CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, Paul Scanlan, Keith Diekmann, Paul Mahowald, Becky Sandahl, and Jeff Prewitt Member(s) Absent: David Schindler City staff members attending: Community Develo pment Director Bruce Nordquist, City Planner Tom Lovelace, Planner Kathy Bodmer, and City Attorney Sharon Hills. 2. APPROVAL OF AGENDA Chair Kurtz asked if there were any changes to the agenda. Community Development Director Nordquist stated there was an updated staff report for item 5.B. and there is an additional finding. Item 6.B. has also had a change in title from “Forecasting Staff Transitions” to “Development Update for 2022-2023 and Forecasting of Staff Transitions.” MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, approving the agenda. Roll call vote: Ayes - 6 – Nays - 0. 3. CONSENT ITEMS MOTION: Commissioner Mahowald moved, seconded by Commissioner Sandahl, approving the minutes of the meeting of May 4, 2022. Roll call vote: Ayes – 5 – Nays – 0 – AB - 1. 4. PUBLIC HEARING None 5. LAND USE A. Lunds & Byerlys City Planner Lovelace presented the staff report. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes May 18, 2022 Page 2 of 4 Commissioner Scanlan asked if the landscaping could be more mixed with horizontal and vertical elements and also seasonal plantings. City Planner Lovelace stated that vertically would be a challenge as the easement allows for only 3 feet so will likely consists of shrubs. Petitioner Mitchell Avery (Lund Food Holdings, Inc.) stated that the Magellan Pipeline easement has strict requirements including no higher than 3 feet and no root structure which limits the types of plantings. Community Development Director Nordquist noted that there was a label of beer and wine sales on the conceptual fixture plan and that Apple Valley is a municipal liquor store city. Mr. Avery stated that it is referring to on-sale beer and liquor. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, to recommend approval of the LB Apple Valley preliminary plat, subject to conditions 1 through 9 in the staff report and an amendment to condition number eight changing the street number from 157th Street West to 155th Street West. Roll call vote: Ayes – 6 – Nays – 0. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, to recommend approval of the Site Plan/Building Permit to allow for construction of a 44,600 sq. ft. grocery store on 6.07 acre lot in accordance with the submitted plans dated April 28, 2022, subject to conditions 1 through 13 in the staff report. Roll call vote: Ayes – 6 – Nays – 0. B. Goze Retaining Wall Planner Bodmer presented the staff report. Chair Kurtz asked if the previous retaining wall was in the wrong location. Planner Bodmer advised that she was not sure as there were no permits pulled for the previous wall. Petitioner Anthony Goze stated that the previous wall was built around 1980 and have heard from neighbors that the fence was not in the correct property line nor was the retaining wall. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes May 18, 2022 Page 3 of 4 Commissioner Scanlan asked if there were no permits for the original wall. Planner Bodmer stated that is correct. Commissioner Scanlan asked if the upper tier on the original wall was also in the School District’s property. Planner Bodmer stated that it would be difficult to ascertain, but that the fence definitely was. Commissioner Scanlan asked how the easement with the School District will be addressed when the house is sold in the future. Would that stay with the house and how would the new owners have record of this? Planner Bodmer stated that is correct. The easement between the homeowner and the School District is a private matter and the City is staying out of the matter. The City may not have the authority to require the easement to be filed since it is not a City easement. City Attorney Hills stated this is correct and not a City issue. The action requested is a variance for just the wall which does not extend into the School District’s property, just the fence does. Commissioner Mahowald asked if the new wall was replacing the existing wall and not extending past the property line. Mr. Goze stated that the existing wall was on the bottom two tiers and the upper wall is due to the change in elevation. Commissioner Scanlan asked if an as-built survey will need to be submitted to the City. Planner Bodmer stated they would not be required to, though one of the conditions is that a special inspector on site verifying the materials and placement. Some flexibility will be needed in order to make sure it is stabilized which is why a blanket variance is being requested. Commissioner Scanlan stated that an as-built survey could show where the property line is in relation to the wall so that the City has record of it and a prospective homeowner would have the information. City Attorney Hills said that the engineering plans and site plans will be kept with the building permit in the Engineering department and most title companies will see these documents. Recommend approv al of the Subdiv ision by P reliminary P lat of Losinski Addition. S UM M ARY: Robert and Evolyn Losinski own the residential property at 400 Reflection Road. In 2021, the Street Improvement Project included trail overlays and pavement maintenance for various trails in the City. T he Losinski's property had an existing trail that was less than six feet (6') wide along their rear property line that connected Reflection Road and Holyoke Lane. In connection with the Street Improvement Project, the existing trail segment was replaced with a new 8' wide trailway; new trees and shrub plantings were also added to the