HomeMy WebLinkAbout04/26/2006 Urban Affairs Advisory Minutes 4-26-2008 Page 1 of 3 URBAN AFFAIRS ADVISORY COMMITTEE MEETING MINUTES WEDNESDAY, APRIL 26, 2006 1 CALL TO ORDER The meeting of the Urban Affairs Committee was called to order at 7 00 p.m. by Chair Shirley Doenng. Members Present: Barry Berg, Sandy Breuer, Shirley Doenng, Shelley Madore, Sharon Schwartz, and Pam Sohlberg. Members Absent: Robin Curran. Staff Present: Kathy Bodmer, Associate City Planner; Margaret Dykes, Associate City Planner; Sharon Hills, City Attorney and Tim Miller, Code Enforcement Officer Guests present: Roger Brandel, 7234 - 144th Court, Apple Valley 2 APPROVAL OF AGENDA MOTION Pam Sohlberg moved, seconded by Shelley Madore, to approve the agenda. The motion carned 6-0 3 APPROVAL OF MINUTES OF MARCH 22, 2006 MOTION Sandy Breuer moved, seconded by Barry Berg, to approve the minutes. The motion passed 6- 0 DISCUSSION ITEMS a. Residential Parking Ordinance Amendments (Final Draft) Shirley Doenng opened the meeting by stating that staff had made the amendments that were requested at the last meeting. She asked if there were any questions regarding the final draft ordinance. Shelley stated that she would have liked to have a clean copy of the ordinance without the strikeouts and underlines. Shirley asked if the ordinance contained a provision to allow parking of recreational vehicles within the 13' setback for loading and unloading. Maggie Dykes pointed out that the loading and unloading provision was placed m Section 155.373(C)(4) on pages seven and eight of the draft ordinance. Maggie confirmed that the ordinance now states that Class II recreational vehicles and trailers may extend into the 13' front yard setback for a maximum of 48 hours in a 7 day penod. Pam asked whether Section 71 17 Late Night Parking would allow for more than six vehicles to be parked at a residence Maggie explained that this section of the ordinance only deals with the 3.00 a.m. to 6 00 a.m. portion of the Code. Maggie stated that a different section of the ordinance would pertain to the number of vehicles allowed at a residence. Barry asked whether the ordinance would allow someone driving a motor home to pull off to the side of the road to nap overnight if one was traveling and became sleepy Staff responded that there was no provision for that in the ordinance. Shirley stated that she didn't think that this would be an issue for the City The other members of the Committee concurred. Sharon Schwartz said that she didn't understand the provision on page five Section 155.373(B)(1) Sharon Hills stated that it would require that if a person owned a residential property with a home on it and a vacant lot down the street, all parking would be required to take place on the property where the home is located. Roger Brandel, 7234-144th Court asked what the setback was for passenger vehicles. Shirley answered by saying that the new ordinance would not require a setback for passenger vehicles; a front yard setback is only proposed for the large Class II recreational vehicles and trailers. Roger said that the proposed changes to the ordinance would make the situation worse, not better, by allowing the parking of more vehicles on a residential lot. Roger said that he was concerned about children that might run out from behind a car He stated that he had contacted his insurance agent who has over 800 policies. Roger said that the agent had very few families with more than four vehicles on the policy Kathy Bodmer said that a home with unrelated adults would not have shared insurance policies. Roger asked if the Committee was giving preference to households with unrelated adults. Shirley explained that the Committee had looked at ordinances from other cities and studied options for luniting the number of cars that could be parked on the driveway She stated that the proposed number was a compromise that the Committee had proposed to try to meet the needs of the Community Shirley stated that the Urban Affairs Committee was only making a recommendation and that Mr Brandel should present his concerns at the public hearing before the Planning Commission. .MOTION Sandy Breuer moved, seconded by Sharon Schwartz to recommend approval of the draft residential parking ordinance. The motion passed with 5 votes in the affirmative and one negative (Barry Berg) MOTION Pam moved, seconded by Shelley to adjourn the meeting. The motion passed unanimously MOTION Shelley moved, seconded by Pam to reopen the meeting. The motion passed unanimously Maggie Dykes stated that Barry should give a statement to explain his negative vote. She stated that the Planning Commission and City Council will want to know why he did not support the ordinance amendments. Barry stated that he voted to oppose the proposed amendments because he feels that the problem is more of an enforcement problem than an ordinance problem. He stated that he was not comfortable adding more regulations when the current ones are not being fully enforced. He said that once a regulation is put in place by a government entity, it is rarely taken away He was concerned about the erosion of property owner's rights. He said that until the City enforces the regulations it now has on the books, enacting more regulations will result m less compliance and more ridicule upon the City Barry said that he felt that property owner's rights are being eroded and that government needs to proceed with caution when rt comes to restricting what an owner can do with his property http.//www ci.apple-valley.mn.us/Minutes/urban affairs/2006/04-26-06.htm1 4/28/2009 Urban Affairs Advisory Minutes 4-26-2008 Page 3 of 3 He concluded by saying that he would be more comfortable with the proposed ordinance if the Crty had the ability to issue administrative fines. He said that he did not like the idea of the City issuing misdemeanor citations for violations of the parking ordinance. OTHER BUSINESS a. None ADJOURNMENT MOTION Barry moved, seconded by Sharon, to adjourn the meeting.
