CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, David Schindler, Paul Scanlan, Phil Mahowald and Becky Sandahl Member(s) Absent: Jeff Prewitt City staff members attending: Community Development Director Tim Benetti, Planner Alex Sharpe, Assistant City Engineer Evan Acosta, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2.APPROVAL OF AGENDA Chair Kurtz asked if there were any changes to the agenda. —None. PUBLIC HEARING A. Starbucks Conditional Use Permit Amendment Chair Kurtz opened the public hearing. Planner Sharpe gave a brief presentation. Chair Kurtz asked if the order sign will be moved just for the one peak morning of 7:00- 8:00 a.m. on Fridays or are there other issues with the vehicle stacking. Planner Sharpe stated that this would be a permanent change to where the menu board is located. Planner Sharpe stated that there is considerable stacking most mornings. The stacking is not going out to Glenda and typically what has been occurring is once the stacking is out the first entrance of the parking lot, vehicles will start entering the line from the second entrance. Chair Kurtz asked why they would not close the first entrance. Planner Sharpe said that staff has explored that option in the past but it would likely inhibit site traffic to close that entrance. The site has already seen two closed entrances off of public roadways. Additionally, Starbucks would likely withdraw their application before considering closing the entrance. Chair Kurtz asked if someone could go out with orange cones at peak hours similar to what is done at other businesses. Planner Sharpe deferred to the Assistant City Engineer on that suggestion. Assistant City Engineer Acosta stated that this could be written into the conditional use permit but City staff believes that the current suggestion of including a condition that if the site begins to function worse than it is now, staff can have the ability to review it at that point. From an engineering perspective, staff is comfortable with what is proposed. Chair Kurtz asked if the issues would be resolved by simply moving the ordering board 30'. Planner Sharpe said that the applicant has stated it would reduce the number of times the issues occur but they have not stated that it would resolve them completely. The applicant has been doing these changes at a lot of locations and would likely not spend the money if it did not work. Chair Kurtz asked if Sleep Number had any complaints. Planner Sharpe said that Sleep Number's hours are off-peak as they do not open until 10:00 a.m. and by that time, high peak is usually done. The only concerns Sleep Number has expressed are about the menu board's placement in relation to their advertising, which is not a pertinent portion for the City. This would be a landlord issue. Commissioner Scanlan asked for some additional information from the applicant on how moving the menu board 30' will improve some of these issues and also asked if there was a photo of what the sign would look like from Cedar Avenue. The applicant, Connor McCoy (Kimley-Horn)was present for questions. Mr. McCoy said that the reasoning behind moving the menu board is that it creates more time from the order point to the window thus reducing the amount of time that customers are waiting at the window. That gives the baristas additional time to complete the orders before the customer is at the window and lower waiting times. With no further comments, Chair Kurtz closed the public hearing. It is the policy of the PC to not give final action on an item the same night of its public hearing. Staff is recommending this application receive initial review and comments only; and allow the applicant to update their site and building plans in accordance with the information provided in this planning staff report. SUMMARY: KLJ Engineering, acting on behalf of the property owners, Rockport, LLC, has submitted an application for a site plan and building permit authorization for a new 15,770 sq. ft. automobile related store to be known as Les Schwab Tire Center, located at 15690 English Avenue. The subject site consists of 2.72 acres and is generally located at the NE corner of English Avenue and 152nd Street W., or immediately west of Texas Roadhouse Restaurant and south of Mister Car Wash. The development parcel was originally platted as Lot 2, Block 1 of Orchard Place 2nd Addition. Park dedication was deferred on this parcel until such time a building permit is approved on said site. A site plan and building permit authorization is the only action required for the project to proceed to a building permit. The budget portion of this memo provides additional details on the park dedication. The new tire center store will also include indoor tire and minor auto repair installation service bays. A conditional use permit (CUP) is required to approve service bays with an auto accessory store, as per City Code § 155.157. (D): Service bays as accessory uses for the installation of auto accessories in conjunction with an appliance store or auto accessory store provided there are no more than two bays which shall be screened and oriented