area to replace trees and shrubs that were removed. T he C ity of Apple Valley worked with the Losinskis concerning the trail that traverses their rear yard. T he C ity normally would simply obtain an easement which would allow public use of the trail, but would leave the property owners responsible for the property. In this case, the property owners requested to simply split their property and dedicate the trail portion back to the City so that the C ity would be fully responsible for the trail. By subdividing and dedicating the trail property, the C ity would become the underlying property owner and responsible for the property. Approval of the site plan/building permit is subject to the rezoning of the property, the subdivision by preliminary plat of Apple Valley Commerce Center 2nd Addition, and a conditional use permit for outdoor storage. 2. T he landscaping shall comply with the landscape plan dated J une 7, 2022. A nursery bid list shall be submitted at the time of application of the building permit that confirms that the value of the landscape plantings on the plan meet or exceed 1.5% of the value of the full build-out of the building, based on means construction data in accordance with City C ode Sect. 155.349. 3. A roof cross-section drawing shall be submitted at the time of application of the building permit that confirms that the roof top mechanical units are screened in accordance with City C ode Sect. 155.346. 4. All refuse and recycling shall be stored within the building or enclosed within a container. All waste containers shall be completely screened with a wall that matches the exterior material of the building in accordance with C ity C ode Sect. 155.348(C ). 5. Owner shall provide evidence of executed Encroachment Agreement with Magellan Pipeline and Great River Energy for work proposed within their easements. 6. T he final grading, drainage, sanitary sewer, water and storm sewer plans are subject to review and final approval of the City Engineer. S UM M ARY: T he petitioner requests consideration of a subdivision by preliminary plat, rezoning to align existing zoning districts with new property lines, conditional use permit for outdoor storage of delivery trucks, and site plan review/building permit authorization for 117,600 sq. ft. industrial office/warehouse building with a 3,400 sq. ft. detached maintenance building. T he property owner has identified a single business that is interested in developing the site with a 117,600 sq. ft. building for distributing prepackaged snack foods. A conditional use permit (C UP) is requested to allow the outdoor storage of step vans, box trucks and semi trucks on the site. T he outdoor storage area requires additional lot area, so the property owner seeks to increase the size of the lot from 8.4 acres up to 16.0 acres. T he property owner to the south, Menard Inc., is willing to sell property, provided a minimum 3.0-acre lot is retained for them and that a separate outlot is created for the regional retention pond to be dedicated to the City. Public Hearing Review: T he Planning Commission conducted the public hearing for the subdivision and conditional use permit at its May 4, 2022, meeting. One comment was received by the public and a number of questions were posed by the Planning Commission. 1. Please review the exterior building materials of the accessory garage. Staf f response: T he petitioner updated the exterior building materials to better match the exterior of the main building. 2. Landscaping on the west side of the site is lacking. Staf f response: T he petitioner revised the landscape plan to address this concern and has added plantings along the west side of the site. 3. What is the building material of the fence? Long-term, we want to ensure the fence remains attractive and not a nuisance. Staf f response: T he fence is required to be constructed of a maintenance-free, durable material. T he majority of the fence will be an 8' tall privacy fence that will be integrated with berming and extensive landscaping to avoid long expanses of blank walls. Where there are gates and openings, the petitioner will use an 8' tall vinyl picket-type fence. B AC K G RO UND: Scannell Properties #281, LLC , owns the 8.4-acre parcel on the southwest corner of J ohnny Cake Ridge Road and 147th Street. T he subdivision of the property and development agreement were executed and approved in 2021 for A pple Valley C ommerce Addition, a development of a 117,000 sq. ft. flex industrial building on an 8.4-acre lot. T he first addition approvals were based on a flex office-warehouse building design, with the expectation that the owner would build out the individual suites as they were leased out. T he proposed new development, Apple Valley Commerce Second Addition, would be very similar to the previously approved development, but modifications are requested to address the operational needs of an identified single tenant. Two access points remain in nearly the same locations as previously approved, with one on the north side to 147th Street, and one on the west side, to Fernando Ave. Employee parking is shown around the north and west sides of the building. T he majority of the site is proposed to be secured with privacy fencing with berming and landscaping to help soften the appearance of the solid fencing. Loading dock doors are proposed to face J ohnny Cake Ridge Road which require additional consideration and treatment. T he C ity C ode states that dock doors, including maneuvering area, must be a minimum of 100' from the right-of-way line and that a minimum 40' landscaped area be created for screening and buffering the use. A Great River Energy