CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Vice Chair Scanlan at 7:00 p.m. Members Present: Paul Scanlan, Keith Diekmann, David Schindler, Phil Mahowald, Becky Sandahl and Jeff Prewitt Member(s) Absent: Jodi Kurtz City staff members attending: City Planner Tom Lovelace, Planner Alex Sharpe, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. APPROVAL OF AGENDA Vice Chair Scanlan asked if there were any changes to the agenda. – None. MOTION: Commissioner Schindler moved, seconded by Commissioner Diekmann, approving the agenda. Roll call vote: Ayes - 6 – Nays – 0. 3. CONSENT ITEMS A. Approval of Minutes of December 21, 2022 MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler, approving the minutes of the meeting of December 21, 2022. Roll call vote: Ayes – 5 – Nays – 0 – AB – 1. 4. PUBLIC HEARING A. X-Golf On-Sale Liquor Conditional Use Permit Vice Chair Scanlan opened the public hearing. Planner Sharpe provided a brief presentation. Petitioner Ben Feret (Minnesota Capital Management) provided some additional information. There were no questions or comments from the commissioners or the public. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 4, 2023 Page 2 of 4 MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler, to recommend approval of an on-sale liquor sales conditional use permit. Roll call vote: Ayes – 6 – Nays – 0. 5. LAND USE A. Lunds & Byerlys Sign Variance Planner Sharpe provided a brief presentation. Petitioner Brad Lis also provided additional information. Commissioner Diekmann asked why the Planning Commission should grant a variance when Mr. Lis stated that the sign would not impact their business. Mr. Lis stated that the sign would not be for advertising purposes but more so for safety and ensuring that traffic moves more efficiently. Commissioner Diekmann said there is difficulty in granting a variance for an additional sign based on a hardship or need, when he does not see one. Traffic and safety would have been addressed by the City Engineer. Mr. Lis stated that it would enhance the safety of people getting to the store. The main pylon sign would be for advertising purposes and the additional sign would provide for easier traffic flow to the site. Commissioner Mahowald asked if there is a plan to have signage on the west side of the building. Mr. Lis stated that there will be signage but it will be smaller. The other issue is that by the time people are seeing that signage, they have already gone past the building. People coming north from English Ave. will likely see it right away but not those coming from the south. Commissioner Mahowald pointed out that Target also does not have an entrance from Pilot Knob Road and though users need to use 157th to access it, there is not directional signage to guide you back towards the store. Target and Lunds & Byerlys have similar sight line issues. There are other sites in the area that are similarly set up to Lunds & Byerlys. The request may be premature and perhaps signage could be added if the need arises. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 4, 2023 Page 3 of 4 Planner Sharpe pointed out that Target does not have directional signage. He also stated that the applicant noted several times in their application materials that the size of the sign is not intended to have an adverse effect upon adjacent properties or be used for advertisement purposes. Commissioner Prewitt asked if there is anything that would prevent the location of the secondary monument sign from being located where the requested sign is. Mr. Lis stated that they do want that sign for advertising purposes so would like to leave it off of Pilot Knob. Vice Chair Scanlan stated that Lunds & Byerlys are a well-established brand in the Twin Cities, from the logo to how the stores are designed. Vice Chair Scanlan did agree with Commissioner Mahowald that if the project did not move forward, it could be looked at again in the future if warranted. MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler, to recommend denial of a sign variance for Lunds & Byerlys to allow two ground/pylon signs where one is permitted. Roll call vote: Ayes – 6 –Nays – 0. B. Obsidian Cobblestreet Mall Planner Sharpe provided a brief presentation. The applicant was not able to attend the meeting due to the severe weather. Commissioner Schindler asked if the south elevation is the final product. Planner Sharpe stated that it is the final product. It does have 6 materials on the face and it is a fairly small building. Vice Chair Scanlan asked if the south side of the building would face the senior living facility and will the utilities be located in the rear of the building as well. Planner Sharpe stated that the rear utility rooms will be centralized and staff continues to proceed with the condition of using a landscape budget for something other than vegetation. Vice Chair Scanlan asked if Planner Sharpe had the proposed verbiage for the approval. The conditions are all standard and noted that commissioners can include any special provisions as an amendment is needed. MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler, to recommend approval site plan/building permit authorization for a 4,915 sq. ft. retail building on Lot 2, Block 1, Cobblestone Lake South Shore 9th Addition. Open public hearing, receiv e comments, close public hearing. It is the policy of the Planning C ommission to not take action on an item on the same night as its public hearing. T he drive-thru window C UP application is a request to approve a C UP that lapsed because of non-use. T he petitioners request an amendment to the condition concerning hours of operation. S UM M ARY: T he developer, Hempel Real Estate, and property owner, Honeycrisp Holdings, LLC , request a conditional use permit for drive-thru window service in connection with a C lass III restaurant at Cider