HomeMy WebLinkAbout12/16/1993CITY OF APPLE VATJ,k~Y Dakota County, Minnesota December 16, 1993 Minutes of the special meeting of the City Council of Apple Valley, Dakota County, Minnesota, held December 16th, 1993, at 7:00 o'clock p.m. at Apple Valley City Hall. PRESENT: Mayor Branning, Councilmembers Erickson, Goodwin, Humphrey and Sterling. ABSENT: None. City staff members present were: City Administrator Melena, City Clerk Mueller, City Attorney Sheldon, City Engineer Gordon, Finance Director Ballenger, Personnel Director Boland, Police Captain Erickson, Community Development Director Gretz, Associate Planner Hickok, Parks and Recreation Director Johnson, City Planner Kelley, Public Works Director Mtranowski and Police Chief Rivers. Mayor Branning called the meeting to order at 7:00 p.m. The Councilmembsrs and everyone in attendance took part in the pledge of allegiance to the flag. MOTION: of Sterling, seconded by Erickson, approving the agenda for tonight's meeting as amended. Ayes - 5 - Nays - 0. APPROVE AGENDA AUDIENCE DISC. CONSENT AGENDA RES. 1993-288 BARTON S & C DONATION 1994 RUBBISH REMOVE SERVICE RENEW OFF-SALE BEER LICENSES POLICE BLDG. CHANGE ORDERS Mayor Branning asked if anyone was present to address the Council at this time on any item not on this meeting's agenda. No one was present to speak. MOTION: of Humphrey, seconded by Goodwin, moving consideration of disposing of confiscated weapons and towing and impounding services to the regular agenda and approving all remaining items on the consent agenda. Ayes - 5 - Nays - 0. CONSENT AGENDA ITEMS MOTION: of Humphrey, seconded by Goodwin, adopting Resolution No. 1993-288 accepting, with thanks, the donation of $500.00 from Barton Sand & Gravel Company to benefit the youth of the community. Ayes - 5 - Nays - 0. MOTION: of Humphrey, seconded by Goodwin, accepting the quotation of Knutson Services, Inc., to provide rubbish removal services at City facilities for 1994 at a net monthly rate of $896.33. Ayes - 5 - Nays - 0. MOTION: of Humphrey, seconded by Goodwin, approving renewal of off- sale 3.2 beer licenses for the year 1994 as listed in the City Clerk's memo dated December 13, 1993. Ayes - 5 - Nays - O. MOTION: of Humphrey, seconded by Goodwin, approving various change orders to construction contracts for the Police Facility Building as listed in the Personnel Director's memo dated December 16, 1993, in the amount of an additional $8,325.00. Ayes - 5 - Nays - 0. of Humphrey, seconded by Goodwin, adopting Resolution No. 1993-289 receiving the preliminary engineering report for Project 94-447, Water Trunk Serving Eastern Apple Valley, and setting a public hearing on it at 8:00 p.m. on January 13, 1994. Ayes - 5 ~ Nays - 0. of Humphrey, seconded by Goodwin, adopting Resolution No. 1993-290 directing the City Engineer to prepare plans and specifications for Project 94-447. PROJ. 94.447 ~IRE SEASONAL EMPLOYEES END OF CONSENT AGENDA MOTION: of Erickson, seconded by Goodwin, adopting Resolution No. 1993-291 directing the Police Chief to dispose of all confiscated weapons, including BB and pellet guns, by having them shredded, melted down or otherwise destroyed so they will not be available on the street. Councilmember Sterling asked if attempts were made to locate the owners, case of stolen property, or if the Police Department can use them? Ayes - 5 - Nays - O. Mr. Melena reviewed the City Attorney's memo dated December 13, 1993, concerning vehicle towing and impounding services. When the City enacted its ordinance concerning towing, State law was interpreted to require bidding for that type of contract. Since then, bidding is no longer required by the State. Bids were received on November 30th and it became apparent that using specifications and bidding this type of service will not achieve the best results. It is recommended that the process be reviewed and the ordinance requiring bidding be repealed. Kevin Mellon, of Magnum Towing, was present and said he submitted a complete bid to the City which was lowest in dollars and complied with the specifications. He met with the Police Department and asked what else was needed. He is willing to provide an office for the impound lot and a dispatcher and asked to be considered as the successful bidder. ~EHICLE TOWING & IMPOUNDING CITY OF APPLE VATJ.mY Dakota County, Minnesota December 16, 1993 Page 3 MOTION: of Humphrey, seconded by Erickson, adopting Resolution No. 1993-292 accepting recommendation "C" described in the memo dated December 13, 1993; rejecting all bids