as required by the City Council. Conditional uses are generally permitted within certain zones but may have additional performance standards and/or requirements to mitigate potential impacts to neighboring properties and the public. Les Schwab Tire Center is a tire retail chain operating primarily in the western United States (WA, OR, CA, ID, MT, NV, UT and CO); was founded by Les Schwab in 1952; and is headquartered in Bend, OR. This new Les Schwab store would be the first in Minnesota and the Twin Cities area. BACKGROUND: Comprehensive Guiding and Zoning The site is guided "C" Commercial and is zoned "RB" ( Retail Business). There are no plans or applications to change either the land use or zoning designation on this site. A retail sales of auto accessories (auto accessory store) is a permitted use within the "RB" zone; and the service bays as an accessory used for the installation of auto accessories may be approved with a CUP. Site Plan The 2.7-acre site is relatively level in grade; and contains a large area of dedicated drainage and utility easement (see plat image — below), which essentially covers and impacts the easterly half and northerly sections of the site. All of the new building or structure improvements must be built outside of this easement area. New parking, walkways, landscaped beds are acceptable. The new auto accessory and installation facility will have a 2,750-sq. ft. lobby/customer service and display area located at the east section of the building; while the remaining 13,000 +/- sq. ft. of building will be dedicated to product storage, service and installation areas. The plan calls for two bay openings; with one located on the east side for entering the service area, while another on the west end for exiting the service area. This two-bay configuration for this building meets the CUP requirements that any "Service bays as accessory uses for the installation of auto accessories... " are limited to two bays only. The "RB" Zone district contains the following site development standards: • Min. Lot Area: 15,000 sq. ft. • Max. Bldg. Height: 45' • Maximum Bldg. Coverage: 30% (of lot) • Setbacks: 50' along principal/minor arterial roads 30' along other streets 15' along side lot lines 15' along rear lot lines The proposed store is shown with a 50' setback from the northerly ROW line of 157th Street to the south; a 30' + 37.18' or 67.18' setback from the westerly parcel line (which is also shown as the centerline of private English Avenue; and 69.5' + 62.25' or 131.75' from the easterly parcel line, which is also the centerline of the north/south drive lane. The subject site is bounded by 157th Street West to the south and English Avenue to the west, plus a private north/south drive lane separating the property from Texas Roadhouse and the multi-tenant commercial buildings to the east; while on the north edge is an east/west drive lane that connects English Avenue to the narrow north south drive lane (and separates the site from Mister Car Wash property to the north). 157th Street is a public road system, while English Avenue and the north/south drive lane are both private roadways. There are no access points from 157th Street to the south, nor would any be allowed by the city from this roadway. The development plan illustrates two separate access points from English Avenue along the west/northwester sections of the site, and two separate access points from the north/south private drive lane to the east. City staff is recommending the most southerly access point off English Avenue be removed due in part to a desire to provide more distance or separation from the English Ave./157th Street intersection; and to eliminate any turning or vehicle conflicts with the northernmost access on English Ave., staff is suggesting the developers provide a single access point between the two shown access points along the curved segment of English Avenue instead (see Site Plan image— below). The Sketch Plan (see Sketch Plan Image — below, which is to be reviewed under separate action by the PC at the 02/07/2024 regular meeting) illustrates a single access point from Lot 2 lining up wit the main access point into the proposed apartment development. Staff would highly recommend that any access points on opposite sides of roadways line up or be situated directly across from each other, to avoid any other conflicts. %JUIL.vJ a .. 