easement for overhead power lines traverses the area which requires the landscaped area to be shifted to the west. T he treatment shown appears to meet the code requirements. A small 3,400 sq. ft., accessory stand-alone maintenance garage is shown southwest of the main office/warehouse building. T he petitioner states that no fuel will be dispensed in this location and that the exterior will be tip-up concrete panels that complement the appearance of the main building. T he exterior materials were revised to better match the main building. An outlot is proposed to be created which would be dedicated to the C ity for a regional storm water basin. T he lot appears to be smaller than the current City easement, which is being reviewed by the C ity Engineer. T he Engineer states that the pond sizing will need to be reviewed to ensure it will properly serve the area. A vacation of easements may be needed if the C ity agrees to the size of the basin proposed to vacate excess easements. T his will be reviewed in more detail in connection with the final plat and development agreement. Conditional Use Permit: A conditional use permit is requested for the open (outdoor) storage of delivery vehicles including semi tractors and trailers, semi trailers, box trucks, step vans and similar. A maximum of 152 vehicles are requested to be stored on the site. C onditions of approval include only operational vehicles may be stored, only vehicles may be stored, no product may be stored. An 8' privacy fence, berming and landscaping appear to do a good job of screening the area from J ohnny C ake Ridge Road to the east and along the south line. Staff has worked closely with the petitioner to ensure the outdoor area is fully screened from adjacent streets. T he developer has been able to beef up landscaping along the west side of the site. O ne view remains a concern, from the southwest side of the site looking across the ponding area. T he petitioner will provide some options for addressing this view of the south dock doors and outdoor storage area. The proposed office/warehouse building is consistent with the comprehensive plan guidance. Zoning: The property is currently zoned “I-2” (General Industrial) and PD-1053. The parcels owned by Menard are zoned PD-1053 and are part of the Menards at Hanson Concrete plat and development. While an office/warehouse flex building is a permitted use in both zoning districts, the zoning district boundary must follow property boundaries; Scannell prefers to keep the I-2 zoning designation on its parcel. A rezoning is needed to align the zoning district boundaries with the new property lines. Preliminary Plat: The proposed plat would reconfigure the lots owned by Scannell and Menard. The new subdivision will increase the size of the Scannell property (proposed Lot 1) from approximately 8.4 acres to 16 acres, leaving a 3.0-acre parcel owned by Menard. The retention pond currently located southwest of Lot 1 would be contained within an outlot that is proposed to be dedicated to the City. Site Plan: The 117,600 sq. ft. flex industrial building is oriented so that the front of the building faces north and the loading/receiving area faces south and east. The location of the building has been shifted west to allow for the addition of loading dock doors on the east side of the site. The proposed building would be similar in size to the previously approved building on the site. The access points are the same location as previously, one from the north from 147th Street to the north side of the building, and one from the west from Fernando south of the building. A dedicated right turn lane will be needed off of 147th Street, consistent with other driveway accesses that have been required in the area. Customer and employee parking is provided on the north and west sides of the building. An outdoor truck storage area is planned on the south side of the site. Loading dock doors are shown facing Johnny Cake Ridge Road which must meet the requirements of §155.354: the dock doors, including maneuvering area, must be a minimum of 100’ from the right-of-way line, and a minimum 40’ bermed and landscaped screen must be installed. The plans appear to meet this requirement. Curb is required around the perimeter of the parking lot. The sidewalk adjacent to the building will have an integrated curb. The width of the sidewalk will be increased from 5’ to 6’ to ensure adequate room for pedestrians in cases where vehicles may overhang the sidewalk. The previous parking requirement was calculated using a generic formula assuming 20% office and 80% manufacturing/warehouse. Now that a user has been identified and a floor plan submitted, the parking required is lower than originally determined. With an office area of 10,500 sq. ft. and warehouse area of 105,000 sq. ft. the parking required would be a minimum of 117 spaces. Proof-of-parking spaces are also shown to allow for adding staff parking in the future. A truck turn plan has been submitted that demonstrates how trucks will maneuver to access the loading dock doors within the site. A truck turn drawing also demonstrates how fire trucks will be able to circulate around the building. The Fire Marshal requested the parking on the west side of the site connect to the entrance drive to Fernando Ave, creating full fire safety access around the building. The petitioners request to install a gate which the Fire Marshal says can be accommodated. Grading Plan: The site is the location of a former solid waste disposal site for concrete pipe manufacturing scrap. A closure record was issued by the Dakota County Public Health Department December 11, 1990, and recorded October 4, 