CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, Paul Scanlan, David Schindler, Phil Mahowald, Becky Sandahl and Jeff Prewitt Member(s) Absent: Keith Diekmann City staff members attending: Planner Alex Sharpe, Community Development Director Tim Benetti, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. APPROVAL OF AGENDA Chair Kurtz asked if there were any changes to the agenda. – None. MOTION: Commissioner Schindler moved, seconded by Commissioner Scanlan, approving the agenda. Roll call vote: Ayes - 6 – Nays – 0. 3. CONSENT ITEMS A. Approval of Minutes of March 17, 2023 MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, approving the minutes of the meeting of March 15, 2023. Roll call vote: Ayes – 6 – Nays – 0. 4. PUBLIC HEARING No public hearings. 5. LAND USE A. Dicks Valley Service Planner Sharpe provided a brief presentation. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to recommend approval of a conditional use permit for exterior storage on Outlot C, Apple Valley Wasatch. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes April 5, 2023 Page 2 of 5 MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to recommend approval of a site plan and building permit authorization for a 15,488 sq. ft. mechanics garage and office. Roll call vote: Ayes – 6 – Nays – 0. B. Short-Term Rental Ordinance Planner Sharpe provided a brief presentation. Commissioner Mahowald questioned the need for ordinance change and stated that a prohibition is likely not necessary. The business type fits well for neighborhoods. Planner Sharpe stated that comments would be forwarded to City Council. Commissioner Scanlan asked if there have been issues with police activity. Planner Sharpe stated that there are ongoing Code Enforcement cases with specific complaints. Code Enforcement is not a proactive department and is only complaint driven. Commissioner Scanlan asked if the City is looking to not change anything, but rather clarify the existing ordinance. Planner Sharpe stated that is correct. Commissioner Schindler shared that previously he had a negative experience with a long- term renter as his neighbor. Commissioner Schindler stated that people using short-term rentals want a home type feeling with more privacy, which hotels do not offer. There is a higher likelihood of property upkeep for those who operate short-term rentals as they want their home to be more attractive to prospective renters. Short-term rentals can help single individuals own homes. Commissioner Schindler stated that there is a benefit in knowing your neighbors but with the current market and people needing to increase income, it may not be possible. Chair Kurtz stated that she would want to know who is staying her neighborhood. Commissioner Prewitt said that he can see both sides of the issue and asked if permits or regulations could be considered as an option. Planner Sharpe advised that there has been no directive from City Council to do this. Commissioner Sandahl stated that more direction is needed. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes April 5, 2023 Page 3 of 5 City Attorney Hills advised that at this time City Council has directed the Commission to clarify the existing ordinance. Planning Commission can make a recommendation to request City Council to study more in-depth. City Attorney Hills also stated that the City Council did discuss short-term rentals in 2017. Commissioner Sandahl stated that with all the different opinions, it may be helpful to study the issue in-depth. Commissioner Mahowald said that he understands that complaints are confidential but there is a difference between a complaint arising simply because the short-term rentals are not allowed as opposed to it being an issue with police or safety issues. Commissioner Mahowald mentioned that at the public hearing, there was an experience on Doyles Court and the homeowners shared that they were able to learn from their mistakes and successfully operate their short-term rental without issue. Commissioner Mahowald stated that further study is warranted. Commissioner Scanlan asked if the City is the petitioner on this item and if there is no timetable for making a vote. Planner Sharpe stated that is correct. There is no timetable. Commissioner Scanlan stated that it has been 6 years since this issue was last looked into and it may be beneficial to request more study. City Attorney Hills recommends that the issue not be tabled but rather act on the ordinance so that the City Council knows what the position of the commissioners is and then make a motion to recommend that the issue be further studied. A recommendation needs to go to Council in order for them to make a decision. Chair Kurtz asked if there was anyone from the public who had any new information to share regarding this issue. Resident Bonnie Brueshoff (13141 Doyles Court) shared that there are four homes in her court and when one has been turned into an Airbnb, there is a loss of 25% of your neighborhood. There is a lot of coming and going for people in the home. Neighbors never know what types of activities are going on and there is a level of disturbance with having a short-term rental in the neighborhood. Mrs. Brueshoff wants to keep the sense of community. Resident David Greenawald (5860 131st St W) stated that he lives adjacent to the Doyles Ct. Airbnb and shared that he has had no problem with the short-term rental. Mr. Greenawald said that the property has been maintained and managed well and he does not CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes April 5, 2023 Page 4 of 5 believe people should be told what to do with their property. Mr. Greenawald stated that at the public hearing