01212 i -- i ,, ' _ . Pursuant to City Code §155.372, all parking spaces must be at minimum 9' in width and 20' in length, plus all two-way designed parking areas must maintain a minimum of a 24' wide drive aisle between marked stalls. It appears all parking stalls and drive aisles for this site meet these standards. Parking Lot Setbacks: 15' from public roads / 5' from Side/Rear lines Retail store: One parking space for each 150 square feet of floor area up to a total floor area of 20,000 square feet; Auto repair: 10 customer parking spaces, plus one additional customer space for each 800 square feet of floor area over 1,000 square feet, plus one additional space for every two employees. CALCULATIONS: • 2,750- sq. ft. of lobby/retail area: 2,750 / 150 = 183., or 19 spaces • 13,000-sq. ft. of service/repair area: [10 spaces] + [12,000 / 800 = 15 spaces] or 25 spaces (note: remaining 9 spaces for this site could accommodate up to 18 employees) As is typical in commercial districts or certain high customer service-related uses such as this auto store, ensuring safe traffic and internal vehicle movements is important. In previous land use cases or developments throughout the city, staff has included conditions to address safe, vehicle movements inside similar commercial sites; and therefore, staff has included in the draft resolution a provision that clear, directional or way-finding signage for vehicular traffic be installed to provide clarity to site users. The subject site does not include or show any new walkways. While the south edge has the trail along the north side of 157th Street, there are no connection to this trail or the other walkways in adjacent developments. Staff is recommending walkways be installed along the west, north and east edges of this site, and walkways should also include marked walkway crossings over to the existing walkways, with ADA accessibility measures. The City Engineers are also recommending a lane restrictor or travel lane reducer (bump-out) along the west curb line of the north/south private drive aisle. The City Code requires that a bike rack(s) be installed near the front entrance of the tire center store in order to encourage and facilitate multi-modal transportation modes. A draft condition has been added to the resolution. The site appears to meet the parking requirements for a retail tire store and service (installation) center on this site. The plans include a 16' x 22' trash enclosure to be located along the front building elevation and near the NW corner. It is unclear from information provided by the applicants if this enclosure will be used for normal store refuse, or for old/damaged tire storage. The City will condition that no outdoor storage of old tires will be permitted; nor will any steel storage/cargo box be allowed on site to temporarily store said tires. Building Elevations The building elevations submitted for this site are somewhat inconsistent with the surrounding commercial uses. The main structural materials are noted as pre-cast concrete panels, with either smooth finish, horizontal stamped, exposed aggregate, or a random raked finish. The panels will be stained or treated with pigments to create various Onyx (dark), Mission White, Greystone, or Ledera Red color schemes. The front entryway and related lobby area contain small, modest amount of windows. The front and rear sides of the building contain stamped metal panels to serve as decorative wall accents. Pursuant to City Code §155.346 BUILDING AND SITE DESIGN: "Exterior vertical surface design. All exterior vertical surfaces of residential, multiple residential, commercial, industrial and institutional structures of any type shall be treated as a front and have an equally attractive or same fascia." This section also calls for "Commercial buildings shall have a vertical exposed exterior finish of 100% non- combustible, non-degradable and maintenance free construction materials (such as face brick or natural stone but excluding such construction materials as sheet or corrugated aluminum, iron, or concrete block of any kind or similar). Exterior roof-top finishes shall preclude the use of exposed or plated metal; any metal surface shall be coated or anodized with a non- reflective, glare free finish." This new store meets the definition of a commercial building, and staff has deemed the "...concrete block of any kind or similar" statement precludes the building from using precast concrete panels as its main building shell or material source. Staff would suggest or request the Planning Commission to direct staff to work with the Applicants in refming the elevation and architectural plans for this new tire store center and have updated plans brought back for review and consideration at a future meeting. Staff will also wish to encourage the applicant's architect ensure that these changes do not affect the screening of any rooftop HVAC mechanical equipment. A standard condition of approval is included that a utility screening plan be submitted with the building permit. To meet this condition, the building elevations can also be altered to demonstrate that the rooftop HVAC is screened from off-site view. Stormwater Stormwater for this site is being treated through a regional stormwater system that was planned for and approved as part of the overall Orchard Place development. There are existing regional ponds located a short distance to the west of this site. The City Engineer's memo provides additional comments and conditions related to stormwater utilities, and grading requirements for this development site. Landscaping City Ordinance requires that 2.5% of the means construction cost of the building be applied towards landscaping. From the initial reviews of this site, it appears this development is light on landscaping. The area south of the building should have some