received November 30, 1993, for vehicle towing and impounding services; and directing Staff to review requirements and options and report back in 45 days. RES. 1993-292 REJECT TOW BIDS & REVIEW Mr. Sheldon said the purpose of bidding is not for business opportunities, but for the City to provide necessary services. Factors concerning response times and operations, for example, are important and these types of things require very detailed specifications beyond those that can be written. Each bidder submitted information that it would make accommodations, but if those are accepted, it changes the specifications. Vote was taken on the motion. Ayes - 5 - Nays - 0. Mr. Melena reviewed the information as presented at the truth in tax- ation hearing on the 1994 budget and tax levy held December 15, 1993. 1994 BUDGET & TAX LEVY MOTION: of Sterling, seconded by Erickson, adopting Resolution No. 1993-293 approving the 1994 City budget with revenue of $20,739,786 and expenses of $20,380,726 and certifying a net tax levy of $5,919,474. Ayes - 5 - Nays - 0. RES. 1993-293 1994 BUDGET & TAX LEVY RES. 1993-294 1994 PAY PLm~ RES. 1993-295 SET SEWER & WATER RATES RES. 1993-296 SET STORM WATER RATES RES. 1993-297 1994 VALLEY- WOOD FEES MOTION: of Humphrey, seconded by Sterling, adopting Resolution No. 1993-294 approving the 1994 pay and benefit plan for employees including pay scale adjustments of three percent and contribution for insurance benefits of $330.00 per month. Ayes - 5 - Nays - 0. MOTION: of Goodwin, seconded by Humphrey, adopting Resolution No. 1993-295 setting monthly sewer rates at $1.19 per thousand gallons and water rates at $.72 per thousand gallons, up to 100,000 gallons and $1.00 per thousand thereafter, effective January 1, 1994. Ayes - 5 - Nays - 0. MOTION: of Goodwin, seconded by Humphrey, adopting Resolution No. 1993-296 setting monthly storm water drainage rates at $3.00 per residential unit, $22.04 per acre for apartments, $6.00 per acre for schools, $8.13 per acre for churches and $23.84 per acre for industrial/commercial property effective for bills mailed after February 1, 1994. Ayes - 5 - Nays - 0. MOTION: of Humphrey, seconded by Goodwin, adopting Resolution No. 1993-297 setting 1994 fees and charges for Valleywood Golf Course, as listed in Exhibit A, including 18-hole greens fee of $19.00 and 9-hole greens fee of $13.00. Ayes - 5 - Nays - 0. CITY OF APPLE VALLEy Dakota County, Minnesota December 16, 1993 Page 4 MOTION: of Goodwin, seconded by Humphrey, adopting Resolution No. 1993-298 setting 1994-95 ice arena rental rates at $115.00 per hour for primo time ($110.00 for hockey association) and at $87.00 per hour for non-prime time. Ayes - 5 - Nays - 0. MOTION: of Goodwin, seconded by Humphrey, adopting Resolution No. 1993-299 transferring $1,500,000 from the Special AsseSSment Fund to the Capital Improvement Project Development Fund. Ayes - 5 - Nays - 0. Mr. Melena gave the first reading of a proposed ordinance, adding Sec- tion 2-3 to the City Code, establishing the mayoral term of office 1994-95 ICE ~ENA ~EES RES. 199-299 TRANSFER TO _C. I.p FUND ORDINANCE MOTION: MOTION: as four years effective with the term beginning January 1, 1995. ~ Councilmember Goodwin commented in favor of the proposed ordinance which would set the Mayor's term of office for the same length as Councilmembers, terms. Councilmember Erickson acid he agrees the term should be four years, however, he would prefer to consider changing it at the time a current Mayor would not be seeking re-election. Mayor Branning commented on the restrictions of a two-year term in the ability of an official to represent citizens. Oouncilmember Sterling asked what other suburbs have four-year mayoral terms? Mayor Branning said he believes Burnsville, Eagan and Lakeville, among others, have four-year terms. The Council accepted the first reading of the ordinance. Mr. Melena reported that he and Mr. Gretz met with the property owner ~--ARK-L~N~ - east of the Central Maintenance Facility concerning acquisition of the ~ property for park purposes. It is expected a purchase agreement will be brought to the Council for consideration at its meeting of December 29, 1993. Ayes - 5 - Nays - 0. RETIREMENT of Goodwin, seconded by Humphrey, approving the Retirement Agreement with Lloyd Rivers and authorizing the Mayor and Clerk to sign the same. REFUND OSCARS' 1994 FEES CLAIMS & BILLS MOTION: of Erickson, seconded by Goodwin, to pay the claims and bills, check register dated December 16, 1993, in the amount of $749,541.01.
