, Orchard Place 2nd Addition) into three lots and site plan/building permit authorization to allow for the construction of a 44,600-sq. ft. grocery store on 6.07 acres. T he site is located at the southwest corner of 155th Street West and Pilot Knob Road. T he site is bounded by vacant property to the north and west, a Mister Car Wash, multi-tenant retail building and C hipotle restaurant to the south, and the Cobblestone Lake retail development to the east. Access to the subdivision will be via a driveway and private drive along the east side of English Avenue, a private street that intersects with 155th Street the north and 157th Street to the south. N o driveway access will be granted from 155th Street West, a city street, and Pilot Knob Road (C SA H 31), a county road. T he applicant is proposing to construct a 44,600-sq. ft. grocery store on Lot 1. T he grocery store will have a two-story café in the southeast corner of the building with an outdoor seating area and multi-lane drive-up canopy for online pickup on the west side. A Caribou Coffee shop will also be located inside the store. T he receiving dock will be located in the rear of the building along with an electric generator, compactor and transformer. T hey are proposing 259 surface parking spaces that will located south, west and north of the building. Primary access will be via two driveways off English Avenue, with a third access off a private drive between Lots 3 and 4 of the Orchard Place 2nd Addition. B AC K G RO UND: Comprehensiv e P lan: T he 2040 C omprehensive Plan guides the property "C" (C ommercial). T his designation allows for a wide variety of retail, office, and service uses that vary in intensity and off-site impacts. T he proposed grocery store, restaurant and coffee shop uses are consistent with the uses described in the C omprehensive Plan. Zoning: T he property is zoned “RB” (Retail Business). Retail business districts are described as areas that are centrally located to serve the need for general retail sales. Permitted uses include stores and shops that sell personal services or goods over the counter, as well as banks, savings and loan offices, professional offices, community facilities, health clubs, animal hospitals and clinics, small engine and appliance repair, commercial recreation, auto accessory sales, restaurants (C lass I and III Neighborhood Restaurant without a drive through window, only), bakeries, grocery stores, and on-sale wine and 3.2% liquor in conjunction with a restaurant facility. Permitted accessory uses include delivery bays and outdoor dining areas. T he proposed grocery store, Caribou C offee shop, and restaurant with beer and wine service are permitted uses. P latting: T he subject property is currently platted as an outlot as part of the Orchard Place 2nd Addition. An outlot is defined as a platted lot to be developed for a use that will not involve a building or in the case of this property, be reserved for future replatting before development. T he outlot will be replatted into three lots for the purpose of constructing a grocery store on the 6.07-acre Lot 1. Future retail uses are expected for the two remaining lots. All the drainage and utility easements will be established in accordance with the C ity's subdivision regulations. T his will include the standard five and ten foot wide drainage and utility easements adjacent to the property lines. A 30-foot drainage and utility easement will be located directly adjacent to the west property line. T hat will be the location of the east half of English Avenue as well as sanitary sewer and watermain lines. English Avenue provides direct access to the lots within the subdivision as well as existing lots to the south and future development on Outlot D. T herefore, the owner of the lots within this subdivision will need to be a party to any right of access agreement for English Avenue and any shared driveways with existing and future developments within and outside of the subdivision. A 70-foot wide drainage and utility easement will run parallel to the south property line and west of the west property line of Lot 3. An east/west private drive, and utility lines to serve the lots will also be located in the easement. P ipeline Easement: An existing 104-foot wide Magellan pipeline easement is located adjacent to the north property. T he applicant will be limited on how they will be able utilize that property. For purposes of safety, the pipeline company limits what can and cannot be placed within their easement. Buildings, retaining walls, trees, and water bodies are examples of things that are not permitted within an easement. Shrubs less than three feet tall, fences, sidewalks, and irrigation systems are permitted subject to certain conditions. A ny surface grade or elevation changes must be reviewed and approved by Magellan. Site P lan: T he site plan shows a 44,600-sq. ft. grocery store