a resident mentioned there being 15 cars in the cul-de-sac and he believes that was fictitious as he has never witnessed an excess of cars other than when the owners are present to take care of the property. Resident Austin Lewis (14019 Flagstone Trail) shared that he and his wife have been operating a short-term rental for the last 3 years in a portion of their home. Prior to starting the Airbnb, they spoke with their neighbors and no one expressed any concern. There have been zero complaints about his property and they keep up with maintenance in order to have their home be most appealing. Mr. Lewis also shared that he operates a short-term rental in Burnsville and prior to starting it, they had to fill out an application and they also pay a 3% lodging tax in addition to the fees/taxes charged by Airbnb. The process was simple and adjacent neighbors needed to be made aware of the short-term rental. They have had zero issues with that property as well. Operating these short-term rentals has been a great opportunity for his family and allowed his wife to stay home with their 4 children while still generating income. The maintenance of the property has become a learning experience for his children. Their most recent guests were an elderly couple who were moving from Oklahoma into an assisted living facility that did not have vacancy yet. Commissioner Schindler asked if neighboring communities were looked at. Planner Sharpe stated that was not an item of the public hearing. Surrounding communities do have some regulations and Eagan completely disallows it. MOTION: Commissioner Scanlan moved, seconded by Commissioner Kurtz, approving the draft ordinance amending zoning code 155.003, 155.363, and 155.382 as presented in the staff report. Roll call vote: Ayes – 3 – Nays – 3. The motion does not carry as there is a tie vote. A new motion is proposed. MOTION: Commissioner Mahowald moved, seconded by Commissioner Scanlan, to request that this issue be studied further for potential benefits to the community as well as the adverse impacts and to examine what neighboring cities have done in regard to short-term rentals and potential regulations that could be put in place. However, if the C ommission concurs, staff is recommending approval of a site plan and building permit authorization for a 3,319 sq. ft. retail building for C hase Bank, subject to conditions. S UM M ARY: J PMorgan C hase Bank N.A. (Chase) has submitted an application for a site plan and building permit authorization for a 3,319 sq. ft. bank building at 15580 English Ave. T his site is the remaining parcel of the Lunds and Byerlys development/plat and is accessed through a cross access agreement from English Ave. T he .68 acre site is in the southeast corner of the Lunds development. T he site was final platted as part of the Lunds and Byerlys plat, but park dedication was deferred to the time of building permit. A site plan and building permit authorization is the only action required for the project to proceed to a building permit. T he budget portion of this memo provides additional details on the park dedication. B AC K G RO UND: Comprehensiv e Guiding and Zoning T he site is guided "C" for C ommercial uses and zoned "RB" (Retail Business). A bank use is a permitted use within the zone. Bank/financial institution drive-through windows do not create heavy traffic demand and as such do not require a conditional use permit. Site P lan As noted, the primary access to the site will be from English Ave through a cross access agreement. T he drive isle to access the site is between Schuler Shoes to the north and Mister Carwash to the south. Staff has included conditions in the draft resolution and the City Engineer's memo that way-finding signage for vehicular traffic be installed to provide clarity to site users. An overall site plan of Lunds and Byerlys' three lot plat is included as an attachment. T his plan shows the pedestrian connectivity between these three parcels as well as the Orchard Place development to the south. A pedestrian sidewalk is also included out to the trail along Pilot Knob. C ity Code requires that a bike rack be installed near the front entrance of the bank to allow for multi-modal transportation. A draft condition has been added to the resolution. T he site meets parking requirements for a bank user. If ever converted to a new use, a cross- parking easement exists between the three lots in this development. Stormwater Stormwater for this site is being treated through a regional stormwater system that was planned for, and approved as part of the overall Lunds and Byerlys project. T he City Engineer's memo provides additional comments and conditions related to stormwater now that this site is being developed. Landscaping Ordinance requires that 2.5% of the means construction cost of the building be applied towards landscaping. As with the prior C hase Bank project, this site is light on landscaping due to the desire for safety. T he applicant must meet code provisions but has the ability to utilize improved pavers, the cost to screen utility boxes, and other site improvements above code requirement to meet code. A condition has been added that the utilities on the rear side of the building be screened in a manner similar to the existing Apple Valley location. Natural Resources has also recommended additional species diversity as the plans currently only include a single tree species. Building E lev ations T he building elevations differ slightly from the existing Chase Bank location. T hese alterations do not affect the building materials but do affect the parapet height of the building. T he applicant's architect has ensured that