HomeMy WebLinkAbout09/15/1988CITY OF APPLE VALLEY Dakota County, Minnesota September 15, 1988 Minutes of the special meeting of the City Council of Apple Valley, Dakota County, Minnesota, held September 15th, 1988, at 8:00 o'clock p.m. at City Hall pursuant to due call and notice thereof. PRESENT: Mayor Branning; Councilmembers Goodwin, Holton, Humphrey and Savanick. ABSENT: None. City staff members present were: City Administrator Melena, City Clerk Mueller, City Attorney Sheldon, City Engineer Gordon, Project Engineer Aune, Finance Director Ballenger, Personnel Director Boland, Forestry Specialist Brackee, Golf Manager Dodge, Assistant Finance Director Eklund, Public Works Director Gretz, Park & Recreation Director Johnson, City Planner Kelley, Assistant Administrator Lawell, Fire District Chief Lindeman, Street Superintendent Ling, Recreation Programmer Quale, Police Chief Rivers, Utilities Superintendent Ross, Central Maintenance Supervisor Spencer, Fire Chief Tuthill, Parks Superintendent Wahl and Planning & Development Director Welsch. Mgyor Branning called the meeting to order at 8:05 p.m. Mr. Welsch reviewed excerpts of the minutes of the Planning Commission CARROLLTON meeting of September 7, 1988, related to Carrollton Estates 5th Addi- ESTATES 5TH tion. The Planning Commission submitted recommendations on nine neighborhood issues as follows: Issue 1 - Additional landscaping and berming around quad homes. The developer is in the process of completing this item and the Engineer has reviewed the drainage surrounding the quads and lots 1 to 7, east of Guthrie. Issue 2 - Access to park in Carrollton. Developer will trade Lots 1 and 2, along Haven Drive, for two lots along Hayes Road. The two lots along Haven Drive will become the entry to the park from the north. Issue 3 - Request the Council authorize hiring a landscape architect to complete design of the park and other public space within Carrollton. Issue 4 - Access to Community Center and School. Request installation of stop signs at the intersection of Haven Drive and Hayes Road and construction of pathway through Hayes Park to the School. Issue 5 - Request locating the armory on 147th Street instead of on Hayes Road. Issue 6 - Instead of four residential lots at 147th and Guthrie, it is recommended the site be graded with a large berm and landscaped. The location of a storm sewer line through the property making only three lots viable. Issue 7 ~ Landscaping and berming along the ponding area at Pennock, north of 147th Street. A three-foot berm is being constructed and any additional landscaping should be reviewed when a building is designed for the commercial site. CITY OF APPLE VALLEY Dakota County, Minnesota September 15, 1988 Page 2 Issue 8 - Request the Council authorize appraisals on four homes adjacent to the quad homes to determine if there are significant changes in value which would require additional screening or other action. Issue 9 - Request installation of "local traffic only" signage at the entrances to Guthrie Avenue and Haven Drive from 147th Street. When the commercial property develops, building permit conditions should also include provisions to restrict truck deliveries and other traffic through the residential area. MOTION: of Humphrey, seconded by Savanick, approving the Planning Commission's recommendations of September 7, 1988, on the nine issues related to Carrollton Estates 5th Addition and directing staff to implement them. ADOPT CARROLLTON RECOMMENDATIONS Councilmember Holton questioned Issue 8, appraisals, because there are differing opinions on the value depending on who does the appraisal. He also expressed-concern about setting a precedent and the. potential for other homeowners to request an appraisal to determine the impact whenever changes occur in the City. Councilmember Humphrey said he does not believe appraisals would be of benefit and are an area beyond what the City should bo involved in. Councilmember Goodwin concurred and said a dispute over values becomes a civil matter the courts should decide. Councilmember Savanick asked what action would be taken if the appraisals showed a loss of value? Mr. Welsch said appraisals were suggested to try and find a neutral third party to resolve the matter. If a loss of value were determined, the developer might be asked to provide additional landscaping between the single family homes and the quad homes. Councilmember Savantck suggested that instead of paying for the cost of an appraisal, the money would be better spent for landscaping in the