1991, as Document No. 1008225. The site was reclaimed during the summer of 2021 and is available for redevelopment. Elevation Drawings: The elevation drawings indicate the building will be constructed of concrete tip-up panels with integrated color. The panels will generally be 37’ high with a decorative 40’ panel with parapet feature on six of the front sections to highlight the front entry areas and building cornices. The maximum building height in the I-2 zone is 40’. The zoning code requires that all sides of the building must be treated as a front and have “equally attractive elevations” or four-sided architecture. A similar treatment with the decorative panels is shown on the south, east and west sides of the building. The south and east sides of the building, the loading and receiving dock areas, will be clearly visible from both Johnny Cake Ridge Road and Fernando Ave and from the nearby properties. Screening of the loading dock areas is provided with a combination of privacy fencing, berming and landscaping. Screening of the mechanical units is provided in the attached “Site Vision Plan.” Screening of the mechanical units will need to be addressed prior to the issuance of the building permit. Landscape Plan: The value of the landscape plantings on the landscape plan must meet or exceed 1.5% of the value of the cost of the construction of the building based on Means Construction Data. Additional landscaping is provided to help screen the outdoor storage area. Availability of Municipal Utilities: Utilities are available to the site. Sanitary sewer will be accessed from Johnny Cake Ridge Road on the east side of the site. Water will be looped around the building with connections to water main at 147th Street W. and Fernando Ave. Storm water will be managed off-site by a regional storm water pond to the southwest on Lot 1. Street Classifications/Accesses/Circulation: Johnny Cake Ridge Road (Major Collector) – No new access points are proposed out to Johnny Cake Ridge Road. 147th Street West (Minor Collector) – One full access is shown onto 147th Street West from the site. A turn lane will be required off of 147th Street. Fernando Avenue (Local commercial street) – One full access is shown onto Fernando Avenue. Pedestrian Access: Trail is required along both 147th Street and Johnny Cake Ridge Road. The proposed Scannell development will be responsible for the installation of trail along Johnny Cake Ridge Road connecting to the trail constructed as part of the Menard and Johnny Cake upgrade project. The plans will also need to show sidewalk connections from the building to the trails on 147th Street and Johnny Cake Ridge Road. Public Safety Issues: Fire would like to see full fire vehicle access around the building. The parking lot on the west side of the site was modified to connect to the driveway access off of Fernando Ave. Recreation Issues: A cash-in-lieu of land park dedication was previously dedicated for Apple Valley Commerce First Addition. The park dedication calculation is calculated based on the number of employees expected based on the size of the building. The park dedication will need to be re-reviewed to determine whether additional dedication is needed. Signs: No sign approvals are given at this time. No signs may be installed prior to the issuance of a permit. A separate sign permit must be obtained prior to the installation of any signs on the site or the building. Public Hearing Comments: One comment was received from the public concerning the exterior screening fence material. The fence is proposed to be 8’ tall and constructed of a maintenance-free vinyl material. The fence will be integrally colored with a pattern similar to a cedar privacy fence. The fence is proposed to be incorporated into the landscape plan with trees and plantings which will help to break up the appearance of the fence. Architectural, Structural and Civil plans are required to be signed with the permit application. Platting of the property lines must be completed prior to permit issuance. Geotechnical report boring log and Special Inspector Agreement is required prior to permit issuance and soil corrections on site. Submit plans to Minnesota Department of Labor Plumbing Division for review of proposed plumbing, roof drainage, and sanitary and storm design. A trash area is required per MSBC 2020 1303.1500. Subpart 1 requires recycling space in accordance with Table 1-A on plans issued for permit. The City of Apple Valley has adopted the 2020 MN Rule 1306, subpart 3 Special Fire Protection systems. This section would require the building to have an automatic sprinkler system installed based on occupancy type and square footage. Allowable area and building heights will be determined once the code analysis has been completed with the permit application. Mechanical equipment on the roof is required to have access in accordance with MN Mechanical Code 306.5. Per MSAC 502.4.4, the access aisles for the accessible areas shall be marked with a designation sign that says “no parking. Review areas under consideration for accessible parking areas. F-1 or S-1 occupancies shall have smoke and eat vents installed in accordance with Section 910.3 or a mechanical smoke removal system installed in accordance with Section 910.4 shall be installed in buildings and portions thereof used as a Group F-1 or S-1 occupancy having more than 50,000 square feet of undivided area. The north parking area has 65 parking spaces. The MSAC code table 1106.1 would require 3 accessible stalls. The west lot is fine. It would be an option to add the third required space to the main west entrance, since it appears this is the customer primary