these changes do not affect the screening of the rooftop HVA C utilities. A standard condition of approval is included that a utility screening plan be submitted with the building permit. To meet this condition, the building elevations can also be altered to demonstrate that the rooftop HVA C is screened from off site view. B UD G E T I M PAC T: Park Dedication was deferred to be collected prior to release of the building permit for this project due to the unknown user/size of the building for this site. Banks are considered an office use, which generates a higher demand for parks than industrial or retail users. Based on the adopted fee schedule this structure/use would generate the need for .2377 acres of parkland. It is typical for a development such as this to pay cash-in-lieu of land dedication. All commercial land is set at a benchmark value of $265,000 per acre. MATERIALS SHALL BE PREVENTED FROM LEAVING THE PREMISES THROUGH THE ACTION OF WIND OR STORM WATER DISCHARGE INTO DRAINAGE DITCHES OR WATERS OF THE STATE. 12.ALL STORM WATER POLLUTION PREVENTION PLAN MEASURES PRESENTED ON THE PLAN SHALL BE INITIATED AS SOON AS IT PRACTICABLE. 13.ALL STAGING AREAS, STOCKPILES, SPOILS, ETC. SHALL BE LOCATED SUCH THAT THEY WILL NOT ADVERSELY AFFECT STORM WATER QUALITY. Please include these items as conditions to approval. General 1. All work and infrastructure within public easements or right of way shall be to City standards. 2. Provide a narrative of how the buildings will be constructed and any impacts. The narrative shall include the following: a. Shoring (if applicable) b. Material Storage. c. Haul routes to and from the site. d. Phasing 3. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 4. Public Works Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. 5. Plans should include reference to all used City of Apple Valley standard detail plates. All Standard detail plates should be shown in the details section of the plans, where applicable. Permits 6. Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to construction. 7. Department of Labor and Industry (DOLI) shall review private utilities. 8. A right of way permit will be required for all work within public easements or right of way. 9. A Natural Resource Management Permit (NRMP) will be required prior to any land disturbing activity commences. 10. Any site disturbing more than 1 acre, creating more than 1 acre of new impervious, or a part of common development larger than 1 acre requires a SWPPP. The applicant will be subject to the requirements of the State NPDES Construction Storm water Permit. The applicant must provide proof of permit. Site 11. Site has been previously reviewed by City Engineer as part of a common development. The following information has already been reviewed: • Traffic impact study showing anticipated trips and distribution of traffic for determination of access needs to adjacent roadways • Storm sewer calculations for storm water requirements (Rational method including Hydraulic grade lines) • Fire hydrant coverage 12. Include Auto turn drawing for service and emergency vehicles entering and leaving the site. 13. The address of the site needs to be corrected on the Title Sheet. 14. Pavement section for public roadways shall match existing roadways and be shown on the plans. 15. Show the location of manholes and gate valves and hydrants on the site plan. 16. Show existing easements on the site/grading and utlity plans. Permanent structures are not allowed in drainage and utility easements or private storm water facilities. 17. Signage Plan and details should be included on site plan (i.e. pedestrian crossing signage, ADA, directional signs, no parking, buffer/storm water signs, no snow storage in storm water basins, etc…) for review 18. Show locations of proposed lighting fixtures for parking lots and site. 19. It’s recommended that a raised or enhanced crosswalk be considered when the sidewalk crosses the drive thru lane. Grading & Drainage Plan 20. Final Storm Water Pollution Prevention Plan (SWPPP) shall be included with plans and shall be reviewed and approved by City Engineer. 21. Final Grading Plans shall be reviewed and approved by City Engineer. 22. Provide the overall site composite Curve Number (CN) along with the impervious % on the area tabulation. 23. Label the EOF’s on the grading plan. 24. Provide rim elevations for each of the catch basins on the grading plan. 25. Submit a Storm water Management Checklist. The checklist can be found on the City’s website at https://www.cityofapplevalley.org/DocumentCenter/View/16258/Project- Submittal-Checklist_Fillable Storm Sewer 26. Final locations and sizes of Storm Sewer shall be reviewed with the final construction plans and approved by City Engineer. 27. Provide pretreatment device/s, such as a SAFL Baffle or approved equal and sump prior to discharging into the public storm sewer in an additional separate private MH. Sump structures as shown in City “Catch Basin Manhole with Sump” detail STO-5S. Any sumps shall be privately maintained and routinely cleaned as the accumulated sediment will be from the private parking lots and roadways. 28. Storm sewer within right of way and public drainage and utility easement for purposes of connection to public infrastructure shall be reinforced concrete pipe and meet all City standards. 29. The casting for STMH 100 is shown in conflict with the proposed curb line. It is recommended to move the casting north out of the curb line which does not appear to impact the location of the structure. Sanitary Sewer and Water main 30. Final locations and sizes of Sanitary Sewer and Water main shall be reviewed with the final construction plans and approved by City Engineer. 