HomeMy WebLinkAbout09/06/1979 • • CITY OF APPLE VALLEY URBAN AFFAIRS COMMITTEE MINUTES September 6, 1979 PRESENT: Dorothy Regis, Hank Meyers, Dick Edwards, Gloria Detters, John McKay. ABSENT: Bill Smith. Chairman Regis called the meeting to order. The minutes of the August 16, 1979 meeting were approved as written. The Co�ittee spent the remainder of the meeting discussing the Proposed Park Ordinance which was referred to them for review by the City Council. Mike Bassett, Park & Recreation Director gave introductory comments. Chairperson Regis asked Mike Bassett to hi-lite the sections of the greatest concern in the ordinance. Mike Bassett referred to page 7, Section 15 (2) . The 10:00 p.m. closing hours is a concern -- the problem is the man jogging or walking the dog through the park after 10:00 p.m. He pointed out that Burnsville does have a 10:00 p.m. curfew in their parks and if Apple Valley's were to be different it could be a problem at Alimagnet Park. Another major area where there have been problems is the golf course. Mike noted that he doesn't see the police stopping someone walking through the park or jogging through the park. He stated that there was also a concern about the control of animals in the parks; there was concern about animals being under voice command. Mike Bassett also noted that there was concern about there being to much in the ordinance that is not needed. He did note that some of the contents of the ordinance may not be needed today, however, it may be needed in the future as Apple Valley grows. Regis questioned ��1, �65 and 4�6 being covered in the disorderly conduct language. Dick Edwards stated that those items would be covered in the Nuisance Ordinance and asked if they were consistent. Mike Bassett stated that some things included in this draft ordinance are redundent, however, he noted that he would like to post the ordinance in the parks and felt they need to be included. Dick Edwards questioned ��3 (3) . Mike Bassett stated that it would restrict kegs, barrels, etc. This would not preclude the family picnic; large quantities would be allowed with a permit. Dorothy Regis felt that '4�'3 (9) should be clarified. Mike Bassett asked how you distinguish between a full fledged camping operation. Dorothy Regis stated that she is concerned about the police making the discretion; she feels that restrictions need to be spelled out for the police. Dick Edwards noted that gambling is illegal in the State other than bingo, etc. -- does it need to be included in the ordinance. .Tohn McKay quesitoned Sect. 3 (4� , "controlled substance". He referred to the definition and questioned a prescription from the doctor. The members of the Committee didn't see a problem. Mr. McKay also questioned Sect. 3 (8) and asked if it meant that children couldn't play with small boats in the water. Mike Bassett stated that the intent is things that would be polluting to the water. He st�.ted that it could state "noxious substance." Mike Bassett stated that the Park Committee changed the wording in (11) regarding animals. He stated that an individual at the Council meeting stated that he felt it should be "voice control" -- it was noted that if this is changed it would be contrary to the present ordinace that stated "on a leash". Dorothy Regis questioned Section 4 (8) and (2). It was noted that a definition is needed for "watercraft." Gloria Detters questioned ��6 (1) . Bill Holton questioned ��3 (1). Mike'..�Bassett stated that you could allow people to take out dead wood; however, it does need to be supervised. Section 16 (5) is a clause to protect the parks. Dick Edwards questioned ��6 (3) . Bassett stated that the intent is to keep swimming in the swimming areas and picnicing in the picnic areas. Hank Meyers questioned Section 9 - Horseback Riding -- the committee discussed horseback riding. Dorothy Regis questioned Section 15 (5) and whether it is enforceable. Mike Bassett stated that the Courts decide, however, it can be included. Dick Edwards questioned Section 15 (1) - what are the guidelines for issuing the permit. Bassett explained the present policies for the community buildings. The policies may have to be drafted. Edwards questioned the possibility of a rock concert at Alimagnet Park. Bassett stated that a permit does not have to be granted if it is in the best interests of the City. Dorothy Regis questioned the designated representative; Mike stated that his secretary issues the permits for Westview, however, if there is a problem she asks him for a decision. DorothyyRegis questioned Section 16 (8) and asked if that included police officers from other municipalities. Hank Meyers suggested including City, County and State in Section 16 (8) . Gloria Detters questioned Section 15 (2) . She is concerned about selective enforcement. Mike Bassetts stated that it needs to be selective because of what the party is doing. She questioned if we do have other ordinances that would cover the 10:00 p.m. There was some discussion on the curfew. Dorothy Regis stated that she feels it is very typical to have closing hours in the parks. Tf it is a party and they are disturbing the peace there are other ordinances that they can be charged with. She is concerned about selective enforcement for the joggers and dog walkers. Holton stated that he is concerned about over-zealous enforcement of all the ordinances. Gloria Detters stated that she would prefer to see Section 3 (9) removed from the ordinance. Mr. Gretz stated that from City experience it should be included because people come and ask for a copy of the park ordinance and it should be stated in the ordinance. Mike Bassett stated that they are willing to experiment; Alimagnet Park is posted as 10:00 p.m. closing, there is the problem with the jogger or cross country skier. Mike Bassett stated that the ordinance could give the Park Director the authority to post the curfew. Page ��3 � Urban Affairs Committee utes 9/6/79 There was some discussion on watercraft and a limit on the horsepower on the lakes. ', Dick Edwards stated that he feels that the speed limit on the small lakes needs to be controlled. Mike Bassett stated that at the present time no motorized boat launching areas are located in the City. Dorothy Regis noted that is you start to regulate then the City is responsible to enforce the ordinance. Dick Edwards stated that he doesn't feel that the horsepower is a problem; it is necessary to keep the motorized craft away from the swimming area. Bill Holton stated that he feels the ordinance tries to encompass to many things into one ordinance and he would like to see the Committee come back to the Council with those things that are really needed.
