CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, Paul Scanlan, Keith Diekmann, Becky Sandahl and Jeff Prewitt Member(s) Absent: David Schindler, Phil Mahowald City staff members attending: CD Director Tim Benetti, Planner Kathy Bodmer, City Engineer Brandon Anderson, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. APPROVAL OF AGENDA Chair Kurtz asked if there were any changes to the agenda. – None. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, approving the agenda. Roll call vote: Ayes – 5 – Nays – 0. 4. PUBLIC HEARING A. Cider Ridge Drive-Thru CUP Chair Kurtz opened the public hearing. Planner Bodmer provided a brief presentation. Commissioner Diekmann mentioned that the Caribou on Cedar Avenue had proposed a drive-thru to their operations some time ago and wondered what restrictions the City had given them on their hours of operation. Planner Bodmer stated that the information would be brought to the next meeting. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes February 15, 2023 Page 2 of 3 Commissioner Prewitt asked if the neighboring coffee shops are also less than 1,000 feet from residential. Planner Bodmer stated that the distances could be shown on a map at the next meeting. The Caribou on Emperor Avenue is close to a senior living facility, otherwise no other coffee shops are within 1,000 feet to residential. Chair Kurtz mentioned that there is no sidewalk on the other side of Cedar Avenue where Starbucks is. City Engineer Anderson stated that there are sidewalks on both sides of Cedar Avenue. Petitioner Ben Krsnak (Hempel Real Estate) provided some additional information. Commissioner Scanlan stated that the Planning Commission has considered several different renditions of this project and the last one had a lot of time spent on it to discuss the layout. The proximity to residential will be a challenge with making an earlier start time. Pastor Tim Bubna (Hope Church) stated that the probability of light from cars shining into the windows of the townhomes is low as the windows face west towards Cedar Avenue and there are also trees located along the townhomes as well as a privacy fence. With no further comments, Chair Kurtz closed the public hearing. 5. LAND USE None 6. OTHER BUSINESS A. Review of Upcoming Schedule and Other Updates The next Planning Commission meeting is scheduled for Wednesday, March 1, 2023, 7:00 p.m. The next City Council meeting is Thursday, February 23, 2023, 7:00 p.m. Chair Kurtz welcomed our new Community Development Director, Tim Benetti, to his first Planning Commission meeting. The Annual Business meeting was originally scheduled for March 1, 2023, but due to the planned absences of several staff and commissioners, the Annual Business meeting has been moved to March 15, 2023. At this meeting, the 2022 Annual Report will be shared and the Election of Officers will occur. It is the policy of the Planning C ommission to not take action on an item on the same night as its public hearing. S UM M ARY: An application for a conditional use permit for exterior storage and a site plan/building permit authorization has been submitted for consideration by Appro Development, Inc, applicant, and RJ T Enterprises, LLC , property owner. T he proposed use and owner of the property is Dicks Valley Service. Dicks Valley Service, located at 6781 146th St. W. in Apple Valley is seeking to expand their current operations. Dicks has purchased the remaining outlot C of Wastach Apple Valley located at the northeast corner of J ohnny C ake Ridge Road and Upper 147th St. W. T he lot is 3.15 acres and zoned "I-1" (Limited Industrial). T he applicant's narrative states that they intend to retain the existing operation in Apple Valley, and that this is an expansion of current services. T he applicant, Appro Development, Inc. is applying on behalf of Dicks. T he application proposes an exterior storage yard, which is a conditional use within the limited industrial zone, and a site plan/building permit approval for a 15,488 sq. ft. auto repair garage. Conditional uses are generally permitted within the zone, but may have additional performance standards and/or requirements to mitigate potential impacts to neighboring properties and the public. T he site is currently an outlot and will be required to final plat the property prior to the issuance of a building permit. T he Planning C ommission does not review a final plat application. B AC K G RO UND: Comprehensiv e Guiding and Zoning: T he site is guided for Industrial uses, and the proposed use is consistent with the guiding of this property. T he site is zoned "I-1" (Limited Industrial), which is consistent with the guiding of the property. Within C ity ordinance "major automobile repair and auto body shop, outdoor storage subject to conditional use" is permitted within the zone. T he code notes the outdoor storage associated with auto repair requires a conditional use permit (C UP). Site P lan: T he site is 3.15 acres, but is significantly impacted by a 50' wide easement for Magellan pipelines, which bifurcate the property. Magellan has restrictions