September 6, 1984
Minutes of the meeting of the` Urban Affairs Committee of the City of App1e Valley,
Minnesota, held September 6th, 1984, at 7:30 p.m. at the City Hall.
PRESENT: Members Richard Carlson, Stan Fedoruk and Fred Metry; Staff Member
Rick Kelley; and three Members of the Public.
ABSENT: Members Shirley Doering, John McKay, Sharon Schwartz and Pamela Sohlberg.
The meeting was called to order at 7:40 p.m. and it was noted that no formal action
could be taken tonight because the Committee did not have a quorum.
The Committee received and reviewed a memo from Rick Kelley summarizing kennel regu-
lations in the surrounding communities of Burnsville, Eagan, Lakeville and Rosemount.
The Committee received a copy of a letter from Lois Haag, a neighbor of Mr.
Wurdeman's, objecting to the' number of dogs he has on his property. Mr. Kelley
said the Police Department had received a telephone call from another neighhor ob-
jecting to the number of dogs and he received another letter from a different
neighbor, who did not wish hi,s name used, also objecting to the dogs.
Mr. Fedoruk said, after his review of the current City Code, he does not believe
any changes are needed except to specify age of the dogs; three adult dogs shcauld
be the maximum allowed on a normal residential lot.
Lois Haag was present and described the problem of too many dogs inlcuding barking
during the night. Two other neighbors of Mr. Wurdeman were present and said they
do not believe the City Code should be changed. Their main complaint is noise
from the dogs. Mr. Carlson asked what they tao`Id.recommend as a limit for the num-
ber of dogs? They agreed with three adult dogs. They also expressed concern about
a kennel with a larger number of dogs turning into a business in a residential area.
Mr. Metry said in prior situations, the Committee has eonsidered a�sd recommended
ordinance changes which appear to be to the general benefit of the public and he
does not believe this is the case with this request.
Ms. Haag questioned a previous reference made to requiring a petition by neighbors
for kennel licenses. Mr. Kelley said that was one of the provisions in the model
kennel ordinance supplied` by the Dog Breeders' Association. She said asking neigh-
bors to sign such a petition would be unfair and would put them in a diffi;cult
position if they did not agree with it.
Mr. Fedoruk suggested the Committee members present agree on a recommendation and
send it to the other members. If there is no comment, the recommendation could
then be forwarded to the City Council. M�. Garlson and Mr. Metry concurred. The
recommendation agreed upon is: No change to the kennel licensing provisions of
the City Code except adding that the restriction is for three dogs over four months
of age.
Mr. Kelley will look into the status of the Committee's recommendation on changes
to the City's garbage ordinance and report back.
