CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Vice Chair Scanlan at 7:00 p.m. Members Present: Paul Scanlan, David Schindler, Phil Mahowald, Becky Sandahl and Jeff Prewitt Member(s) Absent: Jodi Kurtz, Keith Diekmann City staff members attending: Community Development Director Tim Benetti, Planner Alex Sharpe, Planner Kathy Bodmer, Assistant City Engineer Evan Acosta, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. APPROVAL OF AGENDA Vice Chair Scanlan asked if there were any changes to the agenda. CD Director Benetti said that item 3. A. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes November 15, 2023 Page 2 of 4 Planner Bodmer provided a brief presentation. Vice Chair Scanlan asked if it would be appropriate to include the Flex Density designation. Planner Bodmer stated that each of the criteria was set up for a specific development and none were set up for the Flex Density. Commissioner Sandahl asked if there should be an oxford comma after “limited business”. Planner Bodmer stated that the change can be made. Vice Chair Scanlan asked if there were any comments from the public – None. Vice Chair Scanlan closed the public hearing. MOTION: Commissioner Mahowald moved, seconded by Commissioner Schindler, to recommend approval of a draft ordinance amending PD-703 Cobblestone Lake. Roll call vote: Ayes – 5 – Nays – 0. 5. LAND USE A. Wings Credit Union Sign Height and Area Variances Planner Sharpe provided a brief presentation. A representative from Wings, Tom Schuenke, was present and provided a brief presentation. Commissioner Sandahl stated that she understood where Wings is coming from but the commissioners need to abide by what the ordinance currently is and she agreed with the staff findings for denial. Commissioner Mahowald said that he agreed that the current sign is dwarfed by the building behind it and that the current sign does not reflect the campus, though the conditions for a variance make it difficult to approve, though the sign would be a benefit to the site. Mr. Schuenke added that when Commons II was purchased in 2016, the building was in a significant state of disrepair and was gutted down to the beams. The building has been turned into a showcase with a full fitness center, staff commons area, all of the office spaces were remodeled since 2017 with state-of-the-art finishes. Once that was finished, they began work on 14985 Glazier and have now begun remodeling the final area. Commissioner Schindler said he agreed with previous comments by commissioners and that this did not currently meet the requirements for a variance to be granted. He asked if Wings had looked into what the sign would look like within the ordinance requirements. Mr. Schuenke stated that they had and the 8’ maximum height was not going to get them where they want to be. Their minimum would be 12’. Mr. Schuenke said he was not sure of a path forward. Planner Sharpe explained that staff became aware of this proposal by receiving a sign variance application. Once the legal application was received, staff had to move forward with processing it as presented. Now that additional feedback from commissioners has been received, staff could potentially look into modifying the PD-290 ordinance though this would take more time as it would affect an entire zone. At this time, commissioners are only acting on the sign variance. Vice Chair Scanlan appreciated the additional information provided by staff for a path forward. He restated they would need to close out this item in order to move forward as discussed. Planner Sharpe stated that the action of this evening would be to vote on the variance requested and staff will work with the applicant as the legal application must follow a set path. Commissioner Prewitt said that he understands the desire of the applicant but going by the criteria set forth in their packet, a variance could not be granted. MOTION: Commissioner Schindler moved, seconded by Commissioner Sandahl, to recommend denial of a variance to allow a 20’ tall sign where 8’ is the maximum height permitted subject to the draft findings a-e in the staff report. Roll call vote: Ayes – 5 – Nays – 0. MOTION: Commissioner Schindler moved, seconded by Commissioner Sandahl, to recommend denial of a variance to allow a 80 sq. ft. sign where 60 sq. ft. is the maximum size permitted subject to the draft findings a-e in the staff report. Review of Upcoming Schedule and Other Updates The next Planning Commission meeting is scheduled for Wednesday, December 6, 2023, 7:00 p.m. The next City Council meeting is Tuesday, November 21, 2023, 7:00 p.m. B. Approve the 2024 Planning Commission Regular Meeting Schedule CD Director Benetti explained that next year’s meeting schedule falls on Wednesday, June 19th which has recently been adopted by the City as a holiday (Juneteenth). He asked commissioners if that meeting could be held on either Tuesday, June 18th or Thursday, June 20th instead. Staff will bring this item back for approval at the next Planning Commission meeting. 