31. All water mains located within right of way and public easements for purposes of connection to public infrastructure shall be ductile iron pipe and meet all City standards. 32. Provide gate valves on all water lines going into the buildings including fire suppression lines in accordance with City Detail plate SER-6. 33. All watermain shall be a min depth of 8.0’. 34. A vertical watermain offset will be necessary at the WTR-STRM XING to maintain 1.5’ of vertical separation. It’s recommended that a note is added to the plans for a known vertical or horizontal offset. 35. Identify Irrigation service location(s) if applicable per SER-4. 36. Domestic water and fire service shall be split outside the existing building and the valves shall be located 1.5 times the height of the building away from the building or placed in location readily accessible per City of Apple Valley standard detail plate SER-6. • The 6” gate valve at the proposed connection point is in conflict with the proposed curb line. It’s recommended that when the plan is revised to show proper fire and domestic lines, the gate valves are not under curb and gutter. Landscape and Natural Resources 37. Applicant to establish 4-6 inches of topsoil as part of site grading prior to landscaping. 38. Restoration in City Right of Way will be Required where any private utility work related to the service or services of the site occurs. 39. Diversify the deciduous tree plantings to follow the 15-10-5 planting rule. The rule suggests an urban tree population should include no more than 5% of any one species, 10% of any one genus, or 15% of any family. This rule shall be followed for shade trees, evergreens, and ornamental trees. • Additional deciduous tree species to consider are oaks, disease-resistant elms, ginkgo, American basswood, buckeye, and Kentucky coffeetree. 40. The Landscape Plan Sheet L100 summary states using 12 existing trees to meet the island tree plantings requirements, with 30 new trees to be planted. Clarify which 12 trees these are on the plans or provide additional trees in greenspace areas. 41. While not required, incorporation of more native plants into the planting plan in place of cultivars and native cultivars will have water quality and pollinator habitat benefits. CITY OF APPLE VALLEY RESOLUTION NO. 2023-___ A RESOLUTION AUTHORIZING ISSUANCE OF A BUILDING PERMIT FOR A 3,319 SQ FT CHASE BANK BUILDING AND ATTACHING CONDITIONS THERETO WHEREAS, pursuant to Minnesota Statutes 462.357 the City of Apple Valley has adopted, as Title XV of the City Code of Ordinances, zoning regulations to control land uses throughout the City; and WHEREAS, said regulations provide that issuance of a building permit for commercial, industrial, and multiple residential uses require the specific review and approval of development plans by the Apple Valley Planning Commission and City Council; and WHEREAS, approval of such a building permit issuance has been requested for the above referenced project; and WHEREAS, the Apple Valley Planning Commission has reviewed the development plans and made a recommendation as to their approval at a public meeting held on May 17, 2023. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Apple Valley, Dakota County, Minnesota, that the issuance of a building permit for Chase Bank is hereby authorized, subject to all applicable City Codes and standards, and the following conditions: 1. If the Building Permit is not paid for and issued within one (1) year of the date of approval, the approval shall lapse. 2. The Building Permit shall be applicable to property to be legally described as Lot 3, Block 1, LB at Orchard Place. 3. Construction shall occur in conformance with the site plan dated April 19, 2023, on file with the City, including parking lot paving and a non-surmountable concrete curb and gutter. 4. Construction shall occur in conformance with the landscape plan dated April 19, 2023on file with the City, (including sodded/seeded public boulevard area up to each street curbline); subject to submission of a detailed landscape planting price list for verification of the City’s 2.5% landscaping requirement at the time of building permit application. 5. Construction shall occur in conformance with the utility plan dated April 19, 2023, on file with the City. 2 6. Construction shall occur in conformance with the elevation plan dated May 3, 2023, on file with the City. 7. Park dedication requirements are based upon the City’s finding that the subdivision will create a business/occupants that will generate a need for .02377 acres of parkland in accordance with adopted City standards for park services. This required dedication shall be satisfied by a cash-in-lieu of land contribution based on .02377 acres of needed land area at a benchmark land value of $265,000 per acre, which the City reasonably determines that it will need to expend to acquire land elsewhere in order to provide the necessary park services as a result of this subdivision. Issuance of a building permit shall be subject to the cash-in- lieu of land contribution payment. 8. A bike rack shall be installed in close proximity to the primary entrance which does not impede pedestrian flow of the proposed sidewalks. 9. Screening of utility meters and boxes shall be achieved either through landscaping or fencing in a manner consistent with the existing Chase Bank location in Apple Valley at 15103 Cedar Ave. 10. Subject to all conditions noted in the City Engineer's memo dated May 11, 2023. 11. Wayfinding signage shall be installed to direct vehicular and pedestrian traffic. A wayfinding signage plan shall be approved by the City Engineer. 