and 259 surface parking spaces on Lot 1. T he project is located at the southwest corner of 155th Street West and Pilot Knob Road and is bounded by vacant property to the north and west, a Mister Car Wash, multi- tenant retail building and C hipotle restaurant to the south, and the C obblestone Lake retail development to the east. Access to the site will be via three driveways off English Avenue, a private street that runs north/south and intersects with 155th Street West to the north and 157th Street West to the south. No direct driveway access will be allowed from 155th Street West and Pilot Knob Road. T he plan identifies 259 surface parking spaces. C ustomer parking will be located along the south and west side of the building; and the 49 spaces located along the north side of the site will be for employees only. T he parking spaces shown on Lots 2-3 will not be constructed as part of the development on Lot 1. For a grocery store use, C ity code requires a minimum of one parking space for each 150 square feet of floor area up to a total floor area of 20,000 square feet; thereafter, one space for each 200 square feet of floor area. T he term “floor area” for the purpose of calculating the number of off-street parking spaces shall be the net usable floor area of the various floors, devoted to retail sales, services, office spaces, processing and fabrication exclusive of hallways, utility space, restrooms and storage areas other than warehousing. Parking requirements for the restaurant use located in the southeast corner of the building and coffee shop is one space per 2.5 customer seats; and one space per five seats of outdoor eating area, excluding the first ten outdoor seats. It appears that the proposed parking will meet the C ity's required parking requirements. T he site and landscape plans show planters around the perimeter of the outdoor dining area. Outdoor dining areas that serve alcohol shall have permanent fencing around its perimeter. Also, the outdoor dining area shall not interfere with any pedestrian or vehicular traffic. Grading P lan: T he site has been graded as part of the sand and gravel mining reclamation of the site. Minor grade adjustments to accommodate the proposed building and parking lot will be needed prior to construction. Section 155.354, which regulates off street loading areas, requires that when a loading area faces a public street or residential district, a minimum 40-foot wide landscaped yard, including berms and vegetation, shall be provided and maintained along the public street or that particular side. T he area within this site where this would occur is in a 104-foot pipeline easement. As stated previously, trees are not permitted within the pipeline easement. However, shrubs less than three feet tall are permitted, subject to certain conditions, and surface grade or elevation changes must be reviewed and approved by Magellan. T he pipeline company has indicated that would be open to review and discuss a possible berm in their easement. T he applicant should work with the pipeline company on construction a landscaped berm over and across the easement and the grading plan shall be revised accordingly. Any site grading shall occur in conformance with a N atural Resources Management Plan (N RMP) which shall be issued upon review and approval of a final grading plan by the City Engineer. Elev ation Drawings: T he elevation plan shows an exterior finish consisting of combination of brick, stone, architectural precast and aluminum composite panels, EIFS, and glass. Twelve-foot tall cast concrete screen walls with groove reveals that will match the brick color will be constructed along the north side of the building. T hese walls will be used to help screen the loading docks, electric generator, compactor and transformer. T he proposed exterior finishes for the building will meet zoning code requirements. Roof P lan: T he roof plan shows the locations of the building's rooftop units. All mechanical equipment shall be screened in accordance with Section 155.348 of the City's zoning code. Landscape P lan: T he landscape plans identify two overstory tree species, three types of coniferous shrubs a variety of coniferous, deciduous and ornamental trees as well as a variety of shrubs, two types of deciduous shrubs, and four types of perennials. T he applicant will need to meet the landscape requirements within the City zoning ordinance, which requires that commercial developments install landscaping (live plant material excluding sod) that will have a minimum cost of 2.5% of the estimated building construction cost based on Means Construction Data. T he applicant will need to submit a detailed planting list for review and approval by C ity staff prior to issuance of a building permit. Landscaped islands shall be provided in parking lots containing more than 25 parking stalls. Total area of islands shall be at least 