McKay at 7:00 p.m. Members Present: Chairman John W. McKay, Members Van. Holston, Shelley J. Madore, and Sharon R. Schwartz. Not Present: Robin Curran, Shirley Doering, and Pamela Sohlberg Staff Present: Annette Margarit and Kathy Bodmer 2. APPROVAL OF JUNE 12, 1996 AGENDA. 3. ADULT USES ORDINANCE a. Review and Discuss Draft Report and Draft Ordinance The Urban Affairs Committee reviewed and discussed the Draft Report and Draft Adult Uses Ordinance prepared by the City Attorney's Office. Each of the members was assigned one or two of the adult uses study and asked whether they agreed with the summary of their study in the Draft Report. John noted that in the Seattle study, the report focused more on the impact of adult uses on property values rather than on moral issues. The group noted that morality is more subjective, while property values can. be calculated and quantified. John mentioned that the Oklahoma City study also involved a survey of Realtors and their perceptions of impacts to property values. Shelley reviewed the St. Paul study and asked that the proposed summary in the draft report be modified to include the perception that a concentration of adult uses resulted in a "combat zone." Van and Sharon stated that they agreed with the summaries of their reports in the Draft Report. The group discussed the length of a block, and the fact that the studies found that impacts to property values were greatest within one block of the adult use, but lessened once they were 3 or more blocks away. Because a block is approximately 500', three blocks would equal 1,500 feet. Next the group reviewed the Draft Zoning Ordinance and Licensing Ordinance. The group discussed whether adult uses should be conditional uses in the zoning ordinance. Annette Margarit cautioned that the requirements of a conditional use permit should not duplicate the requirements of the licensing ordinance nor include items that could be covered by the licensing ordinance. The Committee then went back to the Draft Report and made a motion that the report be concluded as follows: It is the recommendation of the Urban Affairs Committee to adopt the maximum buffer zones consistent with the health, welfare and safety of the City of Apple Valley. This buffer zone in the Committee's opinion should be 1,000' from residential areas, 1,000' from sensitive uses (such as schools, daycares, churches, parks, libraries and on-sale liquor establishments) and 1,000' from other adult uses. The Committee also strongly recommends that. adult uses be regulated through a licensing ordinance and conditional use permit process. 4. FUTURE MEETING DATE The next meeting will be held on Thursdav, July 11, 1996, (please note change to Thursday) at 7:00 p.m: in the Large Conference room in City Hall. Please mark your calendars for an informal meeting/discussion with the Planning Commission to discuss the Committee's report on Wednesday, July 31, 1996. 5. ADJOURNMENT The meeting ofthe Urban Affairs Committee adjourned at 8:50 p.m.
