HomeMy WebLinkAbout10/05/1978 . - • � CITY OF APPLE VALLEY URBAN AFFAIRS COMMITTEE h1INUTES OCTOBER 5, 1978 PRESENT: Chairman George Hecker, C1int Dixon, Hank Myers, Bill Smith, Joan Goering, Dorothy Regis and Dick Edwards; Rick Kelley. ABSENT: None. Chairman Hecker called the meeting to order. Minutes of the September 21 , 1978 meeting were approved as written. The remainder of the meeting was spent reviewed the proposed draft of the Ordinance Licensing and Regulating Food Vending Machines and Coin-operated Amusement Devices and Providing a Penalty for Violation. Some revisions to wording were made in Sections one and two. The License Fees were discussed. Because the food vending machines need to be inspected the annual fee was set higher than for soft drink vending machines. Rick Kelley noted that the City has the authority to restrict the number of licenses available for pi:nball_ _machines with the City. Hecker questioned if the machines should be limited to particular area. They could be regulated by zoning districts. Bill Smith questioned the zoning district for 7-11 Stores; Mr. Kelley stated that the 7-11 Store areas are zoned B-2 which allows for a convenience center or grocery store. Dorothy questianed the churches having the game devices; this could be a problem if the machines were restricted to distriets. Bill Smith stated that he felt they are restricting the machines by the license fees. Regis questioned who determines if the license should be issued. Kelley stated that the City will det- ' ermine that and also stated that you don't have to license everyone who applies. Joan Goering asked if a store owner outside a residential area comes to the City and applies, who is going to make that decision to decide if he is eligible for the license. Mr. Kelley stated that with this type of license it can be turned down for the "general protection of morals." The licenses wi11 have to be approved by the City Council . There was considerable discussion regarding restricting by zoning district. Dorothy Regis slated that she feels they should be restricted to the B-3 and B-4 districts. The Committee agreed to recommend to the Council that the coin operated mechanical amusement devices shou.ld be restricted to the B-3 and B-4 zoning districts. This will keep t�rem out of t�he residential areas. - . ..t:, Joan Goering questioned the second sentence in Section 4 -- she doesn't feel they should take for granted that the license will be reissued each year. MOTION: of Smith, seconded by Goering to forward the draft of the Ordinance Licensing and Regulating Food Vending Machines and Coln-operated Amusement Devices and Providing a Penalty for Violation to the City Council for approval . YES - 7 - NQ - 0. Attached is a corrected copy of the proposed ordinance. Meeting adjourned.