2% of the parking lot area, except that no island shall be less than the size of a standard parking stall. Islands shall be surrounded by a concrete curb and provided with a weed retardant mesh or plastic sheeting. Islands shall be planted with a minimum 2.5-inch diameter tree at the rate of one tree per 150 square feet of island area. T he N atural Resources C oordinator has reviewed the landscape plans and her comments are in the attached memo for the C ity Engineer. Revisions to the landscape plan shall be made that will identify species and locations of landscaping on the berm along the north side of the site. Please note that the landscaping shown for Lots 2 and 3 are not part of this review and will not be installed as part of development on Lot 1. Av ailability of Municipal Utilities: Public utilities will be extended to site from the existing lines located within the Orchard Place commercial development. T he C ity Engineer has reviewed the proposed utility plans and his comments are included in his attached memo. Lighting P lan: No formal lighting plan has been submitted with this application. All building and site lighting shall conform with Section 155.353 of the zoning code, which requires that any lighting used to illuminate an off-street parking area or sign shall be arranged so as to deflect light away from any adjoining residential zone or from the public streets. Direct glare from floodlights or similar sources, shall not be directed into any adjoining property or public streets, and all the source of all lights shall be hooded or controlled in some manner so as not to light adjacent property. Mitigative measures shall be employed to limit glare and spill light to protect neighboring parcels and to maintain traffic safety on public roads. T hese measures shall include lenses, shields, louvers, prismatic control devices and limitations on the height and type of fixtures. T he city may also limit the hours of operation of outdoor lighting if it is deemed necessary to reduce impacts on the surrounding neighborhood. In commercial areas, any light or combination of lights that cast light on any adjacent commercial or industrial property shall not exceed one foot candle as measured at the property line. Street Classifications/Accesses/Circulation: T he subject property abuts 155th Street West to the north, Pilot Knob Road to the east and English Avenue to the west. Pilot Knob Road and 155th Street West are public streets and direct access shall not be allowed from those two roadways. T he development will have three access drives off English Avenue, which is a private street that extends from 155th Street West to 157th Street West. Staff has no issues with the private driveway locations. P edestrian Access: Sidewalk connections will be made from the internal sidewalks to the south and the bituminous pathway along the west side of Pilot Knob Road. A sidewalk along the east side of English Avenue from the property line to the south to the south side of the most northerly driveway. T his sidewalk shall be extended north and connect to the bituminous pathway located along the south side of 155th Street West. Signs: T he site plan shows a monument sign that will be located in the northwest corner of the site and building signage is shown on the submitted elevation drawings. Formal sign applications for this project will need to be submitted, reviewed and approved prior to the placement of any signs. All signage shall conform to the C ity’s sign ordinance. Dakota County P lat Commission Rev iew: T he Dakota County Plat C ommission reviewed the proposed replat and their comments are provided in an attached letter dated April 14, 2022. T he letter states that a quit claim deed to Dakota County for restricted access will be required with the recording of the final plat. All work and infrastructure within public easements or right of way shall be to City standards. 2. Provide a narrative and site plan showing how the expansion will be constructed and any impacts prior to building permit authorization. The narrative and plan shall include the following: a. Material storage and staging i. All material storage to be onsite and indicated on plan. b. Haul routes to and from the site. c. Contractor and subcontractor parking locations i. Onsite trade parking should be provided. 3. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 4. Public Work Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. 5. City of Apple Valley Water Department shall operate all valves on public owned mains and valves connecting private lines to public owned mains. 6. All work and infrastructure within public easements or right of way shall be to City standards. A public improvement project will be required for sanitary sewer and water main improvements. 