entrance. C402.5.6 require cargo door openings and loading door openings be equipped with weather seals that restrict infiltration and provide direct contact along the top and sides of vehicles that are parked in the doorways. C402.5.7 would require a vestibule in building entrances unless the area it opens to is less than 3,000 square feet, or meets one of the exceptions. Operational Review A review was done to determine how many of these trips are proposed to travel through the 147th Street/Johnny Cake Ridge Road and the 149th Street/Johnny Cake Ridge Road intersections to understand if the additional trips will be able to be accommodated by the current traffic controls. A review of the available reports provided approximate existing intersection level of service for the two study intersections. Results are shown in Table 2. Table 2. The traffic controls and geometry appear to be sufficient to accommodate the proposed development and no additional improvements are necessary. Landcape and Natural Resources 31. A 16.5 foot buffer is required around the pond edge and will be maintained by the City. Signage will be posted, property owner shall not encroach into buffer area. Any areas disturbed as part of the construction shall be re-seeded with appropriate seed mix and re- established per the mix guidelines. 32. Landscape Plan Sheet L-101 dated 6/7/2022 states 53 island trees are required to meet the minimum planting requirements, however no trees are shown in parking islands. Provide a plan with trees in islands meeting the City’s minimum landscaping code or indicate where these extra trees are to be located elsewhere on the site. 33. Ensure trees have space to reach mature size to maintain good form. For example the red and white pines are drawn 20-25’ on center. Shall expand to 30-35’ for better spacing as these trees reach ~40’wide each. 34. Ensure trees planted below power lines will not create a future conflict. 35. Ensure all trees proposed to be planted are within the site and not on other properties. 36. The City encourages decreasing the daylily quantity and planting more of the other native species in the schedule or further diversifying. Daylilies currently makeup approximately 45% of the perennials proposed on site. 37. Incorporation of additional native plants into the planting plan in place of cultivars and native cultivars will have additional water quality and pollinator habitat benefits. Recommend a Site Plan and Building Permit Authorization for a 30,111 sq. ft. fire station at 13995 Galaxie Ave. S UM M ARY: T he Apple Valley Fire Department has submitted an application for a site plan and building permit authorization for Fire Station N o. 2, which is located at 13995 Galaxie Ave in the northwest corner of Galaxie Ave and 140th St. T he site is zoned "P" Institutional. T he existing fire station was built in 1979 and an addition was completed in 2003. T he Fire Department plans to demolish the existing structure and replace it with a 30,111 sq. ft. modern facility with room for training, office, and staff areas. T he application includes two variances, one to exceed the maximum building height and the second for maximum building coverage. Additionally, state statute requires that a city's Planning Commission review, and have a finding of compliance with the comprehensive plan for a city capital improvement project. T he Planning C ommission will be asked to approve a resolution finding conformance with the City's Comprehensive Plan prior to a recommendation on the other building and code provisions. B AC K G RO UND: Neighborhood Meeting T hough not required, the Fire D epartment held a neighborhood meeting on May 11th from 5:30pm-6:30pm at Apple Valley Fire Station 2. All adjacent neighbors were invited to attend the meeting to learn about the project and provide feedback. One neighbor was in attendance and expressed their full support for the project. Site P lan and P arking T he current Fire Station No. 2 building does not meet Institutional zoning district setbacks, the proposed building will meet all setback requirements. A site comparison diagram is attached to this report which displays both the proposed new structure and the location of the existing building. T he proposed building has been oriented on the site to prevent cut-through traffic from Galaxie, which has been an issue with the site currently. Site access is proposed farther from the G alaxie Ave and 140th St. intersection which is safer than the current conditions. T here are currently two access points off of Galaxie that will be combined into a single access farther to the north, distancing it from the intersection. Two access points are existing on 140th St. T he proposed plan also includes two access points, but similarly to the access points on Galaxie Ave they have been shifted farther from the intersection. City ordinance does not include a minimum parking requirement for a Fire Station. T he site plan proposes 34 parking spaces and has large pavement areas available when larger training sessions occur. Staff evaluated whether additional parking would be required but that would result in additional paved area for the infrequent events. Should the C ity find that parking becomes an issue in the future additional striping and/or parking stalls could be added to the site. Site Zoning and Variances As previously noted, the site is zoned institutional and as proposed would require two variances. T he first would be to allow a 2' variance to the total height of the building. Institutional zoning allows for a maximum building height of 40', the Fire Department would like to exceed this height for a parapet wall