Ridge Marketplace on the northeast corner of Cedar Avenue and 145th St. W. at 7495 145th St. W. T he petitioners applied for a conditional use permit to replace the one that was previously approved but lapsed because of non-use. C ity Code § 155.399 C O N D IT IO N A L USE PERMIT S states that an approved conditional use permit (C UP) must be placed in operation within one year, or the approval will lapse. T he one-year time limit ensures that development projects are undertaken in a timely manner and remain current with the current code provisions. When the project was approved in J une 2021, a conditional use permit (C UP) was approved for drive-thru window service in connection with a C lass III Neighborhood Restaurant. T he C UP approval lapsed J une 10, 2022. Review of the building permit for the 7,400 sq. ft. Cider Ridge Marketplace building was conducted within the one-year timeframe, but construction of the building was delayed until the fall of 2022. T he building is currently under construction. Hours of Operation: T he previously approved conditional use permit limited the operation of the drive-thru window to between 7:00 a.m. and 10:00 p.m. T he petitioners request that the City allow the hours to be shifted earlier to 6:00 a.m., noting that competing drive-thru coffee shops are open earlier than 7:00 a.m. T he P D zoning district, PD-1087, states that if a drive- thru window is located less than 1,000 feet from residential or institutional properties, the City may restrict the hours to 7:00 a.m. to 10:00 p.m. When the Planning C ommission reviewed the C UP in 2021, C ommissioners were concerned that the neighboring properties might be negatively impacted by early morning drive-thru traffic noise, headlights, etc. T he petitioners state that any negative impacts can be mitigated and would like to discuss an earlier start time with the Planning Commission. B AC K G RO UND: T he site is zoned PD-1087 which allows a conditional use permit for drive-thru window service in conjunction with a C lass III restaurant, provided several conditions are met. Staff recommends the following conditions as part of the draft resolution approving the conditional use permit (C UP): 1. T he drive-thru window service must be completed or utilized within one (1) year. 2. T he drive-thru window service shall be installed and operated in accordance with the approved site plan dated September 7, 2022, on file at the C ity Offices. 3. T he C lass III restaurant is located less than 1,000 feet from residential and institutional uses; therefore, the C ity Council restricts the hours of operation of a drive-thru window from 7:00 a.m. to 10:00 p.m. daily to mitigate any adverse impacts caused by noise, headlights, traffic volume and emissions from idling vehicles. 4. Noise, headlights, traffic volume and emissions from idling vehicles resulting from the operation of the window shall not negatively impact surrounding residential and institutional uses and shall be mitigated as required by the City. 5. T he drive-thru lane shall not impede or conflict with vehicular, bicycle or pedestrian traffic circulation on the site as determined by the City Traffic Engineer. 6. If the installation of the drive-thru facilities results in the loss of parking spaces, then the remaining parking spaces available for the entire site shall meet the parking requirements set forth in this Chapter. CHAPTER 7: FIRE AND SMOKE PROTECTION FEATURES Section 705: Exterior Walls 705.8: Openings in exterior walls shall comply with Sections 705.8.1 through 705.8.6 705.8.1: Allowable Area of Openings. The maximum area of unprotected and protected openings permitted in an exterior wall in any story of a building shall not exceed the percentages specified in Table 705.8 based on the fire separation distance of each individual story. Where the wall is permitted to have not less than 25 percent of the exterior wall areas containing unprotected openings based on fire separation distance as determined in accordance with Section 705.8 CHAPTER 9: FIRE PROTECTION AND LIFE SAFETY SYSTEMS Section 903: Automatic Sprinkler Systems 903.3: Installation Requirements: 903.3.1: NFPA 13 Section 912: Fire Department Connections 912.2: Location. Fire department connections shall be located on the street side of buildings, fully visible and recognizable from the street or as approved by fire code official. Chapter 10: MEANS OF EGRESS Section 1003: General Means of Egress 1003.2: Ceiling Height. The means of egress shall have a ceiling height not less than 7 feet 6 inches above finished floor, except as permitted by this section. 1003.3: Protruding Objects. 1003.3.1: Headroom. The Class III restaurant is located less than 1,000 feet from residential or institutional uses; therefore, the City Council restricts the hours of operation of a drive-thru window from 7:00 a.m. to 10:00 p.m. daily to mitigate any adverse impacts caused by noise, headlights, traffic volume and emissions from idling vehicles. 6. No more than one (1) drive-thru window with related exterior drive-thru facilities is permitted for each building on a lot of record. 7. Noise, headlights, traffic volume and emissions from idling vehicles resulting from the operation of the window shall not negatively impact surrounding residential and institutional uses and shall be mitigated as required by the City. 8. The drive-thru lane shall not impede or conflict with vehicular, bicycle or pedestrian traffic circulation on the site as determined by the City Traffic Engineer. 9. If the installation of the drive-thru facilities results in the loss of parking spaces, then the remaining parking spaces available for the entire site shall meet the parking requirements set forth in this Chapter. 10. The Conditional Use Permit may be revoked for cause if the terms of (2) through (9) preceding are not adhered to.
