HomeMy WebLinkAbout08/25/2022 CITY OF APPLE VALLEY Dakota County, Minnesota August 25, 2022 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held August 25, 2022, at 7:00 o'clock p.m., at Apple Valley Municipal Center. PRESENT: Mayor Hooppaw; Councilmembers Bergman, Goodwin, Grendahl, and Melander. ABSENT: None. City staff members present were: City Administrator Lawell, Deputy City Clerk Marschall, City Attorney Dougherty, City Engineer Anderson, Parks and Recreation Director Carlson, Police Captain Dahlstrom, Police Chief Francis, City Planner Lovelace, Community Development Director Nordquist. Mayor Hooppaw called the meeting to order at 1:00 p.m. Everyone took part in the Pledge of Allegiance to the flag. APPROVAL OF AGENDA MOTION: of Bergman, seconded by Grendahl, approving the agenda for tonight's meeting, as presented. Ayes - 5 -Nays - 0. AUDIENCE Mayor Hooppaw asked if anyone was present to address the Council, at this time, on any item not on this meeting's agenda. Mr. Randy Pool, 6901 153rd Street W., Apt. 101, commented on the City's public notification and education on its "No Parking" signs. He reviewed the Minnesota Department of Transportation's sign design standards and the number of parking tickets issued. Discussion followed. CONSENT AGENDA Mayor Hooppaw asked if the Council or anyone in the audience wished to pull any item from the consent agenda. There were no requests. MOTION: of Melander, seconded by Goodwin, approving all items on the consent agenda with no exceptions. Ayes - 5 -Nays - 0. CONSENT AGENDA ITEMS MOTION: of Melander, seconded by Goodwin, approving the minutes of the regular meeting of August 11, 2022, as written. Ayes - 5 -Nays - 0. CITY OF APPLE VALLEY Dakota County,Minnesota August 25, 2022 Page 2 MOTION: of Melander, seconded by Goodwin, approving issuance of lawful gambling exempt permits, by the State Gambling Control Board, to 1776 Riders, for use on September 22, 2022, October 20, 2022,November 17, 2022, and December 15, 2022, at Bogart's Entertainment Center, 14917 Garrett Avenue, and waiving any waiting period for State approval. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-104 approving issuance of a Gambling Premises Permit to Apple Valley Hockey Association for premises at Celts Craft House, 7083 153rd Street W., and waiving any waiting period for Minnesota Gambling Control Board approval. Ayes - 5 - Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-105 approving issuance of a Gambling Premises Permit to Apple Valley Hockey Association for premises at Mezcalito Butcher, 14889 Florence Trail, and waiving any waiting period for Minnesota Gambling Control Board approval. Ayes - 5 - Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-106 setting a public hearing, at 7:00 p.m., on September 22, 2022, on the application for On- Sale Wine and 3.2 Percent Malt Liquor Licenses by Civitali Restaurant Corporation, d/b/a Punch Neapolitan Pizza. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-107 amending Lunds & Byerlys construction hours. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-108 ordering preparation of Feasibility Report for Project 2023-108, Apple Valley Additions Neighborhood Feasibility Study. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-109 clarifying terms in conditional use permits for Sand and Gravel Mining Operations. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-110 directing the City Engineer to prepare plans and specifications for Project 2023-101, 2023 Street and Utility Improvements. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-111 directing the City Engineer to prepare plans and specifications for Project 2023-104, 142nd Street W. Street & Utility Improvements. Ayes - 5 - Nays - 0. MOTION: of Melander, seconded by Goodwin, approving Amendment#3 for Minnesota Investment Fund(MIF) Grant Contract Agreement CDAP-17-0006-H-FY17 SC 132045 with the Department of Employment and Economic Development CITY OF APPLE VALLEY Dakota County, Minnesota August 25, 2022 Page 3 (DEED) for Uponor, Inc., and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, approving the Lease Agreement with Scott- Carver-Dakota CAP Agency, Inc., for Redwood Community Center, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays—0. MOTION: of Melander, seconded by Goodwin, approving the Agreement with B & B Commercial Coating, LLC, for Project 2022-135, 2022 Hydrant Reconditioning and Painting, in the amount of$28,125.00, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, approving the Agreement with Sewer Septic Grease Services, LLC, for Project 2022-134, 2022 Sump Catch Basin Cleaning, in the amount of$60,225.00, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, accepting Project 2022-103, 2022 Micro Surfacing, as complete and authorizing final payment on the agreement with Fahmer Asphalt Sealers, LLC, in the amount of$2,248.87. