River Valley Church Expansion — Public hearing to consider amendment to an existing Conditional Use Permit for a church in a "BP" (Business Park) zone; variance to allow an increase in building height from 24' to 32'; site plan/building permit authorization for a 5,100 sq. ft. building addition and removal of 20 parking spaces. (PC14-41-CV) LOCATION: 14898 Energy Way PETITIONER: River Valley Church and Vanman Architects CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes December 17, 2014 Page 2 of 5 Chair Melander opened the public hearing at 7:01 p.m. Commissioner Alwin arrived at 7:02. Planner Margaret Dykes reviewed the applicant's request for a Conditional Use Permit to expand the total worship area in River Valley Church from 19,400 sq. ft. to 24,500 sq. ft. with a 5,100 sq. ft. expansion to the main auditorium. The proposed expansion of the worship area would be done only in the main auditorium, which is to be increased to approximately 13,000 sq. ft., with 1,200 seats. An additional 1,590 sq. ft. of the addition would be used for storage. The property is zoned "BP", which allows for churches as a conditional use. The City approved a CUP for the church in 2000; it has expanded twice since then in 2007 and 2009. Upon each expansion the City had approved new CUPs. The church now occupies the entire building. One of the conditions of the CUP that was approved in 2009 referenced the floor plan. Because the applicant is changing its floor plan, it is necessary to amend their existing CUP to reflect the revision. The applicant is requesting a variance to increase the maximum height of the building from 24' to 32'. Only the new addition, which is located in the central part of the building, would be 32' in height; the rest of the building would still be no taller than 24'. The Code states buildings in the "BP" zoning district shall not exceed 24' in height when they are located within 250' of residential structures. The River Valley Church property line is 169' from the common property line of the Valley Way Village townhomes east of the site. The church building is about 350' from the closest townhome, and the new addition would be 560' from the closest townhome. It is staffs opinion that the variance is justified due to the distance of the addition from residents. The increase in height of 8 would have a limited impact on the adjacent residential uses. The site plan shows the construction of a 5,094 sq. ft. addition to the church. The plan also shows a new patio and landscaped area on the north side of the building replacing existing loading docks. Sufficient landscaping must be installed to meet City requirements, which states landscaping must equal 1.5°A of the cost of building materiaisloased on Means construction data. T, he patio would lead to a new enhanced north entrance allowing church members to enter from the north and south. She reviewed the current parking spaces on the site and what would be required with the church expansion. The church has executed a cross-parking agreement with Questar, the property owner of the lots north of the site. The plans show the addition would be clad in black fiber cement panels on the north side of the building; white fiber cement panels would be used on the main entrance on the south side, and the new entrance on the north side. The Code requires building materials consist of "100% non- combustible, non- degradable and maintenance-free construction materials." It is Planning Staffs opinion that the material complies with the zoning code. The Building Official had reviewed the CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes December 17, 2014 Page 3 of 5 material specifications and stated that the panels would meet the parameters of the zoning code and comply with the building code. Staff had no concerns with the use of the panels. She stated River Valley Church had requested that the proposal move forward if the City has no major issues, subject to any conditions deemed necessary. The church would like to begin construction by March 30, 2015. Commissioner Alwin asked for confirmation that the distance to the townhomes are across Pilot Knob Road. Ms. Dykes answered yes. Commissioner Alwin questioned the parking at the Questar facility and River Valley Church and assumed they have staggered parking. Ms. Dykes answered yes. The peak demand for the church and peak demand for Questar are at different times. There is an executed parking agreement filed with Dakota County. Commissioner Schindler expressed concern for the north elevation and that he was not comfortable with the rendering and would like to see something more compelling. Ms. Dykes commented that would be a question for the applicant. Chair Melander suggested that more visual interest could be added. Commissioner Scanlan questioned if the request for the variance could affect the surrounding facilities or other applications if this is approved with the additional height. Ms. Dykes answered that as with any variance it adds a precedent. Staff is comfortable with the distance from the townhomes. Commissioner Burke inquired if the black wall to the north would be replacing the loading docks. Ms. Dykes answered yes. Commissioner Alwin asked for an aerial map and commented that the north side of the building where the docks currently are would not really be seen from the street. Ms. Dykes stated that traveling south on Pilot Knob Road a driver may see the back of the building. Commissioner Diekmann inquired where the cellular tower was located and what the height of the tower was. Ms. Dykes pointed out the location of the tower and answered that the tower was about 80 feet but she would have to confirm that. Angie Knodel, Vanman Architects, provided additional information and color options for the materials. Commissioner Schindler commented it helps to see the additional material colors. Commissioner Diekman stated he agrees with Commissioner Schindler and is not here to change anyone's design intent but he is not interested in a multi-color panel building. He would prefer something of silver bending and softened colors. Chair Melander closed the public hearing at 7:20 p.m. Commissioner Schindler commented he was comfortable with the applicant working with City staff. MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler recommending approval of an amendment to the existing Conditional Use Permit to allow for an approximately 5,100 sq. ft. addition for River Valley Church located at 14898 Energy Way (Lot 1, Block 1, Valley Business Park 2nd Addition), as shown on the plans received on November 19, 2014, subject to all applicable City codes and standards. Ayes - 6 - Nays - 0. