Meeting was called to order by Chairman Myers at 7: 30 p.m.
2. Approval of January 15, 1981 T�iinutes.
MOTI�N: by Schwartz, seconded b3� Deters for approval of minutes
as mailed.

3. Discussion of Ordinance to Control Advertisin� I,iterature.
Letter received 12/?_2/80 and forwarded to Committee from
l�?rs. Jackie �ailkinson, 7283 Upper 139th Street W. (See Attached) .
A�s. Schwartz asked if there hadn 't been another letter received
compZaining about the literature. Mr. Kelley replied counting
this one two letters had been received and a Council Member had
been called.
Mr. �cKay asked P�ir. Kelley to explain the rules on all the boxes
that were put up over a fair portion of Apple Valley. Mr. Kelley
replied that the green or black boxes were put up for delivery
of non-mail items by an independent service who deliver the
literature. He said they were on separate stands from the mail
box and people had the option of whether or not they wanted them.
Mr. P�icKay said he thought the resolution of Mrs. Wilkinson' s
problem �as to use one of the baxes.
I'=:r. Metry stated people have the right to advertise and distribute,
but the mechanic s of the di stri hutio n v�as the pro blem.
l�ir. Kelley stated the only time a city passed an ordinance was
when there was a real common problem.
NIr. Myers stated g�.r��e sale signs were another problem. Mr. McKay
asked if there �y��as a way of standardizing them.
PZs. Schwartz questioned if Nirs. Wilkinson had tried calling and
complaining to the advertising agency deliver��g the material,
stating tha-t she had called the Countryside at one time. Mr. Kelle,y
stated that he didn't know. Ivls. Schwartz went on to say that both
the Countryside and This `aJeek are now delivered in plastic bags
and hung on the doornob in her area.

Mr. Metry stated there didn't seem to be much of a precedent
for an ordinance and it would have to be enforced. Mr. Kelley
said it would be awfully hard to enforce as the police would
have to go out and find out who was deliver�ng the material.
Ms. Det�'?�sstated she thought it would be nice if they would put
it in the newspaper box.
Mr. Metz�y stated he f�'��, she should be called saying that there
doesn't seem to be a widespread problem, and that perhaps if
she cooperated with the people leaving this material it would
solve the problem.
n�s. �eters said she could see a problem in that both the Country-
side and This ��1eek was delivered thi s way. Mr. Me�try added that
some magazines are also delivered to the door now, and he thought
there would be more things handled this way.
Ms. Deters questioned if there was anyway to get the green and
black boxes citywide for the people who want them. T�Ir. Metr,y
stated he thought the only eff ective way would be to adopt an
ordinance that would require the separate containers. Mr. Kelley
said he could check to see how many cities actually try to reg-
u3ate this to any extent.
t�ir. Metry su�gested the carriers be contacted who could offer
to supply the containers, adding that they have a service to pro-
vide and they should be aware of the problem. He said if they
would contact ��Trs. Wilkinson it would establish some rapport with
city govez�nment.
Other Items:
I��s. Schwartz mentioned the hote� fire in Las Vegas, and the fact
that she had been hearing quite a bit about discussion of re-
guir�,�.� �prinkler systems in l�Zinneapolis. She said this made
her wonder if Apple Valle,y had any type of ordinance for sprinklers
particularly in re�ard ta the nursing home that is to be built and
a proposed mot�� , She said her thinking was that sometraing should
be done before the buildings were built. Mr. Kelley replied that
all cities in the seven county metro area have to follow the
Minnesota State Building Code, and it has to be adopted by them.
He said the fire code was a part of that, and some was by refer-
ence back and forth. He stated some areas of it could�a't be
altered. He stated he didn 't thi.nk Apple Valley could require
it if tYze building code doesn 't require it. 1`�r. Kelley went on
to say that requirement �f sprinklers depended upon the type of
build.ing, and �hat methods are taken to make it fireproof.
T��'�r. McKay stated that he had learned a great deal ahout fire
sprinkling systems through his place of busine�s, and he explained
the �roblems of installation in an already esta�lished building,
installation in a new building, stating they were very expensive
and that it has now been found that sprinklers are needed to go
up as well as down because of false ceilings where the fire can
burn and drop down below. He also explained pro�lems with having
to have heat temperature activators, problems with �eakage, the

problem of them going off �� mistake, the fact that the building
has to be heated, as well as the maintenance and upkeep expense.
M�. Sch�aartz asked what type of fire inspection went on in
Apple Valley. NIr. Kelley rex�orted that there were fire inspec-
�tions conducted by a part-time fire marshall who was looking
for combustib�;e material. He stated that he was a fireman who
had to go through special training; that he didn't know how
often each building was inspected, or how many hours each week
he works at this however he has said there is too much to do on
a part-time position.
Mr. Metry stated if discu ssion �as about development of condomin-
iums then he felt it might be appropriate to �ook at the codes
on initial construction.
Ms. Schwartz stated her thinkin� was that if there was somethin�
that eould be done it sho�.��wd ..be looked at, and she was interested
in knowing what Apple Val�.ey can do and how the City is governed.
rtiIs. Schwart� reported on information obtained at the Hazardous
Waste Meetings she had a���nded, and stated there would be a
meeting February 9th regar�ing selection of candidate sites if
anyone �°r�� .��fs� C��mmittee wanted to attend.