on one section of the building. T his wall is on the center of the building and the additional height is to allow for this section of wall to be used for high ladder training. T he second variance proposed is to exceed the total building coverage by 1%. T he Institutional zoning district allows for a 20% site building coverage, which is the lowest of any zone. T his is typically because institutionally zoned sites are large and include vast open areas such as schools, religious facilities, and parks. T his site is 2.16 acres, below the average size of an institutional site. T he maximum building coverage requirement in zoning code is included in large part to regulate stormwater. T his site will include underground stormwater treatment which is a significant improvement from current conditions. When reviewing a variance, the City must consider whether there are practical difficulties which is defined by the following: "Practical Difficulties means that the applicant proposes to use the property in a reasonable manner not permitted by the zoning provisions of this Code; the plight of the applicant is due to circumstances unique to the property not created by the applicant; and the variance, if granted, will not alter the essential character of the locality. Economic considerations alone do not constitute practical difficulties." In considering a request for a variance and whether the applicant established that there are practical difficulties in complying with provisions, the Planning Commission and City Council shall consider the following factors: (i ) Special conditions apply to the structures or land in question that are particular to the property and do not apply generally to other land or structures in the district or vicinity in which the land is located; (ii) T he granting of the proposed variance will not be contrary to the intent of this chapter; (i i i ) T he special conditions or circumstances do not result from the actions of the owner/applicant; (iv) T he granting of the variance will not merely serve as a convenience to the applicant, but is necessary to alleviate practical difficulties in complying with the zoning provisions of this Code; and (v ) T he variance requested is the minimum variance necessary to alleviate the practical difficulty. T he applicant, the Apple Valley Fire Department has also stated that their request serves a public purpose by allowing improved training of fire fighters and by improving upon the current stormwater treatment on site. F inal P lat T he site is currently an outlot and will be required to final plat in the future. T he C ity is currently in the process of preparing documents to final plat the property which will be reviewed by the C ity C ouncil. T he Planning C ommission does not review final plat applications. Turn L ane On Galaxie A turn lane on G alaxie Ave is planned in the 2027-2031 capital budget cycle but is not currently designed. T his turn lane may affect the east side property line and is currently being evaluated by staff for other potential impacts. T he Planning C ommission will be provided additional information as plans are developed. Landscape P lans A landscape plan was submitted with the project submission. However, the plans show landscaping in the right-of-way, in areas where a turn lane will eventually be located, and at a greater density than is required or even healthy for the plants to thrive in the years after planting. Staff is working with the applicant to provide an updated landscaping plan to be shown at the Planning C ommission meeting on the 15th. Extensive screening will still be in place adjacent to the residential homes and a fence behind the trash enclosure are proposed to screen for any potential headlight wash to the homes as fire engines or firefighters' personal vehicles enter the site via Galaxie. Building E lev ations and Materials T he building façade is primarily brick in multiple color tones. Metal accent panels are included on wall sections and a red composite band accents the second story. T he building has several undulating wall panels to add visual relief to the wall expanse. Fire engine doors will face south and north, and are not oriented towards an residential homes. Windows on the second story are purposely placed to not face residential homes or their rear yards. Building and P edestrian Access Interior building plans are included in the plans provided. T he intention of Fire Station No. 2 is to not only to serve the City's firefighters, but also to invite the community into the station for events. T he building will not be manned full time initially, but is intended to be used full time in the future T he site has a sidewalk connection to the trail along 140th and a guest parking area on the south side. Env ironmental Considerations T he building will meet Green G lobe certifications which means it is designed with environmental considerations. High efficiency HVA C systems, low flow water features, water recycling and energy efficient lighting are all included. Additionally, the site will include conduit for electrical vehicle charging stations. As the building will not be manned for several years, this feature is not proposed immediately but would be installed at a future date when the building is more actively used. The trench backfill shall be compactedwith a vibratory plate compactor.6.All grading operations shall be conducted in a manner to minimize the potential for site erosion.Sediment control practices must be established on all down gradient perimeters before any upgradient land disturbing activities begin.7.All exposed soil areas must be stabilized as soon as possible to limit