on the types of uses that may occur within their easement. Due to the shallow grade, and age of one of the pipelines, Magellan has stated that no exterior storage, structures, or landscaping may be placed within their easement area. Additionally, due to the grade of the site all stormwater must be treated on site rather than flowing to the public pond northeast of this site. Due to the site being within a sensitive watershed and the storage of damaged vehicles, underground stormwater treatment systems are discouraged. An existing shared access drive off of J ohnny C ake Ridge Road was required when the property was platted. However, due to the pipeline previously noted, crossing the easement, even with an access drive is cost prohibitive for the applicant. T he sole access drive from Upper 147th St. W is existing. Pedestrian access to the site is not shown. Staff is recommending that the sidewalk in front of the building be extended to connect with the trail along Upper 147th St. W. T he C ity has perimeter easements along J ohnny C ake Ridge Road and Upper 147th St. W. T hese standard 10' easements are densely packed with utilities, including fiber. D ue to these utilities, staff is requiring that landscaping, fencing, and berms be installed outside of the easement. T he applicant is seeking to pave approximately 63,000 sq. ft. of the lot, the majority of the land south of the Magellan easement, and construct a 15,488 sq. ft. building. C ode requires major auto repair to have 10 parking stalls plus one additional customer space for each 800 sq. ft. of floor area over 1,000 sq. ft. Additionally, one stall for every two employees. T he site plan includes 24 stalls, but that does not account for the base 10 stalls required, or the additional 1 stall for every 2 employees. Prior to a recommendation by the Planning Commission, the correct number of parking stalls must be shown on the site plan. An auto turn drawing must be submitted to the City that demonstrates that fire and emergency vehicles are able to enter and traverse the site in the event of an emergency. Site Grading, Stormwater, and Utilities: T he site has a slight grade with the high point in the northeast corner of the site tapering to the southwest. As stated, the grades do not allow for the stormwater from this site to flow to the City pond northeast of this site. As such, all stormwater must be treated on site. T he City Engineer's memo notes that there are corrections required to the proposed stormwater pond on site. Utilities have been stubbed in on site previously, and are proposed to connect to the existing stub. T he C ity Engineer's memo provides additional conditions, comments on the utilities, and grading requirements. Exterior Storage: T he proposed exterior storage will include impounded vehicles, damaged vehicles from accidents, and those towed from other locations. Operations are proposed to be 24-hours a day, 7 days a week. Staff is recommending that the site plan show the location and number of vehicles that could be stored on site. T he current plan does not allow for staff to evaluate whether emergency vehicles can traverse the site, or ensure that there is adequate access to all portions of the site. A typical condition for exterior storage C UPs limits the total number of vehicles on a site to prevent the site from becoming overcrowded and a danger. T he application materials have not noted what types of vehicles will be stored externally on site, but the building and garage sizes would allow for semi trailers and other large vehicles. If taller/larger vehicles are proposed to be stored on site, additional screening in locations where they are located should be considered. T he tow trucks on site are of considerable size and would also be potentially stored externally. Screening of E xterior Storage: Code requires that all exterior storage be screened from view from neighboring properties, and the public right of way through a combination of solid fencing or walls, landscaping, and/or earth berm. T he applicant is proposing the combination of all three with a solid opaque white 6' fence, conifer trees, and a 2' berm. Due to the type of exterior storage proposed, staff is suggesting that the berm be increased in height along J ohnny C ake and 147th to adequately screen larger vehicles such as semis or large trucks. T he applicant has stated that they intend to provide the Planning C ommission with additional sightline renderings that demonstrate that the proposed screening will adequately screen the vehicles stored on site. If these renderings find that the current berm, fencing and landscaping would meet ordinance requirements staff would not have additional recommendations. Screening over the pipeline area is difficult and creates an area where landscaping and a berm cannot be installed. T he site plan currently proposes that the 6' high fence be the sole screening in this area. Staff would seek renderings similar to those previously noted specific to the view from the pedestrian trail along J ohnny C ake. If the exterior storage is visible, additional