7. A design agreement will be required for the design of the public utilities by City Staff. Permits 8. A Minnesota Pollution Control Agency (MPCA) National Pollutant Discharge Elimination System (NPDES) permit is required for any project that disturbs more than one acre. Provide a copy of the executed permit prior to construction. 9. A City of Apple Valley Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity. 10. Provide a copy of any other required permits. 11. A copy of the executed Encroachment Agreement with Magellan Pipeline for work occurring within easement area as indicated on plans prior will need to be obtained prior to any construction activity. 12. A public infrastructure project is anticipated for the proposed sanitary sewer and water services to lot 7 and for the storm sewer that collects from multiple lots. Plans and specifications shall be completed by the City of Apple Valley. A private installation agreement may be necessary for construction of public infrastructure by developer or the developer can have the City of Apple Valley publicly bid the improvements and provide assessments back to the property. Site Plan 13. Indicate locations of tip out curb on the site plan. 14. Show a drainage and utility easement over all the storm sewer pipe that collects drainage from multiple sites. The easement shall be a minimum of twice the depth of the pipe. 15. The easement over the sewer and water services to lot 7 shall be a minimum of twice the depth of the pipe 16. Extend the sidewalk along east side of English Avenue to 155th Street. 17. The proposed sidewalk connection on the south side of the site should be evaluated. Currently the sidewalk dumps out into a parking lane. Grading, Drainage and Erosion Control 18. Provide overall site composite Curve Number (CN) on the plans. 19. Provide pretreatment device/s, such as a SAFL Baffle or approved equal and sump prior to discharging into the public storm sewer in an additional separate MH. Sump structures as shown in City “Catch Basin Manhole with Sump” detail STO-5S. Any sumps shall be privately maintained and routinely cleaned as the accumulated sediment will be from the private parking lots and roadways. 20. Final grading, drainage, and erosion control plan shall be reviewed with the construction plans at building permit/site plan authorization and approved by City Engineer. Sanitary Sewer 21. A new manhole will be required in the location of SS-5 per City Detail Plate SAN-2. 22. Move manhole SS-4 to the east near the end of the drainage and utility easement. 23. Final public sanitary sewer design and construction plans shall be completed by the City of Apple Valley. Water main 24. There is an existing 12” gate valve and stub to serve Lot 1, please indicate this on the plan. 25. Provide an additional gate valve on the watermain that serves Lot 7, near the tee. 26. All water mains located within right of way and public easements for purposes of connection to public infrastructure shall be ductile iron pipe and meet all City standards. 27. Proposed hydrant locations will be evaluated during final design for coverage and water main maintenance. Hydrant coverage map will be required to be submitted prior to building permit/site plan authorization. 28. Final public water main design and construction plans shall be done by the City of Apple Valley. Storm Sewer 29. A minimum easement width of twice the pipe depth should be provided over the storm sewer. 30. Show location of irrigation on the plans. 31. Provide storm water calculations and storm water management plan for review and approval by the City Engineer. 32. Final storm sewer design shall be reviewed with the construction plans and approved by City Engineer. Landscape and Natural Resources 33. Recommend that catch basins are not located in the drive aisles if feasible. 34. Maintenance agreement will be required for the sump catch basin 35. Clarify if greyed out Landscaped areas in “Future Outlots” will be removed with future development. Proposed landscaping shall be permanent for this site and future outlot development(s) shall have their own landscape plan requirements. 36. Only two types of trees are proposed to be planted. Supply quantities in table and diversify the tree planting schedule to follow City Code 152.46 (B): 37. Size, types, diversification of replacement trees. No more than one-third of the replacement trees shall be of the same species of tree, without approval of the city. Box elder, poplar, willow and silver maple are not permitted as replacement trees. Replacement trees must be no less than the following sizes: (1) Deciduous trees shall be no less than two caliper inches; and (2) Coniferous trees shall be no less than six feet high. 38. The City encourages native plantings. Many of the proposed perennials and grasses contain cultivars (cultivated varieties of native plants that do not have the same benefits to pollinators and birds), indicated by the name x ‘variety’. Native plants would not contain the variety name in quotes. 