soil erosion but in no case laterthan 14 days after the construction activity in that portion of the site has temporarily or permanentlyceased. Temporary stockpiles without significant silt, clay or organic components (e.g., cleanaggregate stockpiles, demolition concrete stockpiles, sand stockpiles) and the constructed basecomponents of roads, parking lots and similar surfaces are exempt from this requirement.8.The normal wetted perimeter of any temporary or permanent drainage ditch or swale that drainswater from any portion of the construction site, or diverts water around the site, must be stabilizedwithin 200 lineal feet from the property edge, or from the point of discharge into any surface water.Stabilization of the last 200 lineal feet must be completed within 24 hours after connecting to asurface water. Stabilization of the remaining portions of any temporary or permanent ditches orswales must be complete within 14 days after connecting to a surface water and construction in thatportion of the ditch has temporarily or permanently ceased.9.Pipe outlets must be provided with energy dissipation within 24 hours of connection to surface water.10.All riprap shall be installed with a filter material or soil separation fabric and comply with theMinnesota Department of Transportation Standard Specifications.11.All storm sewers discharging into wetlands or water bodies shall outlet at or below the normal waterlevel of the respective wetland or water body at an elevation where the downstream slope is 1percent or flatter. The normal water level shall be the invert elevation of the outlet of the wetland orwater body.12.All storm sewer catch basins not needed for site drainage during construction shall be covered toprevent runoff from entering the storm sewer system. Catch basins necessary for site drainageduring construction shall be provided with inlet protection.13.In areas where concentrated flows occur (such as swales and areas in front of storm catch basinsand intakes) the erosion control facilities shall be backed by stabilization structure to protect thosefacilities from the concentrated flows.14.Inspect the construction site once every seven days during active construction and within 24 hoursafter a rainfall event greater than 0.5 inches in 24 hours. All inspections shall be recorded in theSWPPP.15.All silt fences must be repaired, replaced, or supplemented when they become nonfunctional or thesediment reaches 1/3 of the height of the fence. These repairs must be made within 24 hours ofdiscovery, or as soon as field conditions allow access. Please include these items as conditions to approval. General • All work and infrastructure within public easements or right of way shall be to City standards. • Provide a narrative of how the buildings will be constructed and any impacts. The narrative shall include the following: a. Shoring (if applicable) b. Material Storage. c. Haul routes to and from the site. d. Phasing • No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. • Public Work Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. • An underground infiltration system construction and maintenance agreement will be required as part of the development agreement. Permits • Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to construction. • Department of Labor and Industry (DOLI) shall review private utilities. • A right of way permit will be required for all work within public easements or right of way. • A Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity commences. • Since the site will be disturbing more than 1 acre and creating more than 1 acre of new impervious. The applicant will be subject to the requirements of the State NPDES Construction Storm water Permit. The applicant must provide proof of permit. Site • Recommendations for future intersection improvements were outlined in 2016 Traffic Study and include the following comments related to Fire Station: • The report noted that for the northbound right turn lane along Galaxie Avenue at 140th Street • A northbound right tum lane would impact all signal components on the southeast comer, two catch basins, AND the traffic signal controller cabinet pad. The relocation of the controller cabinet pad would require a full re- wiring of the signal system. The existing wood pole for overhead north/south power lines is likely out of the way of the tum lane construction itself, and should be able to be maintained in-place while still allowing for signal pole and curb ramp placement. The down guys for this wood pole on the north side of the pole are in the way of both tum lane and signal/ curb ramp construction and will require either elimination or relocation on the wood pole. • The bituminous trail closer to the intersection is on the back side of the wood pole and can be maintained as is, but the trail further to the south will be within the tum lane construction area and thus require relocation. One wood pole located approximately 150 feet to the south will likely require relocation to accommodate tum lane and trail construction. No driveways are in the way of the proposed tum lane construction area. For the entire length of this proposed tum lane, additional right of way will be required to accommodate the tum lane, signal construction, and trail construction further to the south. With the lower right turning traffic volumes, it is possible to reduce the length of this proposed right tum lane to 200-feet (with a recommended 15:1 deceleration taper area). • The report noted that for the southbound right turn lane along Galaxie Avenue at 140th Street (see attached figure for reference) • A southbound right tum lane would impact all signal