screening measures will need further evaluation. L ands c aping: T he majority of the landscaping on site is proposed to be utilized for screening. However, additional landscaping to the east of the building is sought, pending the ability for trees to be installed due to the grade. T he C ity encourages native plantings rather than the cultivars currently proposed. Landscaping has been reviewed by Natural Resources and additional comments are included in the City Engineer's memo. Lighting P lan: In commercial and industrial areas, any light or combination of lights that cast light on any adjacent commercial or industrial property shall not exceed one-foot candle as measured at the property line. Also, any lighting used to illuminate an off-street parking area or sign shall be arranged so as to deflect light away from any adjoining residential zone or from the public streets. D irect glare from floodlights or similar sources, shall not be directed into any adjoining property or public streets, and all the source of all lights shall be hooded or controlled in some manner so as not to light adjacent property. Mitigative measures shall be employed to limit glare and spill light to protect neighboring parcels and to maintain traffic safety on public roads. T hese measures shall include lenses, shields, louvers, prismatic control devices and limitations on the height and type of fixtures. Any light or combination of lights that cast light on any adjacent commercial or industrial property shall not exceed one-foot candle as measured at the property line candles at ground level. T he applicant shall submit a lighting plan that shows that the development will be in compliance with the C ity's lighting requirements. T he hours of illumination of any signage directly adjacent to a residential area shall be restricted. Env ironmental Considerations: Staff has encouraged the applicant to utilize sustainable materials, design, and heating/cooling options. T he applicant is currently evaluating sustainable practices and will provide the City with details on items it will be installing that meet sustainability best practices. Environmental improvements related to the stormwater pond are limited due to the site being in a protected groundwater area and the use of the site. As noted previously, the use of plants native to Minnesota is strongly encouraged. B UD G E T I M PAC T: Park dedication for this lot was deferred until the time of development for this project. T he City is seeking cash-in-lieu of land. T he park dedication is based upon the parkland demand created by employees for this development. Industrial sites have been deemed to generate .1 person-resident. T he parkland demand generated by this development is .014791 acres. The additional location within the city of Apple Valley is due to growth of the Dick’s Valley Service business. Current operations, vehicle repair, for Dick’s would remain at 146th Street with the towing business and vehicle storage yard moving to this new location. We understand that a Conditional Use Permit is required for the business as outdoor storage of vehicles is required for the business operations. The proposed development would include a new building for storage of trucks related to the towing business and an outdoor storage yard for towed vehicles (including impounded vehicles). The business would include daily operations of the tow trucks coming and going, towed vehicles being brought in and removed. Customers coming to the site to recover vehicles. Towing operations would be 24 hours a day 7 days a week to be able to respond to police department requests, emergency towing situations (accidents, snow) and normal towing operations. The outdoor storage area would be fully fenced and screened via evergreen trees on the sides facing the streets. The storage yard would also be paved. As a long standing business, Dick’s Valley Towing looks forward to continuing to serve Apple Valley and the surrounding communities while keeping their operations in Apple Valley. The building would alleviate congestion at the current facility where several aspects of the business take place. This also allows for the company trucks to be stored inside a building. The industrial lot location within Apple Valley of this project is attractive to the business due to its central location within the community. Please include these items as conditions to approval. General 1. All work and infrastructure within public easements or right of way shall be to City standards. 2. Provide a narrative of how the buildings will be constructed and any impacts. The narrative shall include the following: a. Shoring (if applicable) b. Material Storage. c. Haul routes to and from the site. d. Phasing 3. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 4. Provide a copy of the approval letter from the Department of Labor and Industry (DOLI) prior to construction. 5. Public Work Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. 6. A stormwater construction and maintenance agreement will be required as part of the development agreement. Permits 7. Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to Building permit authorization. 8. A right of way permit will be required for all work within public easements or right of way. 9. A Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity commences. 10. Since the site will be disturbing more than 1 acre and creating more than 1 acre of new impervious. The applicant will be subject to the requirements of the State NPDES Construction Storm water Permit. The applicant must provide proof of permit. 11. A copy of the executed Encroachment Agreement with Magellan Pipeline for work occurring within easement area as indicated on plans prior will need to be obtained prior to any construction activity. Site 12. Include Auto turn drawing for service and emergency vehicles entering and leaving the site. 13. Label the easements and setback lines on the site plan. 14. Show locations of proposed lighting fixtures for parking lots and site. 15. No berms or Tree planting will be allowed over the exiting drainage and utility easement on the south and west side of side adjacent to Johnny Cake Ridge Road and Upper 147th Street due to existing fiber located with the easement. Berming over the boxes is prohibited for future access. Grading & Drainage Plan 16. Final Storm Water Pollution Prevention Plan (SWPPP) shall be included with plans and shall be reviewed and approved by City Engineer. 17. Final Grading Plans shall be reviewed and approved by City Engineer. 18. Provide the overall site composite Curve Number (CN) along with the impervious % on the area tabulation. 19. Label the EOF’s on the grading plan. 20. The NWL should be indicated on plan sheets for storm water ponds. 21. The City requires that for any new or redevelopment, at least 3 feet of freeboard between the anticipated high water elevation and the minimum building opening be maintained, therefore a finished floor elevation for the building must be at minimum of 983.2. 22. In Accordance with MPCA Stormwater Manual, Infiltration is prohibited when the infiltration system will be constructed in areas that receive discharges from vehicle fueling and maintenance. 23. In Accordance with MPCA Stormwater Manual, Infiltration is prohibited when the infiltration system will be constructed in areas within a Drinking Water Supply Management Area (DWSMA) as defined in Minn. R. 4720.5100, subp. 13., if the system will be located: • in an Emergency Response Area (ERA) within a DWSMA classified as having high or very high vulnerability as defined by the Minnesota Department of Health; or • in an ERA within a DWSMA classified as moderate vulnerability unless a regulated MS4 Permittee performed or approved a higher level of engineering review sufficient to provide a functioning treatment system and to prevent adverse impacts to groundwater; or • outside of an ERA within a DWSMA classified as having high or very high vulnerability, unless a regulated MS4 Permittee performed or approved a higher level of engineering review sufficient to provide a functioning treatment system and to prevent adverse impacts to groundwater; 24. The proposed storm water management plan may need to be designed as a filtration basin with liner and underdrain to meet the requirements identified in notes 22-23. 25. Submit an updated Storm water Management Checklist. The checklist can be found on the City’s website at https://www.cityofapplevalley.org/DocumentCenter/View/16258/Project- Submittal-Checklist_Fillable Storm Sewer 26. Final locations and sizes of Storm Sewer shall be reviewed with the final construction plans and approved by City Engineer. 27. Provide storm sewer calculations for storm water requirements. (Rational method including Hydraulic grade lines). 28. The pipe along the east side of the building is shown in the drainage and utility easement and appears to collect drainage from multiple properties. If this is going to be public infrastructure then Pipe should be RCP per City standards and the easement width would need to be 15’ minimum width and the pipe size would need to meet city minimum standards of 15”. 29. Provide pretreatment device/s, such as a SAFL Baffle or approved equal and sump prior to discharging into the public storm sewer. Sump structures as shown in City “Catch Basin Manhole with Sump” detail STO-5S. Any sumps shall be privately maintained and routinely cleaned as the accumulated sediment will be from the private parking lots and roadways. Sanitary Sewer and Water main 30. Final locations and sizes of Sanitary Sewer and Water main shall be reviewed with the final construction plans and approved by City Engineer. 31. All watermain shall be a min depth of 8.0’. 32. Identify Irrigation service location(s) if applicable per SER-4. 33. The existing water service line is 8”, and the proposed line is 6”. Provide a reducer valve at the connection. 