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan recommending approval of a variance increasing the height of the proposed addition from 24' to 32' for an approximately 5,100 sq. ft. addition at River Valley Church located at 14898 Energy Way (Lot 1, Block 1, Valley Business Park 2nd Addition), as shown on the plans received on November 19, 2014, due to the distance of the addition from adjacent townhomes being greater than 250', subject to all applicable City codes and standards. Background: The Planning Commission is requested to review the attached two plans that have been submitted by Caribou Coffee, 14638 Cedar Avenue, for a conditional use permit for a drive-thru lane in conjunction with a Class III Neighborhood Restaurant. At the same time, the Commission is encouraged to take feedback and respond to questions from the Cedar Marketplace businesses related to revised plans from Caribou Coffee. The Planning Commission discussion is requested because, although a public hearing is not required, Caribou's plans have been refined since the time of the Planning Commission's review of the project. The attached two plans were distributed to the Apple Valley Chamber of Commerce and the tenants in the shopping center, to solicit feedback. The Chamber and businesses have been invited to attend the January 7 meeting to voice any questions or concerns they may have concerning the project. The Planning Commission reviewed and recommended approval of Caribou's CUP request at its October 15, 2014 meeting. At its December 11, 2014, Informal Meeting, the City Council raised several questions and concerns about the drive-thru lane design and its potential impact on traffic and businesses within the Cedar Marketplace parking lot. In response to the City Council's feedback, Caribou Coffee prepared a revised Site Plan ("Option C") which provides a dedicated queue lane that is separated from parking lot traffic. By reducing the size of the parking lot landscape islands, the property owner is actually able to increase the number of parking spaces available by four (346 spaces to 350 spaces). Discussion: Initial review by staff, which the Planning Commission may wish to discuss further: Are any variances or PD amendments required given the proposed changes to the drive aisles, islands, number and location of parking spaces? • What are the landscaping and lighting changes and expectations? • Who will keep the pedestrian sidewalk to Cedar Avenue cleared of snow and ice? • What are drive-aisle, island and property setbacks in greater detail? Where are catch basins in the drive-aisle? How will storm water flow? • If green area is lost, will an infiltration basin be required? January 2, 2015 Dear Cedar Marketplace Business Owner/Manager, You are invited to attend the Apple Valley Planning Commission meeting of Wednesday, January 7, 2015, at 7:00 p.m. to discuss Caribou Coffee's revised plans for a drive-thru lane. Caribou Coffee has applied for a conditional use permit (CUP) to construct a drive-thru in conjunction with a Class III restaurant. Background: In December, the Apple Valley City Council reviewed Caribou Coffee's proposed plan for a drive-thru lane at 14638 Cedar Avenue which consisted of a compact drive-thru loop on the west side of the Cedar Marketplace parking lot. The City Council raised several questions and concerns, including loss of parking and potential conflicts between queuing vehicles and parked vehicles. Based upon this feedback, Caribou prepared a revised layout ("Option C") with a dedicated queue lane that 15 separated from the parking area. The property owner proposes to reduce the size ofthe parking islands within the shopping center parking lot in order to add parking spaces. The proposed modifications would result in an increase in the number of parking spaces from 346 spaces to 350 spaces. Once again it has been a busy and successful year. At the January 7, 2015 Planning Commission meeting, I will review our accomplishments and would appreciate your feedback and observations. What if. . .? 7A Economic Development News A Weekly Update from the Community Development Department December 31, 2014 Community Development Highlights of 2014 Economic Development… As 2014 draws to a close, the Community Development Department would like to highlight several of the great projects that were worked on this year. Apple Valley remains the place to Plant Grow Prosper. Lives Housing Works The project review and planning work done for subdivision and housing developments Shops allows Apple Valley to declare it is back in the housing business after years of lessor activity and declining values. In the last 18 months, the new housing approved or under Learns review totals 703 units of apartments, and 447 single family homes. The 1,150 total Plays units include the following projects:  The 196-unit Gabella Apartment building in the Parkside Village development is now Buys under construction. The new market-rate apartments, located generally northeast of Sells nd Galaxie Avenue and 152 Street W., are expected to be completed in early 2016. The 126-unit Galante Apartment building, which was also approved, is expected to begin Leases construction after the Gabella building opens. Lends  The 101-unit market rate Remington Cove Apartments located southeast of Galaxie Helps Avenue and Founders Lane is now under construction. The project is expected to be Engages completed by November 2015. Exists  The Springs of Apple Valley is a 280-unit apartment complex that is proposed for the th northwest corner of 147 Street W. and Flagstaff Avenue. The Planning Commission Plans has reviewed the project and this is expected to move to the City Council for review in Ages the early part of 2015. Protects  