CALL TO ORDER The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz at 7:00 p.m. Members Present: Jodi Kurtz, Paul Scanlan, David Schindler, Phil Mahowald, Jeff Prewitt and Douglas Hlas Member(s) Absent: Becky Sandahl City staff members attending: Community Development Director Tim Benetti, Assistant City Engineer Evan Acosta, City Attorney Sharon Hills, and Department Assistant Breanna Vincent. 2. APPROVAL OF AGENDA Chair Kurtz asked if there were any changes to the agenda. – None. MOTION: Commissioner Schindler moved, seconded by Commissioner Scanlan, approving the agenda. Roll call vote: Ayes - 6 – Nays – 0. 3. CONSENT ITEMS A. Approval of Minutes of April 17, 2024 MOTION: Commissioner Schindler moved, seconded by Commissioner Scanlan, approving the minutes of April 17, 2024. Roll call vote: Ayes - 6 – Nays – 0. 4. PUBLIC HEARING None 5. LAND USE A. Applewood Pointe of Apple Valley Second Addition CD Director Benetti provided a brief presentation. Commissioner Scanlan asked for confirmation that there would be a setback of 5’ between each home for a total of 10’. CD Director Benetti stated that is correct. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes May 1, 2024 Page 2 of 3 Commissioner Scanlan asked if the homeowners would have access to the amenities provided to the residents in the apartment. The applicant, Dave Young (United Properties), stated they would not have access other than to pedestrian trails. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to recommend approval of ordinance amending Chapter 155 Appendix F, Article A39 of the City Cody regulating Planned Development Designation No. 1080. Roll call vote: Ayes – 6 – Nays – 0. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to recommend approval of Applewood Pointe of Apple Valley Second Addition Preliminary Plat subject to conditions outlined in Exhibit A. Roll call vote: Ayes – 6 – Nays – 0. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to recommend approval of a site plan/building permit authorization for Applewood Pointe of Apple Valley Second Addition subject to conditions outlined in Exhibit B. Roll call vote: Ayes – 6 – Nays – 0. 6. OTHER BUSINESS A. Review of Upcoming Schedule and Other Updates The next Planning Commission meeting is scheduled for Wednesday, May 15, 2024, 7:00 p.m. The next City Council meeting is Thursday, May 9, 2024, 7:00 p.m. CD Director Benetti also welcomed the new Planning Commissioner, Douglas Hlas, to his first meeting. 7. ADJOURNMENT Chair Kurtz asked for a motion to adjourn. MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to adjourn the meeting at 7:12 p.m. Roll call vote: Ayes – 6 – Nays – 0.
