URBAN AFFAIRS ADVISORY COMMITTEE
MEETING MINUTES
WEDNESDAY, JULY 13, 2005
1 CALL TO ORDER
The meeting of the Urban Affairs Committee was called to order at 6 30 p.m.
Members Present: Barry Berg, Sandy Breuer, Robin Curran, Shelley Madore*, and Sharon Schwartz.
* Shelley Madore arnved at 6 40 p.m.
Members Absent: Shirley Doering and Pam Solilberg.
Staff Present: Kathy Bodmer, Associate City Planner; Margaret Dykes, Associate Crty Planner; Tim
Miller, Code Enforcement Officer and Val Thoemke, Code Enforcement Secretary
Guests present: Russ Prance, 7200-144th Court and Roger Brandel, 7234-144th Court.
2 APPOINT ACTING CHAIR
MOTION Barry Berg moved, seconded by Sandy Breuer, to appoint Sharon Schwartz as Acting Chair
Motion carned 4-0
3 APPROVAL OF AGENDA
MOTION Barry moved, seconded by Sandy, to approve the agenda. The motion carned 4-0

Sharon noted that the motion on agenda item 3 needed to be corrected to state, "Sharon Schwartz
moved, seconded by Shelley Madore, to approve the agenda."
MOTION Sandy moved, seconded by Robin Curran, to approve the minutes as amended. The motion
carned 4-0
4 DISCUSSION ITEMS
RESIDENTIAL PARKING ISSUES
Barry noted that the State of Minnesota requires one-ton pick up truck to obtain a commercial vehicle
license. He stated that even though the vehicle is used for personal, not commercial use, the State
requires a commercial license
Maggie Dykes made a presentation to the group regarding the two issues the Committee will be
reviewing: (1) the number of vehicles that may be parked outside on a residential driveway and (2) the
parking of commercial vehicles and trailers. Maggie discussed the current code requirements and
displayed pictures of examples of current violations of the parking requirements. She presented three
approaches that staff thinks the Committee could take to address the issues (1) minor edits of the
existing code requirements, (2) more m-depth review of the requirements, or (3) comprehensive review

of all aspects of residential parking, including the parking of recreational vehicles.
Barry asked what the Council's direction was when it assigned these issues to the Urban Affairs
Committee. Shelley Madore said that she was at the City Council meeting when the number of vehicles
parked in a driveway was discussed. This was brought up when a property owner on 144th Court
requested an on-site parking permit to allow the parking of up to 6 vehicles outside on the property Her
view was that the City Council was concerned about protecting existing neighborhoods. Shelley noted
that more homes are becoming rental properties in Apple Valley She state that the City will need to
keep in mind that any changes to outdoor parking will impact what renters will be able to do with rental
properties. Shelley stated that the Committee will need to keep in mind the impacts the surrounding
owner-occupied homes.
Robin Curran commented that she saw three issues (1) how large families and large homes with several
garages are impacted by the number of cars that may be parked outside, (2) how rental properties and
surrounding properties are impacted by the number of cars that may be parked outside, and (3) the
parking of trailers.
Shelley asked for a clarification of the notification procedure for on-site parking permits. Kathy Bodmer
explained that the Code only requires that the applicant submit a notarized affidavit certifying that the
adjacent neighbors were contacted and told that they could contact the City regarding the parking permit
request. Kathy stated that because the property on 144th Court was rental property, City Staff mailed out
notice to the neighbors m the cul-de-sac bubble who appeared to be directly impacted by the sight of the
parked vehicles.
Russ Prince, 7200-144th Court, stated that he lives three doors down from the property on 144th Court
and he was not notified when his neighbor applied for the parking permit. He said he wasn't given a
chance to comment on the request.
Sharon stated that in her view, the Code needs to be revised to better define vehicles, trailers, etc. Barry
suggested that the Committee could recommend a policy that the City Council could adopt. Sandy stated
that she felt the role of the Committee was to review City Ordinances and make recommendations, not
recommend policies to the City Council.
Maggie asked what the Committee thought about receiving citizen input on these issues. She suggested
that an article could be placed on the website inviting residents to provide comments to the Committee.
Sandy suggested that a questionnaire be developed to keep the resident comments focused on the issues
at hand. Sharon also suggested that articles be placed in the Sun Current and ThisWeek newspapers
discussing what the group is doing and inviting them to either go on the website or contact the City for
the questionnaire. Sandy also recommended placing an article in the City's Fall Newsletter
Sandy asked Tim Miller whether the City has a mechanism m place for following up when a complaint
is made to the City Tim explained that no follow-up is typically done unless specifically requested.
Sandy asked how much time was typically taken up having to talk to residents who have made
complaints and they want some type of follow-up? Tim answered that the City does not receive many
complaints of this type, so it's not time-intensive.
Roger Brandel, 7234-144th Court, said that he lived next door to the property where the parking permit
was requested. He said the issue of the number of cars parked outside seemed like a simple matter to
him. He felt that the City Council discussed several different issues that were not relevant to the parking
permit request. Barry explained that the City Council, like the Urban Affairs Committee, has to take into

consideration other factors, when they review permits like the one they considered. Barry stated that
many issues would have to be examined in this process.
Russ Prance said that he and Roger had contacted their insurance agents to find out how many families
have 5 or 6 vehicles insured? Russ said his agent told him very, very few Russ asked why the City
would consider amending the ordinance to deal with a very small percentage of families that have that
many vehicles. Barry pointed out, though, that not long ago he had three kids of driving age hvmg at his
home. At that time he had two collector cars along with the everyday cars he and his wife drove. He said
he had special insurance for the collector cars. Sharon pointed out that not everyone in a family or
household will have the same insurance carrier
Shelley asked staff to contact the fire and police departments and ALF ambulance to find out how they
feel about the number of cars parked in a driveway Robin asked staff to contact the police department to
find out whether accidents have been reported from neighbors backing out and having their sight lines
blocked by parked cars.
Kathy suggested that one way to review the trailer issue would be to visit a trailer dealership to see the
size of typical trailers. At the same time, Barry suggested that Tim could take the group on a tour
through Apple Valley and show everyone some of the related code enforcement issues that exist.
The group tentatively set the next meeting date for Wednesday, July 27, 2005 to do a tour of the City At
the August 24th meeting, the group proposed working on definitions and a timeline. On September 28th,
the group. could analyze responses from the questionnaire. The next proposed dates would be October
26th, to hold a possible hearing on ordinance amendments, and November 30th for awrap-up meeting
and to approve a recommended action to the City Council.
MOTION Barry moved, seconded by Robin, to set the next meeting for Wednesday, July 27, 2005, to

MOTION Sandy moved, seconded by Robin to adjourn the meeting. The meeting adjourned at 8.25
p.m.
