Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held January 13th, 1986, at 6:30 o'clock p.m. at City Hall pursuant to
due call and notice thereof.
PRESENT: Mayor Branning; Councilmembers Goodwin, Holton, Humphrey and Savanick;
City Administrator Asleson; City Clerk Mueller.
ABSENT: None.
Mayor Branning called the meeting to order at 6:30 p.m. and noted it is for the
purpose of considering a strike contingency plan and updating the Council on
meetings he has had during the past several days.
The Mayor said, as discussed January 9, 1986, he had been advised of a possible
strike bymembers of the AFSCME bargaining unit. A mediator has been assigned
and certain procedures must be followed. He has asked the City's labor consult-
ant to contact the Bureau of Mediation and set another meeting as soon as possible.
In reference to the contract proposal submitted at the January 9th, 1986, City
Council meeting, the first item requested the Mayor and Council to sit in on
bargaining sessions. Mayor Branning said it is not possible for the Council to
act in this capacity. Management employees have been assigned these duties and
that will continue. The Council will be kept informed on the progress of the
meetings. This is the only issue in the proposal he wished to address and the
other issues will not be discussed tonight.
The Council received draft copies of the Strike Contingency Plan and agreed it
should be reviewed in detail and and amendments made before final adoption of it,
MOTION: of Holton, seconded by Goodwin, approving the Strike Contingency
Plan as drafted and dated January 10, 1986, including Resolu-
tions No. 1986-8 and 1986-9.

AMENDMENT
MOTION: of Savanick, seconded by Goodwin, amending the motion by adding
in Resolution No. 1986-8 a clause, "WHEREAS, only employees in
the striking bargaining unit may legally strike" and in the last
paragraph, "..RESOLVED that the Mayor and City Administrator, or
their designees, are authorized to speak publicly on behalf of
the City in regard to labor disputes and shall be the sole per-
sons authorized to speak..". Ayes - 5 - Nays - 0.
MOTION: of Goodwin, seconded by Savanick, amending the motion by amend-
ing the last paragraph of Resolution No. 1986-9 to read, "..any
Schedule II employee who, because of strike related work, accrues
more than 40 total hours in a seven-day period commencing each
Saturday ahall be honsidergdlfor compensation for hours in excess
of 40 at the end of the strike upon presentation of the hours to
the City Council." Ayes - 5 - Nays - 0.
MOTION: of Savanick, seconded by Humphrey, amending the motion by delet-
ing the second paragraph on page 9 in its entirety. Ayes -
5 - Nays - 0.

MOTION: of Savanick, seconded by Goodwin, amending the motion by de-
leting the words "or contractual services" from the second
sentence in the third paragraph on page 11; adding, "Non-
essential services done by contract prior to a strike action
may continue." after that sentence; changing the word "are"
to "may be" in the last sentence; and on page 12 changing item
11 to category 1-2 and on page 13 changing item 19 to category
1-2. Ayes - 5 - Nays - 0.

MOTION: of Humphrey, seconded by Goodwin, amending the motion by de-
leting the second paragraph on page 17 in its entirety.
Ayes - 5 - Nays - 0.

VOTE ON MOTION
MOTION: of Goodwin, seconded by Humphrey, amending the motion by de-
leting the words "at a rate of $17.79 per hour or" from item
15 on page 26. Ayes - 5 - Nays - 0.
Vote was taken on the original motion as amended. Ayes - 5 -
Nays - 0.
The Mayor asked if there were any questions. Ron Nelson asked if it was true
that any nonstriking clerical workers who spoke to striking workers during the
time of a strike would be fired? Mr. Asleson said no, that is not true. Mr.
Nelson said he had revised hourly salary comparison information from that dis-
tributed to the Council on January 9, 1986, and he distributed these revised
sheets to the Council.
Dave Beckstrom asked if the plan contains an explanation of crossing picket
lines and what will nonstriking employees be expected to do as part of their
duties during a strike? John Gretz said the plan does contain information to
be distributed to employees and nonstriking employees'duties will be whatever
they are directed to do by their supervisors.
Mr. Asleson said the letter to the Fire Department, contained in the plan, was
to advise them that it is assumed their duties will, continue as usual during a
strike. There is nothing implied that volunteer firefighters will be used to
fill other positions. In an emergency situation, there is nothing that would
prevent that from happening, but it is not intended as part of this plan.
Councilmembers Goodwin and Humphrey said they would not be able to attend the
regularly scheduled informal meeting January 16, 1986.
MOTION: of Holton, seconded by Humphrey, cancelling the informal meet-
ing of January 16, 1986. Ayes - 5 - Nays - 0.

The meeting was adjourned at 7:37 o'clock p.m.
