CITY OF APPLE VALLEY

1. CALL TO ORDER

The May 26, 1992 meeting of the Apple Valley Urban Affairs Advisory Committee was called
to order at 7:05 p.m. by Chairman John McKay.
Members Present: Chairman John McKay, Member Robin Curran, and
Councilman Robert Erickson.
Members Absentb JoAnne Ellison, Pam Sohlberg, Shirley Doering, Van Holston, and
Sharon Schwartz.
Staff Present: Jeff Weldon, Scott Hickok, Sharon Hills (Assistant City Attorney),
Terry Cook. and Bruce Erickson.
Others Present: See attached sign-in sheet.
2. APPROVAL OF THE AGENDA
The agenda was approved. as written.
3. APPROVAL OF THE MINUTES OF APRIL 21, 1992
The minutes of April 21, 1992 were approved as written.
4. DISCUSSION ITEMS
A. Housing Preservation Program

Scott Hickok opened the presentation of the Housing Preservation Ordinance with Andy
Rooney's video clip of "60 Minutes" on the topic of "Home Maintenance." Hickok discussed a brief
history of the Housing Preservation Ordinance process and the ordinance itself. Hickok also
explained the minor modifications that had been made in accordance with the Urban Affairs
Advisory Committee's suggestions at the April 21, 1992 meeting. After a very brief, general
discussion, Chairman McKay asked that the other Urban Affairs Advisory Committee members, who
were unable to attend the discussion, be notified, sent a copy of the minutes, and a copy of the
ordinance. Each of the members, not in attendance, were asked to respond, in writing, regarding
the Housing Preservation Ordinance. Those written responses. will then be sent to the City Council
as the Urban Affairs Advisory Committee's recommendations.

B. Refuse Vehicle Operation
-Jeff Weldon/Scott Hickok-
Jeff Weldon used an overhead to illustrate points that were made in the letter by Mr. Hettling,
a resident of the community who is concerned about the refuse hauler operations within their
residential community.
Weldon also explained six possible alternatives to the present hauling and operating procedures.
These options included:
1. A change in the ordinance by the City Council to provide for "curb-side" as opposed to
"garage-side" placement of containers.
2. An amendment to the ordinance to prohibit such vehicles from backing into driveways
of residences.
3. The Council could institute collection by districts or zones.
4. Award only one license to a hauler for the entire City.
5. Eliminate private collection and institute municipal collection.
6. Do nothing.
Patti Klefsaas, 12600 Dover Drive, stated that there is a difference between allowing a hauler
to back up in the road versus backing up into individual driveways.
Bill Hettling, 12552 Driftwood Lane, stated that he was. representing families within his
community and stated that there had been an accident in their neighborhood, which involved a
garbage vehicle and a student. Mr. Hettling continued by stating that there are 900 children in his
area and that School District 196 has the largest percentage of latchkey children in Dakota County;
Apple Valley has the largest percentage of the latchkey children. He also stated that today a refuse
vehicle backed up in the same area as the earlier Cocoran accident. Hettling concluded by stating
that the roads were not built for all of the truck activity and the 242 children in his subdivision,
combined with the number of vehicles on the roadways, is a scary formula in which. he wants the
City Council to act.
Dan McGinley, 12520 Dorchester Trail, commented that Option 6 had been chosen when they
discussed this matter with the Urban Affairs Advisory Committee earlier.
Debbie Clemmer of Lakeville Sanitation stated that the haulers have wanted "curb-side"
collection in Apple Valley for years and that they would prefer that so that they did not have to
back up to collect refuse.
Larry Knutson of Knutson Services stated that their concerns, as a business, are consistent with
our concerns as a community, that safety is important to them and that they have training programs
for their drivers to keep safety in the forefront. Their videos are also available for others to watch.
Mr. Knutson. felt that a change in the ordinance would be the best alternative and stated that

statistically, more refuse haulers are injured annually than the combination of both police and fire
personnel.
Mike Trulson of Quality Waste Management agreed with both Debbie Clemmer and Larry
Knutson. He stated that Quality Waste Management. also prides themselves on safety and feels that
the ordinance of "garage-side" pickup presents them with safety concerns. He feels that they have
done an effective job in keeping their drivers from backing up unless absolutely necessary. He
continued by stating that two drivers recently were injured by slipping on driveways as they ran
up to collect the refuse at the garage site. Trulson concluded by stating that their company cares
about the safety of both the drivers and the individuals in our community.
Joyce McGinley, 12520 Dorchester Trail, stated that she was in favor of either Option 4 - (The
award of only one license for the entire City.) or Option 5 - (To eliminate private collection and
institute municipal collection.)
Eileen Murphy, 12590 Dorchester Trail, stated backing up should not be an option - #1 change
"curb-side". Murphy also commented on control over UPS and no backing up.
Patti Klefsaas stated that either "curb-side" or eliminate the number of trucks would be the
options she would be in favor of. Klefsaas stated that current activities are not acceptable in an
area with so many children. Klefsaas concluded that we should look at more than "curb-side'; we
should look at eliminating the number of truck and haulers.
Bob Erickson, City Council, has observed haulers backing up in every driveway on their routes.
Scott Hickok commented on the license stipulation which would prohibit refuse haulers from
backing into individual driveways. He stated that this may be the best option from an expediency
standpoint.
Knutson advocated a "blue-ribbon" discussion committee to come up with the result.
Bill Healing added a comment to Knutson about safety and efficiency.
Debbie Clemmer feels no backing up is workable.
Bob Erickson stated he dropped his hauler who backed up after being asked not to.
Jeff Weldon stated haulers do not need to back into driveway to do the job. City of Apple
Valley allows competition to allow people to pick their hauler.
John McKay commented that other than. Options 2 and 6, they require a great deal of time.
Patti Klefsaas stated price is not all that different - a few cents difference doesn't matter.
MOTION: A motion was made by Robin Curan that the City Council amend the license with
stipulation for backing prohibtation as worded in Option 2.
A general discussion ensued.