34. Provide additional drawing showing required hydrant coverage for site. 35. Domestic water and fire service shall be split outside the existing building and the valves shall be located 1.5 times the height of the building away from the building or placed in location readily accessible per City of Apple Valley standard detail plate SER-6. Landscape and Natural Resources 36. The project is located in the High and Moderate Vulnerability DWSMA (Drinking Water Supply Management Area). Per the requirements of the MN Construction NPDES Permit and Apple Valley SWMP (Surface Water management Plan), infiltration is prohibited for this area. The BMP must be converted to another type of BMP that meets both State and local requirements. If converting to a filter, an impermeable liner needs to be added to the base of the basin. 37. Applicant should provide pre-treatment such as a rainguardian or sump to capture sediments and solids prior to reaching the proposed stormwater BMP. 38. If the applicant proposes a stormwater pond for stormwater management, the following items will apply: a. Policy 4.10 of SWMP: The City requires vegetated buffer zones of at least 16.5 feet in width to be established for development and redevelopment activities creating stormwater ponds. b. Policy 4.8 of SWMP: Where protective buffer zones are established, the City requires the upland boundary line to be identified by permanent markers, approved by the City. i. The City can provide examples of signs. ii. A figure will be needed showing the sign locations, which are required at each lot line, and one at every 50-foot interval. c. City Ordinance 152.16 (4)(b)(5): A protective buffer zone component (PBC) shall be submitted as part of the natural resource management plan. The plan shall consider the proposed seed mixes and recommended maintenance efforts to ensure the longevity and health of the buffer over time. Provide detail on the proposed stormwater seed mix. The detail shall consider a minimum of a three year establishment period per the specific seed mix specifications. Regular ongoing maintenance such as weeding, spot spraying, and inter-planting are likely required to ensure the longevity, health, and functionality of the buffer. d. City Ordinance 152.57: Protective buffer zones will be subject to the requirements and restrictions in this section of ordinance and generally includes: i. Memorializing the buffer zone in a written document approved by the city and recorded on the plat. ii. Buffer restrictions on vegetation alterations, topographic alterations, dumping of materials, placement of structures or impervious surface, etc. 39. Recommendation: The project is located in the East Lake watershed; East Lake is impaired due to phosphorus. Per Apple Valley SWMP Policy 6.4, I recommend requiring enhancements to the pond and filtration basin to capture dissolved phosphorus. Examples include adding amendments to the filtration basin engineered soil mix, such as iron, adding an iron enhanced filter bench to the pond outlet, adding an iron enhanced rock weeper before the pond outlet, and using the pond for public area irrigation. 40. Revise “Plant Material Legend” to ensure it is complete and accurate. For instance, the botanical name for Black Hills spruce is listed as Acer x freemani ‘Jeffersred’ (this is a maple) and “Symbol I” has been omitted from the legend but appears on the plan. 41. The City encourages native plantings. Many of the proposed perennials and grasses contain cultivars (cultivated varieties of native plants that do not have the same benefits to pollinators and birds), indicated by the name x ‘variety’. Native plants would not contain the variety name in quotes. Additionally, if using cultivars, consider swapping out non-native plants for native versions. For instance, plants such as ‘Butterfly’ honeysuckle (Diervilla sessilifolis) can be swapped out for northern bush honeysuckle (Diervilla lonicera) varieties, a plant native to Minnesota. 42. Diversify the tree planting schedule for the Pond site plan (Sheet L100) to follow City Code 152.46 (B): e. Size, types, diversification of replacement trees. No more than one-third of the replacement trees shall be of the same species of tree, without approval of the city. Box elder, poplar, willow and silver maple are not permitted as replacement trees. Replacement trees must be no less than the following sizes: (1) Deciduous trees shall be no less than two caliper inches; and (2) Coniferous trees shall be no less than six feet high. 43. Ensure tree plantings follow the 30-20-10 diversity planting rule. The rule suggests an urban tree population should include no more than 10% of any one species, 20% of any one genus, or 30% of any family. This rule shall be followed for shade trees, evergreens, and ornamental trees. f. Additional deciduous tree species to consider are oaks, ginkgo, American basswood, buckeye, and Kentucky coffeetree. g. While not a City requirement yet, if the applicant strives to have a well-mixed tree population the planting plan could follow a state recommended 15- 10-5 diversity rule. 44. The City does not recommend planting Austrian pine due to a multitude of disease issues and maples of any variety due to severe overplanting. 45. Ensure all trees have space to reach mature size to maintain good form, even near fences.