components on the northwest comer as well as one catch basin. With the presence of the bituminous trail and a landscaped area on the back side of the trail, there may be just enough right of way available if the trail is placed right up against the new curb. If a boulevard area is required for the trail, then additional right of way will be necessary. The landscaped area near the fire station could be reduced with the tum lane and trail construction to allow for the west side (fire station driveway) curb to be maintained as is (reducing the width of the landscaped area to around 4 feet). • Two fire station driveways will be impacted by right tum lane construction, and the bituminous trail that continues to the north will require relocation well into the tum lane taper area. Right of way is likely needed to the north to accommodate the trail relocation. The proposed southbound right tum lane may be able to be limited to 200-feet long (with a recommended 15: 1 deceleration taper area) due to lower right turning traffic volumes, but this tum lane length will still impact both driveways. If a 3 00-foot tum lane is wanted, then at least one boulevard tree and two boulevard bushes near the end of the tum lane area would require removal. Some above ground utilities are also impacted by this work (including a utility pipe located between the two driveways and behind the existing trail). • It is recommended that the driveway location along Galaxie Avenue be relocated further to the north to accommodate turn lane needs. Some additional easement or right of way may be required and should be reflected in the Final Plat. • Provide a site plan, showing boundary lines of property with dimension and area, and minimum setback lines. • Include Auto turn drawing for service and emergency vehicles entering and leaving the site. • Show the location of manholes and gate valves and hydrants on the site plan. • Signage Plan and details should be included on site plan (i.e. pedestrian crossing signage, ADA, directional signs, no parking, etc…) • All retaining walls over 48” from bottom of footing to the top of wall shall be designed and certified by a structural engineer and submitted to building inspections for final approval. Retaining walls over 4’ will require a fence above the wall. Provide additional details and/or specifications for retaining wall block. Retaining walls shall be privately owned and maintained. Retaining walls are not allowed in drainage and utility easements without an approved encroachment agreement. • Show locations of proposed lighting fixtures for parking lots and site. • Site plan should show site line triangles at access entrances as well as on the landscape plan • Drainage and utility easements should be shown and labeled on Plans. Grading & Drainage Plan • Final Storm Water Pollution Prevention Plan (SWPPP) shall be included with plans and shall be reviewed and approved by City Engineer. • Final Grading Plans shall be reviewed and approved by City Engineer. • Provide the overall site composite Curve Number (CN) along with the impervious % on the area tabulation. • Show all emergency over flow (EOF) elevations and routing. The finished floor/low opening elevation must be 1’ minimum above the EOF elevation. EOF route should be clearly identified on the plans. Storm Sewer • Final locations and sizes of Storm Sewer shall be reviewed with the final construction plans and approved by City Engineer. • Provide storm sewer calculations for storm water requirements. (Rational method including Hydraulic grade lines). • Provide a pretreatment device, such as a SAFL Baffle or approved equal and sump prior to discharging into the public storm sewer. Any sumps shall be privately cleaned and maintained. • Provide details for the underground stormwater chamber system. Sanitary Sewer and Water main • Final locations and sizes of Sanitary Sewer and Water main shall be reviewed with the final construction plans and approved by City Engineer. • Identify Irrigation service location(s) if applicable per SER-4. • Provide additional drawing showing required hydrant coverage for site. • Domestic water and fire service shall be split outside the existing building and the valves shall be located 1.5 times the height of the building away from the building or placed in location readily accessible per City of Apple Valley standard detail plate SER-6. Landscape and Natural Resources • Proposed seed mix will likely require an establishment period of several years. Below is the recommended maintenance for the proposed 36-211 seed mix. If seed mix is deemed undesirable, installing native plant plugs in clusters would provide a faster establishment period. • To reduce weed establishment, mow 2 to 3 times (30 days apart) during 1st year with the mower deck about 6”-8” off the ground. Mow one time during the 2nd year before weeds set their seeds. Burn or mow once every 3 to 5 years following the initial 2 years of maintenance to remove dead plant material and stimulate new seed. • Due to the slope of the area, an erosion control blanket is recommended on the northwest side of the property. • Planted areas within the right of way should be relocated outside of the right-of-way. • The City encourages native perennial plantings. All of the proposed perennials and grasses are cultivars (cultivated varieties of native plants that do not have the same benefits to pollinators and birds), indicated by the name x ‘variety’. Native plants would not contain the variety name in quotes. • Accent Boulders are not allowed with right of way • Landscaping along Galaxie Avenue should be modified to address future turn lane and trail location.
