CITY OF APPLE VALLEY ' URBAN AFFAIRS COMMITTEE June l, 1987 Minutes of the Urban Affairs Committee meeting of the City of Apple Valley, Dakota County, Minnesota, held June lst, 1987, at 7:30 o'clock p.m. at City Hall. PRESENT: John McKay, Sharon Schwartz, Pamela Sohlberg; Councilmember Bill Holton, City Clerk Mary Mueller, Police Lt. Bruce Erickson and City Attorney Jim Sheldon. ABSENT: Shirley Doering, Stanley Fedoruk and Fred Me�ry. The meeting was called to order at 7:30 p.m. It was noted that there was not a quorum present so the meeting would consist of continued discussion. Mr. Fedoruk has submitted his resignation which will be received by the City Council on June 18, 1987. This will leave two vacancies on the Committee. The Committee reviewed some of the gambling ordinance related issues discussed May llth. Mr. Holton said he agreed with the concept of establishing minimal controls on gambling and dealing only with the problem areas. The Council's major concern is to restrict gambling to locally based organizations in some manner. The Committee concurred that one of the purposes of the ordinance should be to keep gambling proceeds in the community. Ordinances from Burnsville, Crystal and Eagan have been reviewed, Each one attempts to make this restriction in a different manner. Mr. Sheldon said the Committee should make a determination on its objectives and then staff can determine what steps to take to achieve them. Lt. Erickson said one concern of the Police Department is the potential for an outside management company to run gambling activities for an organization and take most of the proceeds for expenses. The profits would not be going to the purpose originally intended. He does not believe it is a problem for an organization to use an outside management company, but the operations should be reviewed. Ms. Mueller said state law specifies the percent of proceeds than can be used for expenses and the State Gambling Board has established what are allowable expenses. She will get a copy of the Board's rules for the next meeting. Organizations licensed by the State are required to submit monthly reports to the Board and Ms. Mueller said one condition of the ordinance could be to require that copies also be filed with the City. The Committee generally concurred that the ordinance should: 1. Apply to pull tabs licenses only. 2. Restrict licenses in the City to local organizations. 3. Allow licenses only in on-sale liquor and non-intoxicating malt liquor establishments. . � � � URBAAT AFFAIRS COMMITTEE June 1, 1987 - Page 2 4. Prohibit employees of an establishment from selling gambling chances while at the same time performing other duties. 5. Allow those activities exempt fram State licensing to continue without additional City restrictions or a permit. The next meeting will be Monday, June 22nd, 1987, at City Hall.
