1. CALL TO ORDER
The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz
at 7:00 p.m.
Members Present: Jodi Kurtz, Paul Scanlan, David Schindler, Phil Mahowald, Becky
Sandahl, and Jeff Prewitt
Member(s) Absent: None
City staff members attending: Community Development Director Tim Benetti, City Planner

2. APPROVAL OF AGENDA
Chair Kurtz asked if there were any changes to the agenda. – None.
MOTION: Commissioner Schindler moved, seconded by Commissioner Scanlan,

There is one change to the minutes of February 7, 2024, which reference “Chair Kurtz opened
the public hearing” though Chair Kurtz was absent at that meeting. Minutes will be corrected.

MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler,
approving the minutes of February 7, 2024 and setting the public hearing for
the Parks Referendum – Rezoning Kelley Park. Roll call vote: Ayes - 6 –

1. Open the public hearing to rezone Kelley Park from "PD-739" (Planned Development
739) to "P" (Institutional), receive comments and close the public hearing. It is the policy of
the Planning C ommission not to act on a public hearing the night of the hearing. However, if
the Commission concurs, staff recommends the following action:
Recommend approval to rezone Kelley Park at 6855 Fortino St. from "PD-739" (Planned
Development 739) to "P" (Institutional).
S UM M ARY:
T he C ity of Apple Valley is seeking to rezone the 6 lots that make up Kelley Park located at
6855 Fortino St as part of the Apple Valley Park Referendums projects. T he properties are
currently zoned "PD-739" (Planned Development 739), which allows parks as a permitted
use, but also allows several other commercial and housing uses. With the Parks Referendums
projects, several improvements will be made in Kelley Park, including several land use
actions. T he C ity C ouncil will review the combination of 5 of the Kelley Park lots into a
single parcel, vacation of a portion of Fontana Trail, incorporating it into the parkland, and
vacation of access restriction easements. If approved, the park will be two parcels, one for
the primary park area and second parcel will remain as a landscape feature in the right-of-
way of Fresco Terrace.
Rezoning the property will not result in any physical changes to Kelley Park at this time. T he
Parks Department and Parks and Recreation C ommittee will have additional public input into
Kelley Parks improvements as part of their design process. Rezoning the property is the first
step in the future developments at Kelley Park.
B AC K G RO UND:
T he C entral Village District was established in the early 2000's and is zoned "PD-739". T he
Central Village is intended for pedestrian oriented, integrated mixed use by means of
innovative, neo-traditional mixed use developments. T he original plan for Kelley Park
included several smaller properties intended for townhomes which surround Kelley Park.
T hese residential properties did not develop and the C ity acquired them with the intent to
incorporate them into Kelley Park as the park shifted from a smaller neighborhood park into a
more community oriented recreational area.
Fontana Trail was originally intended to extend north and south. Development patterns
resulted in the vacation of this roadway in areas not adjacent to the park leaving a remnant
roadway area through Kelley Park. T he C ity Council will consider the vacation of this
roadway where adjacent to the park for incorporation into Kelley Park. T his would occur as
part of a future Council action in conjunction with platting the properties to combine parcels.

AN ORDINANCE OF THE CITY OF APPLE VALLEY, MINNESOTA AMENDING THE
ZONING MAP BY REZONING CERTAIN LAND
WHEREAS, the Planning Commission of the City of Apple Valley held a public hearing
on property described herein on March 20, 2024, as required by City Code Section 155.400(D),
and
WHEREAS, on DATE, the Planning Commission recommended the rezoning as
hereinafter described.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Apple
Valley, Dakota County, Minnesota, that:
1. The boundaries of the zoning districts established by City Code Section 155.006
are hereby amended by rezoning the following described property located at 6855 Fortino St.

1. Adopt resolution approving a finding of compliance with the Comprehensive Plan for the
Parks Referendums Projects.
S UM M ARY:
On November 7, 2023, the voters of Apple Valley approved two Parks Bond Referendums at
a special election. Improvements to Apple Valley's recreation system will be made in all City
parks and several park facilities will see significant improvements as well. Attached to this
report is a presentation that will be made before the Planning C ommission providing
additional information on the background, specific improvements, and the current status of the
Parks Referendums projects.
B AC K G RO UND:
State Statue 462.355 requires that C ity Planning C ommissions review and report in writing,
findings of compliance with the C omprehensive Plan. As the Parks Referendums projects
encompass all of the C ity Parks the staff is recommending the Planning C ommission take a
single action via the resolution attached after reviewing the proposed park improvements.

RESOLUTION PURSUANT TO MINNESOTA STATUTES SECTION
462.356 FOR PARKS REFERENDUMS PROJECTS CONFORMANCE TO
THE APPLE VALLEY COMPREHENSIVE PLAN
WHEREAS, Minnesota Statutes Section 462.356, Subdivision 2, charges the Planning
Commission with the review of any City action relating to the acquisition or disposal of City
owned interest in real property or the authorization of any capital improvement to determine
such action's compliance with the local Comprehensive Plan; and
WHEREAS, the City is considering an action for which the Planning Commission is
charged to review under said Statute, specifically the capital improvements for Apple Valley
Parks Referendums Projects noted in Exhibit A; and
WHEREAS, upon the Planning Commission's review of such action, the Planning
Commission finds that it is consistent with the goals, policies and implementation procedures
of the Apple Valley Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Apple Valley that the City Council of Apple Valley be advised that the proposed
improvements made as part of the Parks Referendums Projects in Exhibit A are found to be in
conformance with the Comprehensive Plan.