39. Provide landscape detail for the area over the Magellan Pipeline Easement. Apple Valley, MN 55124 Re: LB Apple Valley The Dakota County Plat Commission met on April 13, 2022, to consider the preliminary plat of the above referenced plat. The plat is adjacent to CSAH 31 (Pilot Knob Rd.) and is therefore subject to the Dakota County Contiguous Plat Ordinance. This is a replat of Outlot E, ORCHARD PLACE 2ND ADDITION that includes 3 lots. Restricted access should be shown along all of CSAH 31. A quit claim deed to Dakota County for restricted access is required with the recording of the plat mylars. The right-of-way needs are 100 feet of half right of way, which was dedicated on the underlying plat. As noted, a permit from the County will be required for the connection of the sidewalk. The Plat Commission has approved the preliminary and final plat, provided that the described conditions are met, and will recommend approval to the County Board of Commissioners on May 3, 2022. Traffic volumes on CSAH 31 are 24,000 ADT and are anticipated to be 25,000 ADT by the year 2040. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. S UM M ARY: Robert McNearney of McNearney C ustom Homes has applied to subdivide 5297 140th St W. into six (6) single-family lots by preliminary platting the property. T he property is guided for single-family development and is zoned "R-C L" Residential Cluster. T he Residential Cluster zone allows for lots to be developed at "R-3" single-family requirements, but does allow for greater density when a public purpose is shown/demonstrated by the applicant. T he proposed development meets all "R-3" lot requirements. "R-3" zoning is the predominant single-family zoning district in Apple Valley with over 25% of the community zoned "R-3". T he site is 2.97 acres and generally located at the northeast corner of 140th St. W. and Pilot Knob Rd. T he surrounding Woodwinds neighborhood was developed from 1992-1998 and is zoned for single-family, specifically "R-C L". T hese lots predominantly meet "R-3" requirements. T he lot at 5297 140th St. W. was platted as an outlot in 1993 with an existing home and direct access onto 140th St. W. An access restriction easement was granted at this time preventing direct access onto 140th St. should the property subdivide. T he site has been researched by the Dakota C ounty Historical Society and there "appears to be no specific historical significance to the property". T he 2.97 acre site is heavily wooded with over 150 trees of varying condition and health. T he developer has provided a tree inventory and sought to preserve trees where possible. T he development of a cul-de-sac and ponding to treat stormwater will result in the loss of trees. T he City has tree replacement requirements based on the health of the tree and the diameter inches removed. B AC K G RO UND: Comprehensiv e Guiding and Zoning As noted, the site is guided for single-family and zoned "R-C L" Residential C luster. T he developer is not seeking to utilize the flexibility available within this zone for additional density. T he surrounding neighborhood of Woodwinds is approximately .48 units per acre depending on the addition. T he proposed development would be .5 units per acre, similar to the neighborhood. T he proposed lots meet or exceed all "R-3" lot requirements for setbacks, lot width, lot frontage, and area. However, Lots 3 and 4 will require a 40' rear setback to the home due to 140th St. W. being a minor collector. T he homes as shown are not definitive but the building pad on lot 3 will require adjustment prior to the Planning Commission providing a recommendation. Decks are permitted to encroach into this 40' setback but porches and the home must meet the 40' rear setback requirement. Cul-de-Sac A cul-de-sac is proposed for the development. T he C ity Engineer has reviewed the dimensions and found that a minor revision is required on lots 1 and 6 to allow for additional right-of-way (RO W) to allow for a sidewalk. Additional information about street design is included in the City Engineer's report attached. T he Fire Department and Dakota County Dispatch have asked that the street name be Ember C t. versus the applicant proposed Emily Ct. T his is naming convention consistent with other cul-de-sacs in the neighborhood and greater A pple Valley. Assignment of addresses is underway but final assignment will be determined once a final plat is submitted. As previously noted, access to the site from 140th St. W. will be closed with this development. P edestrian Access/Sidewalk T he greater neighborhood has a sidewalk along one side of Essex Trail connecting to the trail along 140th. T he 2040 C omprehensive Plan states that sidewalks in new development, particularly residential is encouraged and specifically notes the "Great Streets" program which requires sidewalks in residential areas. T he Planning and Public Works Departments