12. The property owner shall execute a maintenance agreement or other suitable agreement to be filed with the deed that ensures the perpetual maintenance of all onsite stormwater areas. 13. Trash enclosures shall be screened in conformance with City Code. 14. All necessary mechanical protrusions visible to the exterior shall be screened or handled in accordance with Section 155.346 (3) (a) (b) of the City Code. If the current parapet wall is found to not be a sufficient screen other code compliance screening shall be installed. 15. Issuance of a Building Permit and a final certificate of occupancy is contingent upon the project being constructed in conformance with all the preceding conditions as well as all applicable performance standards of the current zoning regulations. In the event that a certificate of occupancy is requested prior to completion of all required site improvements, a suitable financial guarantee in the amount of 125% of the estimated cost of the unfinished improvements shall be required along with an agreement authorizing the City or its agents to enter the premises and complete the required improvements if they are not completed by a reasonably stipulated deadline, with the cost of such City completion to be charged against the financial guarantee. 3 16. A separate application and signage plan in conformance with the sign regulations must be submitted to the City for review and approval prior to the erection of any signs. 17. Construction and earthmoving activities shall be limited to the hours of 7:00 a.m. to 7:00 p.m. Monday through Friday. Weekend construction hours shall be limited to the hours of 8:00 a.m. to 5:00 p.m. 18. The ongoing use and occupancy of the premises is predicated on the ongoing maintenance of the structure and all required site improvements as listed in the preceding. No alteration, removal, or change to the preceding building plans or required site improvements shall occur without the express authorization of the City. Site improvements which have deteriorated due to age or wear shall be repaired or replaced in a timely fashion. BE IT FURTHER RESOLVED that such issuance is subject to a finding of compliance of the construction plans with the Minnesota State Building Code, as determined by the Apple Valley Building Official, and with the Minnesota State Uniform Fire Code, as determined by the Apple Valley Fire Marshal. S UM M ARY: Serhan Ozkan owns the residential property at 8106 Lower 147th Street West. He requests a variance to increase the height of a front yard fence from 3.5' to 6' for a length of 16'; the fence would then step down to 3.5' for a distance of 11' in compliance with the front yard fence height requirement. T he maximum height allowed in the front yard is 3.5' (42"). A variance is requested to allow the taller (6') fence section for 16' of the 27' long fence span. Mr. Ozkan states that his neighbor has set up a portable basketball hoop in the shared side yard of both properties. During play, the ball and kids often traverse onto his property, an area he wishes to protect for landscaping. When asked whether a 3.5' tall fence would accomplish his objective, he said the fence would not be tall enough to deter errant balls, toys and other activity. When asked whether thorny shrubs would help to deter the kids, he stated he was concerned that the kids would trample and damage any plantings and that he feels a tall fence is the only reasonable solution. B AC K G RO UND: F indings for a Variance: In order to grant a variance, the C ity must find that the property owner has a "practical difficulty" that prevents him/her from complying with the requirements of the zoning code. A practical difficulty is defined as follows: T he applicant proposes to use the property in a reasonable manner not permitted by the zoning provisions of the code; the plight of the applicant is due to circumstances unique to the property not created by the applicant; and the variance, if granted, will not alter the essential character of the locality. Economic considerations alone do not constitute practical difficulty. After reviewing the practical difficulty, the C ity considers the following factors to determine whether the applicant established that there are practical difficulties in complying with the provision(s) of this Chapter: 1. Special conditions apply to the structure or land in question that are particular to the property and do not apply generally to other land or structures in the district or vicinity in which the land is located; 2. T he granting of the proposed variance will not be contrary to the intent of this chapter; 3. T he special conditions or circumstances do not result from the actions of the owner/applicant; 4. T he granting of the variance will not merely serve as a convenience to the applicant, but is necessary to alleviate practical difficulties in complying with the zoning provisions of this Code; and 5. T he variance requested is the minimum variance necessary to alleviate the practical difficulty. Staff views the requested variance as a reasonable request to help the owner to protect and maintain his property. T he tall portion of the fence will be limited to a length of 16', which should have minimal impact on street sight lines and visibility. T he fence will not stop unwanted intrusions and reckless behavior if the neighbor is intent on not respecting property boundaries. However, a short length of tall fence will provide a physical barrier for improved protection. The 6 foot high fence on the front yard is much needed to protect my landscaping, which cost me thousands of dollars, from the neighbors kids who play ball every day and they are all over my yard.
