URBAN AFFAIRS COMMITTEE
MEETING MINUTES
August 21, 1980
PRESENT: Chairman Hank Myers, Committee members Gloria Deters, Sharon Schwartz,
Carol I�ein, Fred Metry and John McKay and staff inembers Rick Kelley
and Richard Asleson.
ABSENT: Shirley Doering.
The meeting was called to order by Chairman Hank Myers at 7 :35 p.m.
Motion to accept the minutes of the August 6, 1980 meeting was made by John
McKay, seconded by Fred Metry. Minutes were approved.
FIREARMS ORDINANCE:
Mr. Asleson, City Administrator, addressed concerns which had been expressed at
the August 6 meeting and explained changes which had been made in the July 17
draft of the ordinance. He said that they had attempted to address the concern
over ages stated in the ordinance and the intent was not to conflict with state
law but in some instances it may be more restrictive than state law.
Sections which were specifically addressed were as follows:
4.1 The word "boat" was added.
4.2 - The word "boat'' was added.
5.1 - Stated ages was the concern but it was explained that ordinance
thru language is a restatement of language in Minnesota Statutes.

3.6 - Could be applied in cases where "predators" were a problem in
the more rural areas of the City.
3.3 - The question of specifications for a firearms range is covered
by this section. Any firearms range within the City would require
a permit from the City Council and specifications for the range
would be established before the permit was granted.
Walt Haussner stated that he believed Section 3.3 will cause objections from
the public because it does not deal with discharging guns in the basement of
a residence. He also questioned whether or not that Section of the ordinance
would be enforceable in this regard. The problem was discussed by the
Committee and Mr. Haussner.

MOTION: of McKay, seconded by Deters, to accept the ordinance and forward
it to the City Council for its August 28 meeting with the addition
of the following changes:
3.6 - Addition of a phrase permitting discharge of firearms within
the confines of the basement of a private residence.
3.7 - Addition of a statement permitting use of commonly used con-
struction equipment for construction purposes.
7.2 - Addition of a "Savings Clause" which states that should
- one section of the ordinance be declared invalid by a
court, the remainder of the ordinance would remain in effect.
(Staff note - Upon reexamination, this would better fit
under Section 8.)
Vote to approve the ordinance was unanimous.
The committee and Mr. Haussner requested copies of the revised ordinance be
mailed to them prior to the Council meeting August 28.
Metry reported that he had appear�d before the City Council on July l4 concerning
the garbage pick-up question and stated ot the Council that he would be able to
support the survey which the City will be mailing with the water bi11s.
MOTION: by McKay, seconded by Metry, to adjourn. Motion approved.
