HomeMy WebLinkAbout11/03/1977 , � � i � CITY OF APPLE VALLEY URBAN AFFAIRS COMMITTEE MI��UTES NOVEMBER 3, 1977 PRESENT: Chairman George Hecker, Hank Myers, Jim Ronay, Dorothy Regis, Dick Edwards. ABSENT: Bill Smith & Joan Goering. Chairman Hecker called the meeting to order, John Gretz, Public Works Director for the City of Apple Valley, was in attendance to answer questions, make a few comments and suggest�ons in reference to the Weed Ordinance and the f]ag referral from the City Council . Gretz reviewed the background with the flag situation. When Perkins Restaurant came in with a request for a building permit the Council stated that when it was approved the flag was not approved. The present ordinance does not refer to flags. When the flag pole went up at Perkins, two Councilmembers were upset. There is concern about it being a traffic hazard at the intersection. The Country Kitchen has also called and requested a large flag similar to the one that Perkins has at their restaurants. Mr. Gretz stated that he is not arvare of any municipalities that prohibit the large American F3a�g or have any restrictions on the American Flag. It was questioned if it is legal to restrict the size and location of being able to place an American flag. Mr. Gretz suggested that the Committee draft a recor�mended stater�en't o� po'ticy; once it is adopted by the City Council the staff can draw up an ordinance that reflects the po7icy. That way the Committee does not have to get into the the legal language. Regis asked if the nuisance ordinance would require that a flag be removed if it were a traffic hazard. Gretz stated that the flag could be removed if it caused problems that would effect the health, safety, and welfare of the residents. Ronay suggested a minimum ratio of height of the flag pole in relation to the �ize of the flag, The reasons for objections seemed to be because of aesthetic reasons. Committee members saw no reason for anyone to object to the flying of the American Flag. Mr. Gretz stated that every corrnnunity has a problem with a "Weed Ordinance." There are natural areas that are not meant to be manicured; it is a disgressionary thing. The Committee members asked about increasing the height limit; could state that when they start to pollinate or go to seed; there is a need for a provision for the natura] areas. It was suggested that they could exempt the City Parks; unplatted areas; heavily wooded areas. Mr. Gretz suggested that they amend tMe Nuisance Ordinance rather than have a "Weed Ordinance." There was considerable discussion regarding the Game Machine Memo to the Council . The Members of the Corrnnittee made corrections and deletions and approved the memo to be forwarded to the City Council . (See Attached.) Meeting was adjourned.
