HomeMy WebLinkAbout04/07/1977 _ r t • � CITY OF APPLE VALLEY URBAN AFFAIRS COMMITTEE April 7, 1977 PRESENT: Jim Ronay, Dorothy Regis & Joan Goering The Committee discussed the ordinances regarding the massage parlors. They feel that it is better to write the ordinance and have it in effect prior to the request for a license rather than have a request and then try to write an ordinance. There was some discussion on "why" the ordinance. It was decided that the purpose was to "eliminate overt sexual activity and maintain a level of sanitation and health." After reviewing the ordinances received from other municipalities there was con- siderable discussion as to what they would include. Do they want to state that certain portions of the body be covered with a nontransparent material; include males with males, females with fema.les; etc. There was some discussion regarding including steam baths, heat bathing rooms -- it was decided that as long as it is stated that the services offered to the public for a fee it would eliminate any steam baths, etc. in schools, private homes, etc. There was also some discussion as to whether an investigation fee should be charged. Following is the ordinance which the committee begsn organizing: ORDINANCE N0. AN ORDINANCE RELATING TO THE LICENSING OF MASSAGE PARLORS, SAUNAS, STEAM BATHS OR HEAT BATHING ROOMS. The City Council of the City of Apple Valley, Dakota County, Minnesota ordains as follows: SECTION 1. Definitions: When used in this ordinance the following terms shall have the following meaning: A. Ma.ssage: means the rubbing, stro king, kneading, tapping, or rolling of the body with the hands, for the exclusive purpose of physical fitness, relaxation, or beautification, and for no other purposes. The practice of massage is distinct from the practice of inedicine, surgery, osteopathy, chiropractic, physical therapy, or podiatry and persons duly licensed or registered in this state to practice medicine, surgery, osteopathy, chiropractic, physical therapy, or podiatry, nurses who work solely under the directions of any such persons, athletic directors and trainers are expressly excluded from the provisions of this ordinance. Beauty culturists and barbers who do not give, or hold themselves out to give, massage treatments, as defined herein, other than is customarily given in such shops or places of business, for the purposes of beautification only, are also excluded from the provisions of this ordinance. B. Massage Technician: means any person who gives or adm3.nisters a massage. 6. Patron: means any person who receives a massage under such circumstances that it is reasonably expected that he or she will pay money or give any consideration therefor. 1�/� }. Page ��'2 � o Urban Affairs Committee � 4/7/77 D. Massage Establishment: means a place of business providing massage services either to the public or as a private club. E. Operator: means any person, association, firm, partnership, or corporation licensed by the City to operate a massage establishment. F. Sanitary: means free from pathogenic-microorganisms. G. Health Officer: means the Health Officer of the City of Apple Valley or his agents. There was considerable discussion on the education required for a ma.sseur or masseuse; the schools, membership in the American Massage & Therapy Association, etc. Jim Ronay is going to do some phoning to determine what types of education the ma.sseir or ma.sseuse at the Minneapolis Y has and see what type of information he can gather before the next meeting. The Committee will continue their work on the ordinance at their next meeting on April 21, 1977, at 7:30 p.m.
