HomeMy WebLinkAbout05/11/1987 � � i CITY OF APPLE VALLEY URBAN AFFAIRS M�NUTES May 11, 1987 MINUTES of the Urban Affairs Committee of the City of Apple Valley held Monday, May 11, 1987, at 7:30 p.m. at the Apple Valley City Hall. PRESENT: Shirley Doering, Fred Metry, Sharon Schwartz, Pamela Sohlberg; City Council Liaison Barbara Savanick, City Clerk Mary Mueller; Lt. Bruce Erickson of the AV Police; One visitor--Mr. Butch Schimek. ABSENT: Stanley Fedoruk and John McKay. The meeting was called to order at 7:30 p.m. Ms. Mueller indicated that the Gity Council would like the following points addressed in consideration of a gambling regulation ordinance. (Several changes in State Law have occurred since the City's original ordinance was adopted in 1982.) 1. Limit gambling licenses issued in the City to local organizations or provide that proceeds are used locally. 2. Specify the amount of lease payments which can be paid b3r organizations to establishments. 3. Determine who will do the actual selling of gambling chances; i.e. , members of the organization or someone hired by the organization. 4. Consider a permit process for those gambling activities which are exempt from State licensing so the Council has approval over when and where these events will occur. Gambling licenses would be issued by the State, but the City can specify the ' conditions which would allow gambling. The State controls the yearly licensing, but can restrict licensing by absolutely prohibiting gambling or restricting it to private clubs only. Lt. Erickson indicated that the position of the AV Police Department is i.f gambling is restricted to local operators, it can be more easily controlled. It would be more difficult for a person who comes from out-of- town to have records available at random. Lt. Erickson indicated he does not see a problem with the use of pull tabs, but it would be good for the City Council to pass some rules for control of this operation for the Police Department to operate under. The question of how much a person can lease space for to a non--profit organization was discussed, Where does money from the pull tabs go? Cauld the prof its be kept at the local level. Mr. Schmik indicated that his rent for his gambling operation at R, Berry's is based on the gross of income. He wishes to base his operation on the premise that his "eha�itable donation" go to the City--prof its to be used for lawful purposes. The City can require reports with items listed. Mr. Schmik said that there is a "lot of money" in pull tabs. The lease for the space used must run for one year, which corresponds with the length of the license. The Committee must decide should gambling operat�ons be restrieted to only on-sale establishments, the amount of a f ee, would outsie.e management be allowed, etc. Ms. Mueller indicated that perhaps a non-restrictive approach could be used for one year and then evaluate the operation to see if more restrictions are needed. . „ � � URBAN AFFAIRS MINUTES May 11, 1987 Page 2 It was suggested that the members of the Urban Affairs Committee study the issues and determine which items they wish to see controlled. Copies of ordinances from Burnsville, Crystal, and Eagan may be reviewed for further ideas. The Committee will study the "Drafted" ordinance of App1e Valley, amending Chapter 14 of the City Code providing specif ic conditions for and local regulation of state- licensed gambling in the Gity.