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, adopting Resolution No. 2022-112, amending the 2022 pay and benefit plan. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin, approving the personnel actions as listed in the Personnel Report dated August 25, 2022. Ayes - 5 -Nays - 0. MOTION: of Melander, seconded by Goodwin,to pay the claims and bills, check registers dated August 3, 2022, in the amount of$6,760,920.59, and August 10, 2022, in the amount of$1,795,288.31. END OF CONSENT AGENDA ORCHARD PLACE 5TH ADDITION Mr. Lovelace reviewed the request by HJ Development, LLP, and Rockport, LLC, for approval of the subdivision of a 16.22-acre outlot(Outlot D, Orchard Place 2nd Addition) into two lots and one outlot, and a site plan/building permit authorization for a 7,006 sq. ft. commercial retail building on both Lots 1 and 2. On August 3, 2022, the Planning Commission voted unanimously to recommend approval. Councilmember Bergman said he likes the building design, but sees the same design in other cities. He wonders if the design is a fad that will go away. Mr. Chris Moe, owner of HJ Development, responded the designs are not all the same, using different colors and stones. MOTION: of Bergman, seconded by Grendahl, adopting Resolution No. 2022-113 approving the Orchard Place 5th Addition preliminary plat, with conditions as recommended by the Planning Commission. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2022-114 approving the site plan and authorizing issuance of a building permit for construction of a 7,006 sq. ft. commercial retail building, on Lot 1, Block 1, Orchard Place 5th Addition, with conditions as recommended by the Planning Commission. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Grendahl, adopting Resolution No.2022-115 approving the site plan and authorizing issuance of a building permit for construction of a 7,006 sq. ft. commercial retail building, on Lot 2, Block 1, Orchard Place 5th Addition, with conditions as recommended by the Planning Commission. Ayes - 5 -Nays - 0. BRUCE NORDQUIST PROCLAMATION Mr. Lawell introduced this item and thanked Community Development Director Bruce Nordquist for 15 years of service to the City. He then read the proclamation proclaiming August 31, 2022, as "Bruce F.Nordquist Day in Apple Valley". The Council thanked Mr. Nordquist for his service and wished him a happy and well-deserved retirement. Mr. Nordquist thanked Council, staff, and the community for their support throughout the years. Mayor Hooppaw then presented Mr. Nordquist with the proclamation. MOTION: of Grendahl, seconded by Goodwin, proclaiming August 31, 2022, as "Bruce F. Nordquist Day in Apple Valley"in recognition and honor of his distinguished service to the City of Apple Valley. Ayes - 5 -Nays - 0. COMMUNICATIONS Mr. Lawell thanked everyone for attending the Dedication Ceremony for a new shelter building at Lebanon Cemetery on August 18, 2022. The shelter was made possible by a$338,000 donation from the Paul Rosenau family, in memory of two departed loved ones. Mr. Lawell thanked everyone for attending the ground breaking ceremony for Bodega 42 Fresh Market and Homshuk Mexican Kitchen and Bar on August 18, 2022. The site is located at the northeast corner of Galaxie Avenue and 152nd Street W. Mr. Lawell thanked Apple Valley Community Crime Prevention Association and Red's Chop Shop for their donation of$10,000 to support the Apple Valley Police Department K-9 program. The donation will be formally accepted by the Council at an upcoming City Council meeting. CITY OF APPLE VALLEY Dakota County, Minnesota August 25, 2022 Page 5 Discussion followed.