7. ADJOURNMENT Vice Chair Scanlan asked for a motion to adjourn. However, if the C ommission concurs, staff recommends that the Planning Commission provide a recommendation on the ordinance amendment. T he Planning C ommission is asked to recommend approval or denial of an ordinance amendment to C hapter 155, Appendix F-Article 2 of the A pple Valley City C ode revising Section A2-5 (A )(6) to allow the installation of a freestanding ground sign with a maximum height of 20’ and total sign area not to exceed 80 sq. ft. *T he Planning C ommission must act on the application for an ordinance amendment as submitted. If the Commission does not recommend approval, a recommendation of what the Commission does support may be provided to the City C ouncil.* S UM M ARY: Wings C redit Union at 14985 Glazier Ave applied to amend Planned Development 290 Zone 3 to allow a 20' tall 80 sq. ft. sign. Recently, Wings applied for a variance to allow this sign to be installed. Due to the requirements to grant a variance, the C ommission was unable to recommend approval. Wings withdrew their variance application and applied for the ordinance amendment. T he site is zoned "PD-290 Zone 3" and the underlying zoning is Limited Business, which is a primarily office use zoning district. T he sign ordinance allows Limited Business zones to have monument signs at a total height of 8' and max area of 60 sq. ft. T he ordinance amendment as proposed would include additional text specific to Zone 3 allowing a 20' high, 80 sq. ft. sign. Zone 3 includes six parcels, but only three buildings; Wings C redit Union, Wings Mortgage (Wings II) and C ommons I (Nystrom). T he C ity has not issued any permits for signs which exceed 8' in height within the district and there are no signs at 20' in height. T he maximum sign height in the C ity is 24', which is permitted in Retail Business and Industrial Zones. T hese zones are traditionally adjacent to major roadways such as C edar Ave, C SA H 42, Pilot Knob, and Galaxie. B AC K G RO UND: Comprehensiv e Guiding and Zoning T he site is guided for commercial uses and is zoned "PD-290 Zone 3" which is one of the City's first planned developments. PD-290 Zone 3 was specifically created for large office users, Wings, C ommons I and Commons II. T hese buildings are some of the tallest in the community and are prominent along the major roadways of C edar Ave and C SA H 42. T he sign ordinance allows for significant building signage on the upper story faces of these structures. Monument signs are permitted to be 8' in height and 60 sq. ft. Monument signs are permitted along lower speed and volume roadways. Zone 3, the area where the site is located, is circled by 147th St. and Glazier Ave. Both roadways have a speed limit at 30 mph and are lower volume. Other businesses within the Planned Development, namely the retail/office across the street from the subject property that includes Aspen Dental, J ersey Mike's, Panchero's, etc. have sought retail sized signage in the past and been denied. Aspen Dental applied for, and was denied a variance for additional sign area on the building. As stated, PD-290 was created as the C ity's primary office park. T he zone is the northeast quadrant of C edar Ave and C S A H 42 and over the years has seen significant pressure to convert to retail uses, including big-box and drive through restaurants. T he Planning Commission and C ity Council have held the guiding and zoning of the area to maintain the office land use in a key location within the community. P D-290 Zone 5, the location of t he Aspen Dental, J ersey Mike's, Panchero's, etc. building was created in 2018 as a mix between office and retail uses but the majority of P D-290 has remained office despite development pressures and the office trends occurring since 2020. Sign Types Apple Valley's ordinance includes two free-standing sign types. Monument signs, which are allowed to be 8' in height and either 40 or 60 sq. ft. depending on whether the site is a single user or multi-tenant. Monument signs are at a pedestrian scale, and typically adjacent to lower speed, lower volume roadways. Pylon signs are permitted to be 24' in height and up to 110 sq. ft. in area. T hese signs are permitted in retail and industrial zones and are typically adjacent to higher speed higher volume roadways. Guiding Sign P rinciples T he American Planning Association has compiled a nationally accepted guide for signage that includes a best practices and findings report that staff utilizes when evaluating sign ordinance amendments. T his document provides general guidance and shares the basic intent behind sign ordinance provisions. T here are some basic rules to signage which explain the purpose behind regulations. T he purpose of signage is for wayfinding, helping users find the business/service they are seeking. T he purpose behind regulating signs is to preserve the community's character, prevent visual clutter, and in many cases, to enhance the sign's ability to share its message. When signs are too prevalent, overlapping, cluttered, or out of scale with the area, they lose their effectiveness. T he purpose of relating the sign size and height to the adjacent roadway speed is to