added landscaping measure installed to help provide some additional screening to the service bays. The applicant must meet code provisions but has the ability to utilize improved pavers, utility screens, and other site improvements above code requirement to meet these standards. Natural Resources has also recommended the removal of some identified tree specials (Amur maples and Autumn blaze maples) and provides a recommendation or suggestions on a number of preferred species and varieties of trees and plantings. The City prides itself in making sure new developments include and provide adequate and attractive plantings throughout the site, which help add greater aesthetic value to all commercial sites. Therefore, staff is requesting the Planning Commission direct the applicant to work with city staff to refine and update the overall landscaping plan for this Les Schwab site and have that brought back for fmal review and consideration at a future PC Meeting. BUDGET IMPACT: Park dedication for this lot was deferred until the time of development for this project due in part to the unknown user and/or size of the building proposed for this site. All park dedication is based upon the parkland demand created by employees for this development. Commercial (retail/service) sites have been deemed to generate 2 employees per 1,000-sf. of building area. Based on the adopted fee schedule this structure and use would generate a need for 0.075-acres of parkland; and all commercial land is set at a benchmark value of $265,000 per acre. Please include these items as conditions to approval. General 1. All work and infrastructure within public easements or right of way shall be to City standards. 2. Provide a narrative of how the buildings will be constructed and any impacts.The narrative shall include the following: a. Shoring(if applicable) b. Material Storage. c. Haul routes to and from the site. d. Phasing 3. No construction work shall begin prior to a preconstruction meeting conference with a Public works and a Building Inspections representative. 4. Public Work Department (952-953-2400) shall be notified a minimum of 48 hours for any required water main shut downs and/or connections. 5. Plans should include reference to all used City of Apple Valley standard detail plates.All Standard detail plates should be shown in the details section of the plans. Permits 6. Provide a copy of the executed Minnesota Department of Health, Minnesota Pollution Control Agency, Met Council, Department of Labor and any other required permits prior to construction. 7. Department of Labor and Industry (DOLT) shall review private utilities. 8. A right of way permit will be required for all work within public easements or right of way. 9. A Natural Resource Management Permit(NRMP)will be required prior to any land disturbing activity commences. 10. The applicant will be subject to the requirements of the State NPDES Construction Storm water Permit.The applicant must provide proof of permit. Site 11. Include Auto turn drawing for service and emergency vehicles entering and leaving the site. 12. Pavement section for public roadways shall match existing roadways and be shown on the plans. 13. Sidewalk will be required on the perimeter of the site. • Crosswalks will be required at the Northwest corner of the site (heading north) and the Northeast corner of the site (heading east). 14. Reduced pavement width or a curb bump out is required along the west curb line of the One Way entrance off of 157th St W. 15. Signage Plan and details should be included on site plan (i.e. pedestrian crossing signage, ADA, directional signs, no parking, buffer/storm water signs, no snow storage in storm water basins, etc...)for review 16. Eliminate Amur maple from the planting schedule—Amur maple is listed as a"specially regulated plant"on the Minnesota Depai fluent of Agriculture noxious weed list.Due to the plant's propensity to disperse its seeds via wind and the site's proximity to the regional storm ponding area, it should be eliminated from the schedule. 2. `Autumn Blaze' maple should be eliminated from the plant schedule and no other maples should be substituted in their place or added to the plant schedule. This is for two reasons: a) Apple Valley Natural Resources does not recommend the planting of any maple species under any circumstances. Maples currently make up approximately 17-23% of all tree species in Apple Valley.This number is similar to what the content of ash trees was in Apple Valley prior to emerald ash borer infestation. It is an unsustainable amount that should be no greater than 10%.In the event of a maple-specific pest or pathogen similar to EAB,the financial burden on the City, its residents, and its businesses would be astronomical. b) `Autumn Blaze' maples specifically, and maples in general, are a poor choice for parking lot islands. `Autumn Blaze' maple mortality was up significantly in 2023 primarily due to recent drought conditions,which are only exacerbated in parking lot island settings. 