Several new single-family home developments were approved this year: Builds Cobblestone Lake North Shore -22 single-family homes on 4.85 acres southwest o of Eagle Bay Drive and Cobblestone Lake Parkway North. Changes Hunter Forrest – 14 single-family homes on 7.41 acres generally northeast of o Invests Galaxie Avenue and Frost Point Way. Creates Regent’s Point – a 76 single-family home phase generally northeast of County o Road 46 and Johnny Cake Ridge Road. Grows Quarry Ponds – 14 lots for single-family homes out of a 33-lot development Improves o received approval generally located northwest of County Road 46 and Johnny Cake Opportunity Ridge Road. The Cortland Second and Third Additions added a combined 62 single-family o …in the lots for development this year in the next phases. Valley. Embry Place – 13 lots for single-family homes out of an 86-lot development o received final approval generally southeast of County Road 42 and Pilot Knob Road. nd Apple Valley East Family 2 Addition – 34 single family homes began o th construction this year northeast of 155 Street W. and Pilot Knob Road. PlantGrowProsper Intentional Economic Development Commercial and Industrial  Construction was completed on the final phases of Apple Valley Business Campus th with the two new buildings north of 147 Street W.: an approximately 44,000 sq. ft. multi-tenant building and an approximately 83,000 sq. ft. multi-tenant building. Tenant buildouts are underway and facilitated by the Building Inspections division.  Edina Realty, a 9,000 sq. ft. office building, is now under construction in the Cobblestone Lake Commercial area; and Prestige Pre-school, a 10,850 sq. ft. th daycare facility, is slated to be located southwest of 158 Street W. and Emperor Avenue.  The Minnesota Valley Transit Authority received approval for a transit layover facility just east of the Apple Valley Transit Station. The layover facility consists of spaces for 14 buses, and a 600 sq. ft. building for transit drivers.  Tide Dry Cleaners will occupy nearly 3,300 sq. ft. of tenant space in the Time Square Shopping Center. The new business needed site plan approval for its valet drive lane.  River Valley Church, located at 14898 Energy Way, requested approval for a 5,100 sq. ft. expansion. City Council review is planned for January, with construction expected to begin in March 2015.  Merchant’s Bank is leaving the Commons I office building and relocating to an existing building at 14990 Glazier Avenue, and adding a drive-up teller window to better serve customers. Also leaving the Commons I building is Dougherty, Molenda, Solfest, Hills & Bauer P.A., which has moved to the Wings Financial building. Finding the right alternative locations has allowed both businesses to remain in Apple Valley.  A drive-thru window and lane for Caribou Coffee, 14638 Cedar Avenue, is currently being reviewed. The applicant is currently refining plans to alleviate potential congestion in parking areas. Many new businesses opened this year. PlantGrowProsper Intentional Economic Development Policy and Other Department Initiatives  The City is on track to receive a Metropolitan Council LCDA grant of $1,148,639 for the Village Pointe Plaza project, which is located on a 3.65-acre site southwest of rd Galaxie Avenue and 153 Street W. in the Apple Valley Central Village. Planned for the site is a 78-unit active senior cooperative, and about 42,000 sq. ft. of commercial uses including a boutique grocery store.  The City made several updates to the sign code this year to create a more business- friendly code. The code now allows individual tenants/businesses to be identified on Area Identification Signs in Industrial and Business Park zones, and the maximum signage area for Institutional properties has been increased to account for the multiple uses in these buildings. The City also made changes to the zoning code to better serve residents and businesses and updated the ordinances on keeping of animals.  The City participated in the creation of a new initiative this year. Vitalocity! is an effort led by the private market to better incorporate aging-friendly principles into the City’s social, economic, and physical infrastructure. The City, in conjunction with several corporate and non-profit partners including Ecumen, sponsored a three-day workshop open to residents and businesses to help develop a “roadmap” for an aging- friendly Apple Valley.  With strategic help from Uponor earlier in the year, the City advanced business connections to Scandinavian countries. In March, staff met with local representatives of the Swedish, Norwegian, and Finnish Chambers of Commerce to explore partnerships. In August, staff participated in a business conference to discuss connecting Finland and Minnesota with new business development. The conference, attended by about 100 state affiliated and private interests, was held as part of “FinnFest 2014”. In May and September, the City met with representatives from Telemark, Norway. In October, the City and Uponor co-hosted a delegation from the City of Tampere, Finland.  Staff sent many comments to the Metropolitan Council regarding the Thrive 2040 regional plan. A 15-point letter sent in April identified growth opportunities, and long- range planning concerns. A 14-point letter sent in September supported the housing policies for anticipated growth needs in housing choice. Transportation policies advocated resources for the Cedar Avenue drop-lane bottle neck, a safe elevated th pedestrian crossing at 147 Street W., and robust road projects that compliment transit solutions.  Several other economic development initiatives this year included participating in the preparation for a visit by Moody’s to retain the City’s AAA bond rating; and meetings with several successful Twin Cities corporations about expansion opportunities. Future economic development initiatives include a partnership with Frontier Communications and District 196 to expand fiber conduit to advance STEM; funding solutions for additional structured parking for transit use along Cedar Avenue; initiating a more aggressive Business Retention, Expansion and Attraction (BREA) program, and continuing “Open to Business”.