ensure the sign meets its purpose to the driver. Some communities base their code solely on the speed of the roadway rather than the zoning. At greater speeds a user must view a sign from a greater distance in order to respond appropriately. When a user is going 65 mph, they need to view a sign to know which highway exit to use. In contrast, a sign adjacent to a lower speed roadway must be readable to a user at a closer distance, these signs are intended to assist the driver in finding the driveway specific to the user. Apple Valley's ordinance for office allows wall signage a higher maximum size, but less sq. ft. of signage per sq. ft. of floor area than a retail use. T his means that large office buildings with significant sq. ft. of floor area are permitted larger building signs than typically seen in retail spaces. Smaller offices, such as Aspen Dental, are permitted smaller signage than a retail user. T he purpose of this is to allow larger and taller buildings, such as Wings and Nystrom large signs on their buildings. T hese buildings become landmarks due to their height. T he building itself serves the purpose of wayfinding for the business. Users typically see these landmarks from larger roadways and then navigate to the site using lower volume roadways. Monument signs are at a pedestrian scale and are intended to be installed adjacent to lower volume roadways that are pedestrian oriented. Smaller offices are typically along lower volume roadways and are destinations rather than businesses that rely on drive-by traffic. Retail is typically a single story, relies on drive-by traffic, and along major roadways. Apple Valley's ordinance allows retails uses more signage based on their sq. ft. of floor area than for office uses. Signage for retail also serves as advertising and attracts the drive-by user and as such is larger and taller per sq. ft. An example is the Apple Valley Liquor store vs. a destination such as a dental office. Apple Valley's ordinance generally follows the principles set forth in the American Planning Association Guide. Comparison with Neighboring Communities Staff has compiled a table of neighboring communities allowances for sign area and height which is attached to this report. T he intent of the table is to provide the C ommission with comparable zoning districts regulations in other cities to provide context to the applicant's request. Staff would like to note that when reviewing the table, the "Retail Zoning" section was compiled from zones which were either in downtowns or retail that is not adjacent to 65+ mph highways. Apple Valley does not have any retail adjacent to a 65 mph roadway and therefore these sign regulations would not be applicable. As noted previously, sign height and size are often related directly to the speed of the adjacent roadway. T he table shows that Apple Valley's sign regulations are in line with other communities. T he table also demonstrates the principle outlined previously. Regulations for freestanding signs in office areas tend to be more restrictive than in retail uses. Wings C redit Union is a mix. T he primary purpose of the site is as their headquarters, but the site also includes a branch for customers. Many financial institutions locate branches in retail zones to offer convenience to customers/members and as such, have larger/taller signs in these locations. Chapter 155, Appendix F-Article 2 of the Apple Valley City Code is amended by revising Section A2-5 (A)(6) to read as follows: (6) Signs. Except as provided herein, Ssignage shall be in accordance with Chapter 154 of the City Code except that the foundation or support structure of a freestanding sign must be completely enclosed and such enclosure shall have an exterior facing consisting of materials which shall match the exterior construction materials of the primary building with which it is associated and serves to identify. In Zone 3 of this Planned Development, freestanding ground signs shall comply with the sign regulation in Chapter 154 and the above foundation structure requirement, except the following height and sign area restrictions shall apply: (1) the height of the sign shall not exceed 20 feet; and (2) the total sign area shall not exceed 80 square feet. Section 2. Summary approved. The City Council hereby determines that the text of the summary marked "Official Summary of Ordinance No. _____” a copy of which is attached hereto clearly informs the public of the intent and effect of the ordinance. The City Council further determines that publication of the title and such summary will clearly inform the public of the intent and effect of the ordinance. Section 3. Filing. A copy of the ordinance shall be filed in the office of the City Clerk. This copy shall be available for inspection by any person during regular office hours. Section 4. Publication. The City Clerk shall publish the title of this ordinance and the official summary in the official newspaper of the City with notice that a printed copy of the ordinance is available for inspection by any person during regular office hours at the Office of the City Clerk.
