HomeMy WebLinkAbout05/04/1989BRDRVWCITY OF APPLE VALLEY BOARD OF REVIEW Dakota County, Minnesota May 4, 1989 Minutes of the Board of Review meeting for the City of Apple Valley, Dakota County, Minnesota, held May 4th, 1989, at 7:00 o'clock p.m. at Apple Valley Community Center, 14603 Hayes Road. PRESENT: Mayor Branning; Councilmembers Goodwin, Holton, Humphrey and Savanick. ABSENT: None. City staff members present were: City Administrator Melena, City Clerk Mueller, City Attorney Dougherty, Finance Director Ballenger, Personnel Director Boland, Public Works Director Gretz, City Planner Kelley, Assistant Administrator Lawell, Planning Intern Plummer and Police Chief Rivers. Mayor Branning called the meeting to order at 7:12 p.m. He stated the purpose of the meeting is to review property valuations in the City for 1989. Mr. Melena presented information on the current tax formula for residential property and reviewed the history of county, city, school and special districts tax rates from 1985 to 1989. Because the Legislature is still in session and various bills amending the property tax system are being presented, there may be changes affecting taxes payable in 1990. He reviewed an example using the current formula and said the title of homestead credit has been changed to transition aid. Bill Peterson, of the Dakota County Assessor's office, said the appraisers would be meeting with the residents individually to review their property records and he asked everyone to sign the attendance roster. Those attending tonight would preserve their right to appeal to the County Board of Review and Tax Court. In general, values in Apple Valley were increased 10 percent on land for 1989. Ronald Zamansky, an attorney representing NHD-Cedar Knolls Associates Limited Partnership, and Grady Newman, a general partner, were present to challenge the valuation placed on the mobile home community. Mr. Zamansky said the method used to value the property resulted in a 127 percent increase in one year. He was advised that the method used was based on gross rents which he believes is taxing the mobile home business; the value should be based on real estate instead. The partnership was purchasing a business and that was included in the purchase price. Mr. Peterson said he was not the appraiser involved in valuing the property, but would review the information with Mr. Zamansky and Mr. Newman. He noted one approach to appraising is the income approach, which is also used in shopping centers. Based on the certificate of value filed, they would need to resolve what is actual market value of the real estate and what portion of the price is the business value. Mayor Branning asked that a member of City Staff be present at their meeting also. The meeting was recessed at 8:15 p.m. and all persons in attendance were given an opportunity to review the Assessor's property records. Appointments have been scheduled for call back reviews of some property and a list will be submitted to the Council. They will also be conducting reviews with those who have submitted written requests to their office and the City Council. The City's total market value for 1988 was $968,386,800, with gross tax capacity of $26,987,743, and is estimated at $1,065,835,800, with gross tax capacity of $30,209,499, for 1989; an 11.9378 percent increase in tax capacity. The final total will not be available until later this summer. MOTION: of Humphrey, seconded by Holton, to adjourn. Ayes - 5 - Nays - 0. The meeting was adjourned at 10:25 o'clock p.m.