park or around the homes. Mark Ceminsky, 14625 Hallmark, said the four homeowners bought based on incorrect maps, one of which was handed out by the City, and the City is involved and should help find a solution. Anne Larson, 14669 Harrington Place, concurred and said if the City were not a party to the mistake it would be different. Mayor Branning asked if the owners of the four homes were present? Mr. Ceminsky said one is, but the other three were not. He asked the attorney to comment. Mr. Sheldon said regardless of what any map shows at a given time, it can change. A developer has the right to ask to have property rezoned and the City Council would have been entirely within its right to do so even after other homes were built. Councilmember Humphrey noted that a legitimate appraisal could not be done until the quaR homes and single family homes around them were done and landscaped. He agrees the City should be involved and it is involved and agrees with the eight other issues. He doesn't agree with multiple backing up to single family, but sometimes concessions are made to increase the density in the City. AMEND MOTION CALL QUESTION MOTION: of Savanick, seconded by Humphrey, calling for a vote on the amendment. Ayes - 5 - Nays - 0. Vote was taken on the amendment. Ayes - 5 - Nays - 0. : MOTION: of Holton, seconded by Humphrey, amending the motion by AMEND MOTION deleting Issue 9, local traffic signs, from approval. Councilmember Holton said it appears to try and solve a problem which may not arise and add to visual pollution. The signs often don't have any effect. Cindy Tighe, 14625 Guthrie, said the same signs are on Guthrie north of 145th Street and she avoids going through the area. Enough people will respect them to be of benefit. Mayor Branning said the Council is trying to be uniform throughout the City so all areas are treated the same. The McIntosh Drive area near Apple Valley Square is similar and there are no signs. Brian Zenisek, 14601 Guthrie, said the signs would be in the residents yards and they would like them. Mark Patridge, 8172 Upper 146th Street, said these signs are already installed north of 145th Street and it would make this area similar. If appraisals are not going to be dose, use the money to install the signs. Vote was taken on the amendment. Ayes - 1 (Holton) - Nays - 3 (Branning Abstained). Councilmember Savanick asked for clarification on Issue 4, where would the stop signs be? Mr. Melena said a three-way stop at Haven Drive and Hayes Road and they are already in place at 145th Street and Hayes Road. He asked that the Council allow the Mayor and a Councilmember to look at the site for a trail. There is one along the north edge and one will be constructed along the south side of the parking lot to Westview. Perhaps a path should connect these two. The Council concurred. Vote was taken on the motion as amended. Ayes - 5 - Nays ~ 0. MOTION: of Goodwin, seconded by Savanick, directing staff to PARK LANDSCAPE negotiate with a landscape architect to complete the design ARCHITECT of the park and other public space within Carrollton. Ayes - 5 - Nays - 0. Mr. Melena reviewed information on water usage in the City during WATER USAGE 1987 and 1988. In May, June and July of 1987, average daily water consumption was 5,718,000 gallons per day while it was 7,780,000 per day in 1988. The lawn watering restrictions are still in place and the Council will be asked to remove them in a couple of weeks. The Mayor said the Council did not address timing, but staff will be working with the developer to complete them before the development is completed. CARROLLTON TIMING SAVANICK SENATE CANDIDATE Mayor Branning noted that Councilmember Savanick won election, in the September 13, 1988, primary election, as DFL candidate for Senate from District 37 and offered congratulations. MOTION: of Goodwin, seconded by Savanick, to pay the claims and CLAIMS & BILLS bills, checks numbered 63463 through 63597, in the total amount of $2,254,521.39. Ayes - 5 - Nays - O. MOTION: of Savanick, seconded by Humphrey, to adjourn. Ayes - 5 - Nays ~ 0. The meeting was adjourned at 9:02 o'clock p.m. The Council then continued with its informal meeting. The first item reviewed was a proposed development on the northeast corner of County Road 42 and Cedar Avenue. Scott Hillstrom, Jack Ghabeaux and Todd Novaczyk, the developers, along with their architect, Jack Boatman, and financial advisor, Lou Demars, of Miller & Schroeder, were present. Following this item, the Council reviewed the 1989 City Budget.