3. The Orchard Place commercial development has proven to be a difficult area for tree establishment. This is likely due to factors common to all parking lot areas as well as the site's soil conditions. To increase the chances of mitigating these issues, suggested tree species are ginkgo, DED-resistant elm varieties, hawthorn, honeylocust, hackberry, Northern catalpa, and bur oak. In addition to maples, paper birch and river birch should be avoided due to drought sensitivity, but `Dakota Pinnacle' birch appears to show drought resistance. 4. The current plant schedule contains only one shrub, `Gro-Low' sumac. If more shrubs or native planting areas are added, Apple Valley Natural Resources highly recommends native shrubs and plants.Native shrubs and plants not only add aesthetic value but are also ideally adapted to drought and climate conditions. . ..... SUMMARY: Trident Development, LLC., submitted a sketch plan proposing a 4-story, 128-unit apartment building on a 5-acre parcel in the Orchard Place development. The parcel would be created from the 16.2-acre Outlot D of Orchard Place 2nd Addition on the northwest corner of English Ave and 157th Street West. The subject parcel is currently guided for commercial uses and zoned "RB" (Retail Business). The property would need to receive a comprehensive plan amendment, rezoning, subdivision by preliminary plat and site plan review/building permit authorization in order to move forward as proposed. Outlot D was originally planned to be part of the Orchard Place development, a large commercial retail area on the northwest corner of Pilot Knob Road and 157th Street W. A master plan created in 2017 showed a single large big-box retail center on the west side of the development with detached commercial buildings on the east along Pilot Knob Road. West of the commercial area was a large ponding feature area with trails connected to the North Creek Greenway. Once the area was under development, the peripheral commercial sites along Pilot Knob Road were developed while the big box retail center lagged behind. A revised master plan in 2019 showed two medium-sized big box retail buildings flanking a center trailhead feature near the pond water feature. The plan showed the commercial center integrated with and connected to the trails and pedestrian amenities that were part of the North Creek Greenway. The petitioners state that there is currently not enough market demand to develop the property as originally planned as a large commercial shopping center. Instead, they propose to develop the site with multiple family residential apaitinents which will help to provide rooftops and energy to the nearby shopping area. BACKGROUND: When the City reviews a request to amend the comprehensive plan, it has the most discretion to determine whether or not the use is appropriate for the location and consistent with the development vision for the area. The master plan for the Orchard Place commercial area should be updated to show how the proposed apaitiiient site will fit in with the existing commercial uses surrounding it. Issues and questions for further discussion: 1. Is multiple family residential appropriate on this site? 2. How will multiple family residents be iii pacted by the nearby car wash and potential tire installation store? How will conflicts be mitigated? 3. The plans currently show the north side of the apartment parking lot siiiply blending into the commercial parking lots to the north. The wide-open shared parking lot arrangement could lead to conflict between the apartment building and neighboring uses. Residents and guests of the apaitinent building may impact commercial businesses by using parking spaces and popular stores and restaurants may likewise take up apaitinent building guest and surface parking. 4. The Master Plan for the Orchard Place development has been evolving over time. How will the proposed development fit with future development and highlight the trailhead feature and pedestrian connections and amenities on the west side of the site? 5. Outdoor apaitinent amenities are shown including a sports court, dog run and kids play area. The amenities are shown west of the apaitinent building between the apaitiiients and the pond/trailhead amenity area. A clearer distinction needs to be provided between the public spaces and private spaces to help guide apaitinent tenants and trail users. As currently shown, trail users will not be able to identify whether or not the outdoor private amenities are part of the trail system or on the apaitinent property. 6. The correct zoning for the project needs to be identified. Currently "PD" (Planned Development) is the only option for the proposed project. 7. Availability of parking and cross-parking easements. The arrangements for easements for cross-access and cross-parking will need to be evaluated. This site will need to share private access with the commercial area. 8. The number of available surface parking spaces will need to be reviewed. The site is currently 49 surface spaces short of 2.5 total spaces/unit. 9. The developer will need to evaluate the garage floor elevation in relation to the the nearby ponding area elevations to protect against flooding.
