URBAN AF�AIRS COMMITTEE MINUTES
NOVEMBER 16, 1978
PRESENT: Hank Myers, Dick Edwards, Joan Goering, Bill Smith
ABSENT: George Hecker, Clint Dixon, & Dorothy Regis
Vice Chairman �Zyers called the meeting to order.
The Committee continued work on the Proposed Massage Parlor Ordinance.
Dick Edwards reviewed an article from the Lifestyle magazine, entitled "Suburbs try
Sweeping Sex Away:' (See capy attached.) The license fees for massage parlors were discussed.
Bill Smith questioned the purpose of the ordinance. Does Apple Valley want to keep them
out or just make sure they are not blots on our fair City? Rick Kelley stated that it
is his understanding that you want to make sure they are just massage parlors or saunas.
Bill Smith suggested that the annual license fee should be $3,000.
Joan Goering asked if the City has an ordinance covering the Health Club operations.
Rick Kelley stated that this proposed ordinance would cover those operations in the
Health Club. The ordinance should be written so that only people that would apply
for a license would be legitimate operations. Bill Smith stated that maybe you wouldn`t
want to charge $3,000 for a health club. Rick Kelley stated that the license fee is
only one thing -- you could require a physical examination for a "personal service
license." Dick Edwards noted that if a YMCA would come to Apple Valley they would have
to pay the license fee also.
Rick Kelley read the following from booklet entitled "Regulating Sex Businesses:' from
the Planning Advisory Service:
Definition of Massage Establishment: Any establishment having a fixed place of business
where massages are administered for pay, including but not limited to massage parlors,
health clubs, sauna baths, and steam baths. This definition shall not be construed
to include a hospital, nursing home, medical clinic, or the office of a physician,
surgeon, chiropractor, osteopath , of physical therapist duly licensed by the State
of Minnesota; nor barber shops or beauty salons. in which massages are administered
only to the scalp, the face, the neck, or the shoulder. This definition shall not be
construed to include a volunteer fire department, a volunteer rescue squad, or a non-
profit organization operating a community center, swimming pool, tennis court, or
other education, cultural, recreational, and athletic facilities, and facilities for
the welfare of the residents of the area.
The Committee agreed to add the above definition to the ordinance Under Section l , Item D.
The Committee reviewed other information and completed the draft of the Ordinance. See
attached. This wi�:l be reviewed at the December 7, 1978 Urban Affairs Committee Meeting
and then forwarded to the City Council.
