HomeMy WebLinkAbout02/07/1980 � � II CITY OF APPLE VALLEY URBAN AFFAIRS COMMITTEE MINUTES FEBRUARY 7, 1980 PRESENT: Deters, Hein, McKay and Schwartz, Staff inembers Dick Asleson and Rick Kelley. Also Apple Valley residents: Durdas and Haussner ABSENT: Edwards, Myers and Regis As the senior member of the committee, John McKay called the meeting to order at 7:45 p.m. Minutes of the previous meeting were distributed. Staff inember Kelley discussed the results of his meeting with the City Attorney over questions raised at the last meeting; the attorney felt all reference to licensing of handguns should be struck rather than referencing state law. The attorney would not be comfortable with specific definitions which did nat contain the phrase "but not limited to" tiecause common vernacular can and does change. The committee opened the floor to general discussion of specific parts of the ordinance. Suggestions for minor wording changes were made to clarify parts of the ordinance; "outdoor" for bow and arrow use, "City" approved predator/game control program and, at Mr. Asleson`s suggestion, movement of the "no one under the influence" section to a place where it would stand alone in order to eliminate a double negative. The permitted circumstance of shooting within a private residence was added, with the committee settling on language which stipulated structures with masonry backstops. At the request of Mrs. Durda, a provision for appeal to the Council over denial of an outdoor bow and arrow permit was added. Predator/game control programs were further defined by the inclusion of the clause "for the purposes and under the conditions to be described in the permit". There was some discussion for the term "under the influence"; Kelley was asked to check with the City Attorney on this. The committee felt that after this revision the special public meeting could be held and requested staff to advertise this for the February Z1, 1980 meeting. Handouts on a proposed change to Refuse Ordinance 4�66 were distributed and Asleson briefly outlined the history of the ordinance. The proposed change would be to allow curbside pickup of rubbish. Larry Knutson of Knutson Rubbish Service will be appearing before the committee to elaborate on this proposal and the reasoning behind it. MOTION: by McKay, seconded by Deters to adjourn at 9:00 p.m. Motion approved unanimously. �
