The Urban Affairs Co�ittee spent the evening discussing the "Transient Merchant
License."
Dorothy Regis had reviewed the information from the League of Municipalities with
regard to the Transient Merchant Ordinance. There was considerable discussion on
the exclusion of peddlers of farm products. "The Minnesota Constitution states
affirmatively that anyone can peddle or sell products of a farm which he occupies
and cultivates without securing a license for the purpose."
The Committee agreed to change Section 8 of Ordinance 100 to read as follows:
Section 8 - Exemptions
The proYisions of this section do not include the acts of persons engaged in the
following activities:
1. Selling personal property at wholesale to dealers in such articles;
2. Acting as newsboys;
3. Selling products of the farm or garden occupied and cultivated by
the person selling such products;
4. (Use the present Section 8A & B.)
5. Calling upon householders in connection with a regular route service
for the sale and delivery of perishable daily necessities of life
such as bakery products, dairy products or ice. This exception does
not relieve such person of the duty of compliance with any other
applicable provision of this code.
The Committee agreed to add the following which becomes Section 9.
Section 9 - Use of Streets. No permittee shall have any exclusive right to any
location in the public streets, nor shall any be permitted a stationary
location thereon, nor shall any be permitted to operate in a congested area
wtiere such operation might impede or inconvenience the public use of such
streets. For the purpose of this ordinance, the judgment of �. police officer,
exercised in good faith shall be deemed conclusive as to whether the area
is congested and public impeded or inconvenienced.
Committee agreed to change the definition of Peddler in Ordinance 100 by deleting
"edible or nonedible" and adding "or merchandise".
There was some discussion on changing the definition of the word "solicitor" however,
committee agreed to leave as is in Ordinance 100.
The Committee agreed to delete the last sentence in Section 2 of Ordinance 100,
however, would leave the reference to Chapter 329 of the Minnesota Statutes Annotated.
They felt it was redundant in Section 2.

Committee agreed to elimination of No. 7 of Section 3 from Ordinance 100. This
is not being done.
In Section 5 A & B it was agreed to change the "shall" to "May" and add the following
to Section 5A -- The seven day waiting period can be waived at the discretion of
the City Clerk.
The Committee agreed to recommend that the fee be changed from $5.00 to $10.00.
In Section 8B the committee agreed to eliminate the following -- "the clerk shall
submit the matter to the Village Council, Upon approval by the Council" -- this
change will allow the City Clerk to issue the license.
There was considerable discussion on Section 9 (changed to 10) of Ordinance 100
dealing with Revocation. The committee will continue their discussion on this
section as well as Mr. Asleson's recommendation for change in the ordinance at their
next meeting on February 17, 1977 at 7:30 p.m.
