URBAN AFFAIRS COMMITTEE MINUTES
MAY 4, 1978
PRESENT: George Hecker, Dick Edwards, Hank Myers, Dorothy Regis, Clint Dixon, Joan
Goering, Bill Smith, Rick Kelly.
ABSENT: None.
Chairman Hecker called the meeting to order.
Minutes of the April 27, 1978 meeting were approved as written.
The Committee continued their discussion in the area of Group Homes.
Mr. Kelly stated that he has reviewed the information that the Committee has discussed
and pointed out the exemptions to the State requirements. The two exclusions of
of concern are as follows:
1977 Amend�aents to Chapter 245
245.791 - (7) A day care or residential facility serving fewer than five physically
or mentally handicapped adults;
(8) A day care or residential program serving any number of nonhandicapped
adults.
Mr. Kelly noted that the number is considered a single family use and the City cannot
regulate the use. Under item 7 they are exempt from licensing by the Dept. of Welfare.
He recommended that the City address #8 to see how they can regulate.
Regis stated that a northern suburb ordinance required that they be 1/2 mile apart and
they were overruled because State Law say 1/4 mile. She questioned the five or fewer
includes the people taking care of the handicapped adults. Kelly stated that he
interprets as being the six handicapped adults, plus two persons taking care of them.
Licensing by the City was discussed, however, the administrative costs and personnel
are not available.
If they are not licensed by the State Dept. of Welfare they would not receive funds to
operate the program. Edwards stated that he finds it difficult to believe that the
state is not regulating and licensing persons to care for handicapped adults.
Since the area of handicapped adults is a small area of the Group Homes the Cotnrnittee
decided to address the areas that they can control with an ordinance. The Group
Home that accommodates seven to twenty persons is considered a Multi-Family Use. The
local zoning ordinance was discussed and it will have to be amended to include the
Group Home area in the Ordinance. "Community Based Care Facilities" were discussed and '�,
how the Ordinance should be approached for that area of Group Homes. The Minneapolis I
Ordinance was reviewed and square feet requirer�ents per person were discussed. '
The Eden P�airie Ordinance does not address the "Community Based Care Facilities" that
provide care for the number from 7 to 20. Chairman Hecker asked Mr. Kelly to prepare
a suggested or model ordinance that the Committee can discuss and review for the
next meeting.