recommend a condition for a sidewalk connection around the cul-de-sac. T he C ity would then complete the "sidewalk gap" from this site to the existing sidewalk on Essex Trail at 13910,13906 and 13902 Ember Way. A illustrative diagram of this is attached to the report. Recent developments have consistently required pedestrian connection via sidewalks, whether residential, commercial, or industrial. Often the C ity completes any gaps in the sidewalk system at the same time as the development. Grading and Utilities P lan T he C ity Engineer has reviewed the grading plan. T he proposed pond will require additional design which may increase the total size. Specific comments can be found in the City Engineer memo attached to this report. T he applicant is asked to provide a "building pad" for each home as the final design of the homes may not reflect the shape/design shown on the plan. Tree Remov al and Replacement T he applicant has supplied a tree removal plan but further refinement and analysis of the data is required to determine the caliper inches removed and required replacement. A tree replacement plan is required per the C ity Engineer memo. As noted, the site is heavily wooded, however many of the trees are scrub species or do not have good or better condition. Approximately 30% of the trees on site are in good or exceptional condition and approximately 40-50% of these trees are proposed to be removed. Many of these are located within the proposed cul-de-sac or in the footprint of the proposed homes. T he developer has proposed retaining walls and locations which seek to protect as many existing trees as possible, particularly in areas abutting neighboring residences. In addition to the tree replacement City C ode requires planting one tree per residential lot. Stormwater T he site will require a stormwater pond, which is proposed in the southeast corner of the site. When the Woodwinds neighborhood was developed stormwater from this site was specifically exempted from the neighborhood requirements and deferred to the time of development. T he City Engineer has reviewed the stormwater pond and noted that the size and specifications may need to increase. Additional details regarding stormwater are included in the City Engineer memo attached. B UD G E T I M PAC T: Park dedication is required with this development. T he Parks and Recreation D irector has determined that the C ity will accept cash-in-lieu of a land dedication due to the site being within close proximity to other parks. Park dedication will be determined when the property submits for a final plat. Anderson, City Engineer DATE: April 15, 2022 SUBJECT: The Woodwinds 8th Addition Preliminary Plan Review Alex, The following are comments regarding the Woodwinds 8th Addition Preliminary Plat & Plans submitted March 23, 2022. Please include these items as conditions to approval. General 1. All work and infrastructure within public easements or right of way shall be to City standards. 2. A design agreement will be required for the design of the public utilities by City Staff. 3. The developer shall identify whether site utilities will be installed under private or public contract. 4. Drainage and utility easement shall be dedicated on final plat over all public infrastructure. 5. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 6. The existing well will need to be abandoned in accordance with Dakota County. 7. Existing septic system shall be properly disconnected/decommissioned in conjunction with the home demolition permit. Permits 8. A public infrastructure project is anticipated for the proposed sanitary sewer and water services. Plans and specifications shall be completed by the City of Apple Valley. A private installation agreement may be necessary for construction of public infrastructure by developer or the developer can have the City of Apple Valley publicly bid the improvements and provide assessments back to the property. 9. Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to construction. 10. A right of way permit will be required for all work within public easements or right of way. 11. A Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity commences. 12. The City of Apple Valley will procure a sanitary sewer extension permit from the MPCA and an approval from the Minnesota Department of Health for public water main as part of public improvement project associated with public sanitary sewer and water main extension. Site Plan 13. City of Apple Valley standards for typical cul-de-sacs are 34’ back to back with 2% crown and a 47’ radius. Include a sidewalk around the cul-de-sac (see attached modified cul-de-sac requirements). 14. The proposed street shall have a curb return radii of 20’, per standard detail plate STR- 16. 15. All curb shall be surmountable and drive entrances shall be designed to city standard detail plate STR-3A. 16. Retaining Walls shall be privately owned and maintained. An encroachment agreement is required for any walls within a drainage and utility easement. 17. Property lines shall be radial from the center of the cul-de-sac. 18. The existing drive entrance shall be removed and the curb, boulevard and sidewalk should be restored to match the existing. Grading, Drainage and Erosion Control 19. Final Grading Plans shall be reviewed and approved by City Engineer. 20. Final Stormwater Management Plan shall be reviewed and approved by City Engineer. 21. Provide Final Hydro CAD modeling files to the City Engineer. 22. Provide the Storm water Pollution and Prevention Plan (SWPPP) prior to construction. 23. Builder/Contractor is responsible for properly grading the lots to avoid ponding or drainage. 2% minimum slopes in grassed areas are required. 24. Provide the existing and proposed pervious and impervious areas and percentages on the plans. 25. Show all emergency over flow (EOF) elevations. The low floor elevation of the existing house on Essex Trail is 990.90. a. The lowest opening shall be: i. at least 3 feet above the estimated 100-year water surface elevation ii. at least 1 foot above the stormwater facility emergency overflow elevation b. The lowest floor (including basement) shall be: i. at least 1 feet above the estimated 100-year water surface elevation ii. at least 3 feet above the seasonal high local groundwater elevation 26. A maintenance and aquatic bench is required on ponds, provide a cross section of each pond. 27. Project is located within 1 mile of an identified impaired water (Long and Farquar Lake). Long and Farquar Lake are impaired for nutrients. a. Per Apple Valley SWMP policy 6.4, enhancement to the pond and infiltration bench to capture dissolved phosphorous are recommended. b. Must comply with NPDES Construction permit section 23.9 and 23.10 28. Pond short circuiting concern by the FES. May need to move the outlet and modify the pond shape to avoid short circuiting. The configuration of the pond should be modified to reduce the amount of significant trees impacted. Storm Sewer 29. Provide storm sewer calculations for stormwater requirements. (Rational method including Hydraulic grade lines). 30. The infiltration/sediment basin collects drainage from offsite and will be require a drainage and utility easement and be owned and operated by the City of Apple Valley. Include the pond buffer in the drainage and utility easement. 31. Show drain tile and cleanouts on utility plan. 32. Stormwater infiltration basin shall be designed to Vermillion River Watershed standard details. 33. Final locations and sizes of Storm Sewer shall be reviewed with the final construction plans and approved by City Engineer. Sanitary Sewer and Water Main 34. Final locations and sizes of Sanitary Sewer and Water main shall be reviewed with the final construction plans and approved by City Engineer. 35. All water mains located within right of way and public easements for purposes of connection to public infrastructure shall be ductile iron pipe and meet all City standards. 36. Provide additional drawing showing fire hydrant coverage. 37. The existing sanitary sewer and water services must be removed back to the main. 38. Provide a bend in the water main at the end of the cul-de-sac instead of a tee. 39. All services are required to have W and S stamps in concrete curb in accordance with City standard detail plate STR-37. 40. Sewer and Water Service locate boxes shall be provided for all lots in accordance with SER-1A. New curb stop and box shall be located at the ROW. Submit a soils report with borings located in the infiltration/sediment basin area. 42. Protective buffer zone required. A protective buffer zone shall be established and maintained with a minimum required width consisting of the area between the line delineating the water body edge and a line parallel to and upland the following feet from the water body edge of 16.5 feet for any stormwater pond. a. A protective buffer zone component (PBC) shall be submitted as part of the natural resource management plan, The PBC requirements can be found in City Ordinance 152.16 (4)(b)(5). The plan shall consider the proposed seed mixes and recommended maintenance efforts associated with them. Escrows are required until the plants are fully established (can be multiple growing seasons). 43. Review Code § 152.16 (A)(3) NATURAL RESOURCES MANAGEMENT PLAN; ADDITIONAL REQUIREMENTS regarding tree protection requirements required on the plans. Tree protection fencing must be installed and maintained properly throughout construction to save significant trees as indicated on demo plan. 44. Review Code § 152.46 TREE PRESERVATION REQUIREMENTS regarding calculations of tree mitigation required on the plans. Applicant shall submit replacement tree/landscape plan for the entire site or a lot by lot basis. …. (B) Size, types, diversification of replacement trees.
